VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Last Updated: 02/01/22 Page 1 of 2
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1
For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C256-22-AP-4093
1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Network Contracting
Office 16 in support of VISN 16, Department of Veterans Affairs, VISN 16, G.V. “Sonny” Montgomery VA Medical Center, Medical Administration Service, 1500 E. Woodrow Wilson Drive, Jackson, MS 39216.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The services to be executed are the following: Non-Emergency, Patient Ground Transportation Services. The period of performance for this acquisition is 08-01-2023 thru 09-30-2027 which consists of a base year of twelve (12) months and four (4) option year periods that are each twelve (12) months in length which may or may not be exercised based on the needs of (and at the discretion of) the government. This justification corresponds to a no cost modification to Contract 36C25623D0085 for Non-Emergency, Patient Ground Transportation Services that was awarded to 28th Trans, LLC. UEI: QFBWKAW12YT7. The total cost of this modification is $0.00 and execution of this modification results in no change (no increase or no decrease) to the contract cost already established and published.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Statutory Authority Permitting Other than Full and Open Competition is the following: 6.302-2 Unusual and compelling urgency. A modification to Indefinite Delivery Indefinite Quantity (IDIQ) contract 36C25623D0085 (which was previously awarded to 28th Trans, LLC.) was required to incorporate additional, required language clearly specifiying maximum and minimum order quantities as part of this IDIQ. While this procurement has always been defined/described as an IDIQ, this contract required a modification to officially incorporate required language needed into this contract. Non-Emergency, Patient Ground Transportation Services are critical services that are vital for the delivery of patient care to veterans. Execution of these services (which are needed immediately) can only be furnished via a formal, established contract that contains all necessary language. The actions that pertain to this justification constitute a sole source action under this authority.
4. Description of market research conducted and results or statement why it was not conducted: Market research was not conducted for the modification that is associated with this justification and is a follow up action to a previously competed acquisiton which included market research that had been completed.
5. Contracting Officer's Certification: This purchase meets the FAR 13.106-1(b) and is approved based on an affirmative price fair and reasonableness determinations conducted utilizing the criteria outlined in FAR 13.106-3. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
