About this file
This document is an Amendment (Standard Form 30) for Solicitation 36C25626Q0022, issued by the Department of Veterans Affairs Network Contracting Office 16 for teleradiology services at the Fayetteville Arkansas Health Care System. The amendment primarily serves to provide responses to questions from potential offerors, with no changes to the quote submission date and time.
The amendment includes a specific response to a volume inquiry, detailing weekend/holiday radiology exam volumes. During weekends and holidays from 6 AM to 6 PM, the average daily exam volume is 22 exams, comprising 7 CT scans and 14 X-ray examinations. These exams are predominantly STAT orders originating from the Emergency Department and Inpatient wards. The solicitation is set aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and seeks a contractor to provide professional teleradiology services for the Fayetteville VA healthcare system.

Melanie Hawley VA VHA 2020 AC 3434AE75 Contract Specialist Question (Q) 1: Is it possible to provide a summary of the estimated volume as follows:
- Weekday and weekend volume?
- STAT and routine volume?
- Overnight and daytime volume?
Response (R) 1:
**Weekends, Holidays, and After hours:** (Note: Almost all of these are ordered STAT and come from the Emergency Department and Inpatient wards.)
- The average daily exam volume on weekends/holidays from 6 AM to 6 PM is 22 exams:
- 7 CT
- 14 X-ray
- <1 Ultrasound (US)
- The average daily exam volume after hours (4 PM to 6 AM weekdays and 6 PM to 6 AM weekends) is 14 exams:
- 6 CT
- 7 X-ray
- <1 US
**Weekday Overflow Reads:** (Note: These are almost always Routine reads. We may need occasional, additional, weekday (Mon-Fri) support with STAT exams during non-holiday, routine business hours (0800-1630).
- The average daily exam volume for overflow reads on weekdays, during the hours of 6 AM to 5 PM:
- X-ray: 110
- CT: 27
- US: 11
- MRI: 10
Q2: How many of the CT exams are estimated to be CT Abdomen & Pelvis exams?
R2: Approximately 23%.
Q3: How many of the CTA exams are estimated to be CTA Abdomen & Pelvis exams?
R3: Approximately 24%.
Q4: For CLIN 0006, do the units provided represent hours of labor?
R4: Yes, this represents staff hours for setup plus troubleshooting connections.
Q5: Does the Nonmanufacturer Rule apply to the workstations required by this solicitation?
R5: Since our solicitation for teleradiology services involves the provision of professional services and not physical products, the nonmanufacturer rule does not apply in this instance. Vendors are expected to utilize their own equipment (workstations and PACS systems). We will be transmitting images from our PACS to the vendor's PACS, and the vendor's computers will not be connected to the VA network.
Q6: In light of recent VA initiatives, is the Government open to an alternative CLIN structure proposal (FTE vs Per Click) that would optimize cost savings to the VA over the course of the contract?
R6: No. Our needs cannot be met by FTE; we need reliable after-hours/weekend/holiday coverage as we are a 24/7 hospital. Our weekday case volume will vary with fluctuations in our own in-house staffing levels.
Q7: What's the flexibility on availability of service? Day to day? Hours available? Time to answer calls if needed?
R7: There is no flexibility for after-hours/weekend coverage as we are a 24/7 operation and the top priority for this contract is to obtain after-hours/weekend interpretations. Since most of those cases are STAT exams, there is also no flexibility with the time to answer calls. For routine, weekday coverage, we are more flexible, but we require dependable availability. and advance notice when there is limited availability.
Q8: What happens when there is more case volume than that is quoted?
R8: Currently we do not anticipate going beyond the estimated quantities/case volume. We mainly need support for STAT reads, after-hours/weekends/holidays, and to help with overflow of weekday routine cases. We have a group of on-site, daily radiologists assigned to read Mon-Fri during routine business hours, excluding holidays. We will occasionally require additional STAT support during normal business hours. If demand grows beyond our original estimates, we will work with the contractor and the Contracting Officer to determine if a contract modification is needed as this will depend on availability of funds.
Q9: How much tech support and IT support would be made available by the VA?
