About this file
This document contains a justification and approval for other than full and open competition and a related special notice of intent to award a sole-source contract. The justification provides approval to award a firm-fixed price contract to Harrell Design Group from March 2024 to March 2029 to complete the design of a replacement steam and condensate loop system at the Alexandria VA Medical Center in Pineville, Louisiana. Due to unforeseen site conditions discovered during an ongoing boiler and steam distribution system replacement project, Harrell Design Group, the designer of record for that project, is in the best position to efficiently complete the follow-on design work while mitigating risks to the steam supply system and hospital operations. The notice states the Veterans Affairs Network Contracting Office 16's intent to award this follow-on contract to Harrell Design Group on a sole-source basis due to no other responsible sources being available.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C25623AP5670
1. Contracting Activity: Network Contracting Office (NCO) 16 for Alexandria VA Health Care System, Project #502-21-115 Steam and Condensate Loop Replacement;
Purchase Request 502-23-1-5800-0001
2. Nature and/or Description of the Action Being Processed: This requirement arose when an unforeseen site condition revealed itself during the construction of Project 502- 14-102V Replace Boiler and Steam Distribution System which is being administered by CFM. After excavating an existing buried shallow concrete trench, contractors found the existing trench walls damaged beyond repair and capable of creating hazardous work environments. The trench walls contained steam and condensate piping that leaked which spalled concrete due to thermal cracking and exposure to chemical attack. At various locations, the spalling concrete was so severe that rebar within the concrete rusted which accelerated the wall failure. As part of the current construction Project 502- 14-102V, the AE Firm, Harrell Design Group (HDG), provided a solution to the unforeseen site condition encountered during construction. HDG recommended design change to install new direct buried drainable-dryable-testable (DDT) steam and condensate piping in a new direct buried trench system along the side of the existing trench. The completion of the installation of new steam and condensate piping is critical since the new piping system will increase pipe diameter which is needed to achieve full performance of the boiler plant steam production. HDG has a current design in place associated to this work. HDG is fully capable to execute this design within the time constraint. HDG has accomplished similar design on the station and continues to be fair, reliable, and reasonable. The construction is anticipated to be completed as a VOSB set aside.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Contractor shall provide a complete final design (construction documents) and construction period services (CPS) for all work deducted from Project 502-14-102V at Alexandria VAMC, Alexandria, LA. Work includes replace all underground steam distribution and condensate return piping system with new direct buried drainable-dryable-testable (DDT) steam and condensate piping in a new direct buried trench system along the side of the existing trench. Addition of new manholes, rework of existing manhole, and new isolation valves and steam components are required. This design must include the replacement of all major deficient crawlspaces and chapel mechanical room steam components, piping, condensate piping and pumps, and insulation that affects the performance of the steam energy distribution system.
Elevation profiles, ground penetration radar (GPR) surveys, utility locates, pothole surveys, and all necessary means must be included to validate new trench location and ensure the design is constructable in relation to setbacks for trenching and excavations.
All work shall be performed in accordance with the SOW and VA guidelines.
4. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;
( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;
( ) (6) National Security per FAR 6.302-6;
( ) (7) Public Interest per FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The design firm has an on-going design to replace the boiler and steam distribution system. Due to unforeseen catastrophic deterioration, associated with project #502-14- 102, a secondary logical follow-on design is needed to complete the overall intent of the 502-14-102 (Boiler and Steam Distribution) boiler project. The sole source to the established designer of record, HDG, will mitigate failure of steam supply, deter potentially hazardous conditions, and maintain continuity for the current project and the work needed to fully implement the intent of the Boiler and Steam Distribution project.
Failure to address this issue immediately could result in adverse impact to the hospitals facility functions.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None. This is a logical follow-on AE design to HDG for the reasoning listed above.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Negotiations will be conducted and compared to the IGCE as required to determine fair and reasonable pricing.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research indicates there are many capable AE firms that can satisfy this requirement. However, HDG has 100% situational awareness of the ongoing construction project mentioned above which mitigates most risks associated with possibly acquiring a new AE firm to design this portion of work.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There will be competition for the construction procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
Jarred Morales, COR Alexandria VA Medical Center, Pineville, LA
13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
a. Contracting Officer or Designee’s Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
b. One Level Above the Contracting Officer (Required over SAT but not exceeding
$750K): I certify the justification meets requirements for other than full and open competition.
