DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT)

1. Contracting Activity: Department of Veterans Affairs, NCO 16, Michael E. DeBakey VA Medical Center

2. Nature and/or Description of the Action Being Processed: This procurement is for Sterile Processing service (SPS) at the Michael E. Debakey VAMC, is replacing all of their Medivators and Endodryer’s that were damage during construction from the construction site above room BB210 Scope Room. The requested equipment is essential equipment that is used for Endoscopic procedures across several departments at the VAMC. This will be a new contract for the purpose of purchasing the necessary equipment to carry out the department’s necessary responsibilities, in reprocessing endoscopic equipment.

3. To change to another manufacturer would require SPS to create new competencies, instructions of use, standard operation procedures, as well as retraining personally on a different system for sterilization. Market research confirmed that there were no other equivalent brands on the market, and as a result a Fixed-Firm-Price, sole source will be issued to Steris to satisfy the Government’s needs.

4. Description of Supplies/Services Required to Meet the Agency’s Needs: This action is for the procurement of Medivators disinfection equipment. The equipment is used to sterilize Endoscopic equipment used in the OR and Clinics. Due to the standardization of this acquisition this procurement will be processed on a Brand Name only basis.

5. Statutory Authority Permitting Other than Full and Open Competition:

(x) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements () Unusual and Compelling Urgency () Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services () International Agreement () Authorized or Required by Statute () National Security () Public Interest

6. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This contract represents the best value to the Government, in that it would not be timely, nor cost effective to change the pre-approved blue prints to meet the designs of a different manufacturer. This would result in a longer period to remodel the department, ultimately halting patient care with awaiting employees’ recertification on new equipment; whereby costing the Government additional delays and increased costs Medivators A Cantel Medical Company is the Standard across the VA system, in addition to Houston VAMC SPS department would have to write new SOP’s, IFU’s, and Competencies that would be in access of 300 new competencies and training for the employees.

7. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable

This procurement is only limited to the brand name being requested. The action is solicited as a SDVOSB Set Aside based on market research. More than one SDVOAB expressed interest in submitting a Quote.

8. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The CO will request pricing information from the manufacturer used in similar procurements to determine price reasonableness.

9. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A RFI/Sources Sought was submitted to Beta. SAM, on 06/06/2021 and closed on 06/10/2021. SDVOSBs expressed interest in providing the brand name equipment.

10. Any Other Facts Supporting the Use of Other than Full and Open Competition: To change to another brand would require SPS to create new competencies, instructions of use, standard operation procedures, as well as retraining personnel on a different system for sterilization. There’s no dollar amount that can be given for the re-training, re-writing of Competencies & Standard of Operating Procedures, if new equipment, other than Medivators, is to be purchased. The amount of manpower and time to do those things are beyond SPS capabilities (at the moment), with having 27 Medical Supply Technician (MST) vacancies, 2 Educator (1 retiring soon & other transferred to another department) vacancies, 1 Trainer vacancy. The SPS department will not only have to re-train & re-write those competencies & SOP’s, according to the Instructions for use (IFU), the contractors will have to be re-trained as well. For example, the Trainer is/has been working anywhere from 20-60 hours of overtime a pay period, sometimes 80 hours. Once those Comp’s & SOP’s are written, they must go through a chain of command for verification and signatures. For example, once written, the Chief must review and approve, then it is sent to Infection Control for review & signature, and then to the Associate Director of Patient Care for final review and signature. Once obtaining the signatures, the Administrative Support Assistant, will then scan & upload the Comp’s & SOP’s into the appropriate folder on the SharePoint drive. SPS Department is currently faced with staffing issues, and due to the enormous amount of work, with little staffing, it’s difficult for the staff to have time to train & stay compliant.

11. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

12. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Prior to processing a requirement for the same sterilization equipment, the government will conduct Market Research to determine if Market Conditions have changed which would ultimately enable the use of Full and Open competition.

13. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