R9: We typically have one technologist after hours who performs X-rays and CTs for the Emergency Department and Inpatient wards, and can answer phone calls, relay messages and assist in submitting an IT trouble ticket. Our PACS technologist is also on call 24/7 for emergency local PACs issues. However, network IT support after hours is limited and overseen by National VA IT which is a remote-based call center with limited capabilities after hours. Local Radiology technologists and PACS technologists are not authorized to access or operate IT systems within the VA.
Q10: Is there an incumbent for this award? If so, what is the solicitation (contract) number, and contract value?
R10: No incumbent exists for this requirement as it is a new requirement.
Q11: Please confirm that compliant with the VAAR 819.501-70(c), VAAR 852.219-73, VAAR 808.004-70, that contracting will confirm at both the time of submission and time of award the eligibility of Size and SDV status of the SDVOSB offerors/awardee, to include the Managing Protégé Member of any Joint Venture offeror/awardee.
· VAAR 819.501-70(c) General principles for setting aside VA acquisitions. Reminder to offerors, that they must submit a copy of any Joint Venture Agreement with their offer.
Q12: Please confirm that compliant with C.12 VAAR 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023) (DEVIATION), the contracting office will:
· Confirm at time of offer the SDV status and Small Status to the corresponding NAICS code in the SBA Small Business Search https://search.certifications.sba.gov/ and www.Sam.gov (VAAR 852.219-73(b)(1) - Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.)

· Confirm that at time of offer and award, a managing Protégé Member of an SBA MPP SDVOSB Joint Venture will only be considered as an eligible SDVOSB if the protégé member is small in the applicable NAICS and a verified/certified SDVOSB.
Q12R: Contracting Officers (COs) are required to conduct a Determination of Responsibility in accordance with all applicable Federal and VA procurement regulations and policies. Offerors are reminded to provide ATT D7 VAAR 852.219-75 completed and return with their proposal. https://www.acquisition.gov/far/19.702?searchTerms=protege
19.702 Statutory requirements.
Any contractor receiving a contract with a value greater than the simplified acquisition threshold must agree in the contract that small business, veteran-owned small business (VOSB), service-disabled veteran-owned small business (SDVOSB), HUBZone small business, small disadvantaged business (SDB), and women-owned small business (WOSB) concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts with small business, VOSB concerns, SDVOSB concerns, HUBZone small business concerns, SDB concerns, and WOSB concerns.
(a)
(1) Except as stated in paragraph (b) of this section, section 8(d) of the Small Business Act ( 15 U.S.C. 637( d)) imposes the following requirements regarding subcontracting with small businesses and small business subcontracting plans:
(i) In negotiated acquisitions, each solicitation of offers to perform a contract that is expected to exceed $900,000 ($2 million for construction) and that has subcontracting possibilities, shall require the apparently successful offeror to submit an acceptable subcontracting plan. If the apparently successful offeror fails to negotiate a subcontracting plan acceptable to the contracting officer within the time limit prescribed by the contracting officer, the offeror will be ineligible for award. For a multiple-award contract with more than one North American Industry Classification System (NAICS) code, see paragraph (a)(2)(i) of this section.
(ii) In sealed bidding acquisitions, each invitation for bids to perform a contract that is expected to exceed $900,000 ($2 million for construction) and that has subcontracting possibilities, shall require the bidder selected for award to submit a subcontracting plan. If the selected bidder fails to submit a plan within the time limit prescribed by the contracting officer, the bidder will be ineligible for award. For a multiple-award contract with more than one NAICS code, see paragraph (a)(2)(i) of this section.
(iii) Each contract modification that causes the value of a contract without a subcontracting plan to exceed $900,000 ($2 million for construction), shall require the contractor to submit a subcontracting plan for the contract, if the contracting officer determines that subcontracting opportunities exist. For a multiple-award contract with more than one NAICS code, see paragraph (a)(2)(ii) of this section.
(2)
(i) For a multiple-award contract with more than one NAICS code, the solicitation referenced in paragraphs (a)(1)(i) and (ii) of this section shall require the apparently successful offeror to submit an acceptable subcontracting plan for either the distinct portion(s) or category(ies) of their proposal for which the offeror is other than small or for the entirety of their proposal, at the offeror's discretion. When determining the need for a subcontracting plan, the contracting officer shall consider the cumulative dollar value of the portion(s) or category(ies) of the offeror's proposal for which the offeror is other than small.
