About this file

This is Amendment 0001 to Solicitation 36C25626Q1127, issued by the Department of Veterans Affairs, Network Contracting Office 16 (Houston, TX) on August 13, 2026, with an effective date of July 31, 2026. The amendment publishes Government responses to vendor questions and incorporates binding clarifications into the solicitation.

The amendment addresses four key areas: (1) Utility Responsibility—clarifying that the contractor, not the facility, shall perform all electrical and plumbing connections required to install new equipment, including labor and materials, while coordinating with VA Facilities Management Service and accessing existing utility infrastructure; (2) Floorplans and Installation Drawings—confirming that the solicitation diagram is sufficient for planning, with offerors encouraged to attend the technical site visit to verify dimensions and utilities, and as-built drawings required upon completion; (3) Nonmanufacturer Rule (NMR)—confirming no SBA class or individual waiver applies to the specified products (Dinex, Traulsen brand-name-or-equal items), requiring nonmanufacturer offerors to supply products from domestic small business manufacturers and certify compliance under VAAR 852.219-76; and (4) Past Performance—clarifying that SDVOSBs may rely on relevant experience from OEM-authorized suppliers and major installation subcontractors as part of responsibility determination, provided the prime remains fully responsible and complies with subcontracting limitations. The amendment includes dimension plans and kitchen layout drawings as attachments. Offerors must acknowledge receipt of this amendment on SF-30 and submit it with their quotes. Closing dates remain as stated in the RFQ unless modified by separate amendment.

A.1 Amendment 0001 — Questions & Answers (Binding)

Solicitation: 36C25626Q1127 | Department of Veterans Affairs, NCO 16

These Questions & Answers are hereby incorporated into Solicitation 36C25626Q1127 and are binding on all offerors. Offerors must acknowledge this amendment on SF 30 and conform proposals to the clarifications and requirements herein. In the event of any inconsistency, the most recent amendment governs.

Interpretation Principles. The Government applies the plain-meaning rule and whole-text interpretation. Answers below clarify the solicitation without adding conflicting or unintended requirements. Where clarification modifies a requirement, it is effective upon publication of this amendment.

1. Utility Responsibility — Electrical & Plumbing Connections

Solicitation Reference: Section D.1(b) Requirements; Section D.1(i)(6) Contractor

Responsibilities (coordination with FMS; contractor responsible for all utility work).

Vendor Question: Section D.1(b) states ‘Electrical and utility connections will be provided by the facility,’ but Section D.1(i)(6) assigns responsibility for all utility work to the contractor. Who performs the electrical and plumbing connections?

Government Answer: This answer modifies Section D.1(b). The contractor shall perform all utility work required to install the new equipment, including electrical and plumbing connections, and shall coordinate all such work with VA Facilities Management Service (FMS) per Section

D.1(i)(6). The facility will provide access to existing utility infrastructure (e.g., panels, stub‑outs, floor drains) but will not perform the connections.

Amended Text — Section D.1(b) Requirements (replace the final sentence): The purchase shall include installation (including labor, electrical, plumbing, fabrication, and materials). The contractor shall connect all equipment to existing facility utility infrastructure. Electrical and utility connections are performed by the contractor and must be coordinated with VA FMS prior.

2. Floorplans and Installation Drawings

Solicitation Reference: Section D.1(e)–(g) equipment layout; Section D.1(i)(33) post‑installation documentation (as‑built drawings); Section E.5 Site Visit.

Vendor Question: Will VA provide detailed floorplans beyond the PWS diagram to support installation planning and required post‑installation drawings?

Government Answer: This clarification does not modify the solicitation. The solicitation includes a diagram sufficient to support planning. Offerors are urged to attend the technical site visit (see

Section E.5) to field‑verify dimensions, utilities, and equipment pathways. As‑built drawings are required upon completion per Section D.1(i)(33). Additional area drawings are provided as attachments to this Amendment.

3. Nonmanufacturer Rule (NMR) and Brand‑Name‑or‑Equal Items (Dinex, Traulsen)

Solicitation Reference: Section C (FAR 52.219‑33, Nonmanufacturer Rule; VAAR 852.219‑76, Certificate of Compliance for Supplies and Products); Section E.1 (Brand‑Name‑or‑Equal;

Volume I instructions); Section B.2 Item Information (Dinex/Traulsen brand‑name‑or‑equal).

Vendor Question: Has SBA granted an individual or class waiver of the nonmanufacturer rule for any specified products or classes in this solicitation? If not, how should offerors demonstrate compliance where brand‑name items are manufactured by other‑than‑small businesses, including in a multiple‑item procurement?

Government Answer: This clarification does not add new requirements. The solicitation does not include an SBA class or individual waiver of the nonmanufacturer rule for the items listed, and no waiver is granted by this amendment. Accordingly, offerors qualifying as nonmanufacturers must supply the product(s) of a domestic small business manufacturer or processor in accordance with FAR 52.219‑33 and 13 CFR 121.406(b). For multiple‑item procurements, compliance must be demonstrated consistent with 13 CFR 125.6(a)(2)(ii). Offerors may propose

‘equal’ items that meet all salient characteristics and are manufactured by domestic small‑business manufacturers to satisfy the NMR. Brand‑name items manufactured by other‑than‑small businesses may be proposed only if an SBA waiver is issued by amendment;

no waiver applies under this solicitation. To facilitate evaluation, in Volume I offerors should identify, for each quoted item (brand‑name or equal), the manufacturer and its small‑business status and certify compliance under VAAR 852.219‑76.

4. Past Performance (Responsibility) Use of OEM Supplier and Major Subcontractor

References

Solicitation Reference: Section E.1(iv)–(ix) Volume I instructions; Section E.7 Evaluation (LPTA)

Factor 3 Past Performance (Pass/Fail responsibility).

Vendor Question: May an SDVOSB prime rely on relevant project experience and past performance of its OEM‑authorized equipment supplier and/or major installation subcontractor as part of the responsibility determination, provided the prime remains fully responsible for contract performance and complies with all applicable limitations on subcontracting?

Government Answer: This clarification does not modify the evaluation framework. Past performance is assessed on a Pass/Fail basis to inform responsibility (FAR 9.104). The

Government will consider relevant performance information from the prime and may also consider references for a major installation subcontractor and/or OEM‑authorized supplier, where the prime’s submission clearly identifies each entity’s role and demonstrates the prime’s management, control, and integration of those entities in performance. The prime remains fully responsible for contract performance and must comply with VAAR 852.219‑73 and 852.219‑76, including limitations on subcontracting at 13 CFR 125.6. Volume I permits up to three relevant references; the prime may include references for these key entities, provided roles and accountability are explicit in the submission.
