About this file
This justification document requests approval for brand name items for a potable water analyzer system and domestic water booster pump installation project at the Biloxi VA Medical Center campus in Mississippi. The project requires installation of components that match the existing potable water analyzers to minimize maintenance costs and ensure compatibility. A Metropolitan Metro Varipac variable speed pump system is specified to interface properly with the existing water system and ensure patient safety. The anticipated cost is approximately $500,000. The overall procurement will be competed as a 100% set-aside for Service-Disabled Veteran-Owned Small Businesses with a response due date of September 6, 2021 and anticipated award date within 30 days thereafter. The contract performance period will be 365 days from notice to proceed.

installation of components that match the existing potable water analyzers minimizes maintenance costs and bench stock requirements. It is necessary to match the existing system to ensure there are no interface problems and minimize impacts to patient safety due to the familiarity of the equipment by maintenance and operations personnel. This is the only way to ensure complete compatibility and that the campus will not have two Potable Water Analyzer systems on the Biloxi VA campus to maintain and operate.
b. Domestic Water Booster Pump
i. Metropolitan Metro Varipac System 2100 Model No. MS 33D PHI 70, Variable
Speed Pump System
ii. Impact: Installation of a system that interfaces properly with the existing potable water system in our main clinic building will ensure patient safety is maintained at the highest level. In lieu of assembling different parts and equipment from different sources to make up a complete booster pump system it is sought to instead procure one complete packaged system that has been trial tested and vetted to ensure product performance and reliability. The Metropolitan is a one stop shop that procures a complete potable water boosting system that is delivered with variable speed pumps, controls, programming, piping, and valve assembly. It is necessary to install the Metropolitan booster assembly to provide consistent water pressures to our main clinic building that includes Sterile Processing and Supply, ICU, Path Lab, Radiology, and our Emergency Department.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service Disabled Veteran Owned Small Business (SDVOSB) Set Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
The anticipated price to the Government for the items requested to be brand name is approximately
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Multiple (SDVOSB) companies are listed in VIP VetBiz and SAM, as general construction companies capable of meeting the requirements as listed in design drawings and specifications. Market research demonstrates that there are 119 SDVOSB’s registered in VIP VetBiz under NAICS Code 238220 in the NCO 16 area of operation. There are also three (3) SDVOSB’s on the current below $500K MATOC servicing the Biloxi VA Medical Center (who possess the capability to perform this size and magnitude of construction project) whom we believe will be very interested in proposing on this project. Therefore, from Market Research findings and the VA Rule of Two, it has been determined that this requirement shall be solicited as a 100% SDVOSB set aside on beta.SAM.gov.
Competing firms will deliver fair market prices for systems and items listed as all systems are common and use standard off the shelf components. The Contracting Officer and COR were in concurrence with information provided. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the Biloxi VA Medical Center.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
New components must be able to tie into an existing and operational system including the use of software. At this time, there are no competing vendors whose products are fully compatible with the existing systems being used to continuously monitor the potable water at the Biloxi VA Medical Center. Converting the entire facility to another manufacturer’s system to accommodate monitoring of 5 patient care buildings would be disruptive to medical center operations and prohibitively expensive.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
William Roberts Project Manager/COR, Biloxi VA Medical Center
13. Approvals in accordance with FAR 6.304