(ii) For a multiple-award contract with more than one NAICS code, the modification referenced in paragraph (a)(1)(iii) of this section shall require the contractor to submit an acceptable subcontracting plan for either the distinct portion(s) or category(ies) of the contract for which the contractor is other than small or for the entirety of their contract, at the contractor's discretion. When determining the need for a subcontracting plan, the contracting officer shall consider the cumulative dollar value of the portion(s) or category(ies) of the contract for which the contractor is other than small.
(b) Subcontracting plans (see paragraphs (a)(1) and (2) of this section) are not required–
(1) From small business concerns;
(2) For personal services contracts;
(3) For contracts or contract modifications that will be performed entirely outside of the United States and its outlying areas; or
(4) For modifications that are within the scope of the contract and the contract does not contain the clause at 52.219-8, Utilization of Small Business Concerns.
(c) As stated in 15 U.S.C. 637(d)(9), any contractor or subcontractor failing to comply in good faith with the requirements of the subcontracting plan is in material breach of its contract. Further, 15 U.S.C. 637(d)(4)(F) directs that a contractor’s failure to make a good faith effort to comply with the requirements of the subcontracting plan shall result in the imposition of liquidated damages.
(d) As authorized by 15 U.S.C. 637(d)(12), certain costs incurred by a mentor firm in providing developmental assistance to a protégé firm under the Department of Defense Mentor-Protégé Program, may be credited as if they were subcontract awards to a protégé firm for the purpose of determining whether the mentor firm attains the applicable goals under any subcontracting plan entered into with any executive agency. However, the mentor-protégé agreement must have been approved by the Director, Small Business Programs of the cognizant DoD military department or defense agency, before developmental assistance costs may be credited against subcontract goals. A list of approved agreements may be obtained at https://business.defense.gov/Programs/Mentor-Protege-Program/.
(e) In accordance with 15 U.S.C. 657r(a), a mentor with an SBA-approved mentor-protégé agreement (see 13 CFR 125.9) that provides a subcontract to its protégé may apply the costs incurred for training it provides to its protégé toward its subcontracting plan goals, provided that protégé is a covered territory business or that protégé has its principal office located in the Commonwealth of Puerto Rico.
Q13: Please confirm that compliant with 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (SEP 2023), (b)(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically), the contracting office requires:
· A complete copy of the Reps and Certs of the respondee at time of offer for review, affirming its SDVOSB status and small size status in the applicable NAICS 621512
· In the case of a Joint Venture, a complete copy of the Reps and Certs for both the Managing Protégé SDVOSB member and the Joint Venture respondee at time of offer for review, affirming its SDVOSB status and small size status in the applicable NAICS 621512. 13 CFR § 121.103 (h)(2) Size of joint ventures.
Q13R: Contracting Officers (COs) are required to conduct a Determination of Responsibility in accordance with all applicable Federal and VA procurement regulations and policies. Offerors of Joint Ventures must be registered accordingly in www.SAM.gov . Reminder to offerors, that they must submit a copy of any Joint Venture Agreement with their offer also.
Q14: Please confirm that in the event an MPP SDVOSB Joint Venture is the apparent awardee, based on the Joint Venture’s reps and certs submitted, please confirm contracting will review the contract award record of the Joint Venture in FPDS at time of award, to ensure that the Joint Venture is within 24-months of its first contract award date and still considered an SDVOSB for purposes of SBA affiliation 13 CFR § 121.103 (h) Affiliation based on joint ventures.
· To find terminations for cause on SAM.gov, log in to your account, go to "Entity Information," and then "Responsibility Qualification" under the search options.
· You can then search by the entity's name, Unique Entity ID, or Cage Code.
· The search results will display public records of terminations and other disqualifying information, with additional sensitive details potentially visible to authorized government users.
Q13 R: Contracting Officers (COs) are required to conduct a Determination of Responsibility in accordance with all applicable Federal and VA procurement regulations and policies. CO will verify in FPDS if required. Offerors that are providing a quote under a Joint Venture (JV) shall also provide a copy of the JV agreement with their offer.
Lastly, in addition to the above questions and responses/answers, as of December 15, 2025, FAR 13 has been overhauled and therefore the evaluation of this requirement will now fall under FAR 12 (12.203 for evaluation and 12.204 for award) and so this is a revision to FAR 52.212-2 and its addendum.
