E.5 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor 1: Past Performance Factor 2: Management Approach
Factor 3: Price
Proposed Price Discounts (on price schedule)
The relative order of importance of the criteria is as follows (in descending order of importance). Factor 1, Past Performance, and Factor 2, Management Approach, are considered of equal importance to each other. Both of these non-price factors, when combined, are significantly more important than Price. Price will be evaluated for completeness and reasonableness of Proposed Discounts and Dispensing Fees. A Total Evaluated Price will be established for each offeror based on their Proposed Discounts and Dispensing Fees as described below which will be used in determining the best value offeror.
Factor 1: Past performance will be evaluated based on the offeror’s recent and relevant past performance in providing the same or similar services given size, scope and complexity of the work effort. The Government will consider past performance information provided by the offeror as well as other information obtained from the Past Performance Information Retrieval System (PPIRs) and other sources. The offeror shall have an opportunity to provide information on problems encountered on the identified contracts or any adverse information identified to which the offeror has not had a prior opportunity to comment. . The past performance information will be considered to the extent it is considered recent and relevant to the solicitation requirements. An overall past performance confidence assessment rating will be established for each offeror. The rating will reflect the Government’s confidence of the offeror’s ability to successfully perform the solicitation requirements based on their past performance record as appropriate. A neutral rating will be assigned to any offeror who does not have recent and relevant past performance in providing these services.
Factor 2. Management Approach. The offeror’s management approach will be evaluated in the following areas:
| a. | Technical –The offeror’s technical approach must demonstrate their understanding of the PWS requirements and their capability to meet all minimum requirements as identified in the PWS. Areas including staffing, document processing, and overall management of contract services must be adequately addressed. The offeror shall identify process of adding pharmacy’s for services for patients located in remote locations and insure timely services. The offeror’s approach must identify how they will recruit, train, and maintain an adequate number of trained and qualified personnel to perform all performance requirements as identified in the PWS. |
| b. | Prescription Processing – The offeror’s prescription processing/filling approach must identify the necessary systems and processes for processing prescriptions, dispensing, and documentation processing to meet all minimum performance requirements of the PWS in a timely manner. The proposed systems, processes, and operational procedures must comply with all required federal, state, and local laws and applicable VHA rules and regulations as stated or as referenced in the solicitation. |
| c. | List of Pharmacies to Proximity of Clinic's- The offeror’s list of pharmacies that it intends to use under the contract must be listed and be located within reasonable proximity of the Clinic’s identified in the PWS. Pharmacies must have the capability and capacity to provide prescriptions as required by the PWS to include adequate and qualified staffing to perform the prescription services required. |
Factor 3 – Price The offeror’s price proposal as reflected in the Schedule must be fully completed for all CLINS and option periods of performance. The offeror shall include their Proposed Discounts from AWP as shown in the Schedule for Brand Name Prescriptions and Generic Prescriptions. In addition, the offeror must also show their proposed Dispensing Fee per prescriptions . All prices submitted in the offeror’s price proposal shall be inclusive of all costs associated with providing the services as stated in the PWS.
The Government will evaluate each offeror’s Proposed Discounts and Dispensing Fee and establish a “Total Evaluated Price” for each offeror in order to support the final best value analysis. The “Total Evaluated Price” will be calculated based on the sample set of prescription data from Attachment 2 the Cost Calculation Document. The offeror’s Proposed Discounts and Dispensing Fee will be applied to the sample set of data to calculate the offeror’s Total Evaluated Price. The sample set is based on the top 10 drugs historically ordered. The Total Evaluated Price is only used for price comparison purposes only and is not intended to represent the actual prescriptions or quantities to be ordered under the contract. In supporting this evaluation, as included in the Instructions to Offerors, the Offeror is required to complete the sample set spreadsheet as shown in Attachment 2 Price Calculation Document by inputting their proposed discounts and dispensing fee in the designated spreadsheet cells. The spreadsheet has pre-loaded formulas which will automatically calculate the offeror’s Total Evaluated Price for the sample set of data. This Total Evaluated Price will be used in the final best value analysis to determine the best value offeror.
Award will be made on a best value basis given the evaluation factors specified and their relative order of importance. The Government reserves the right to award to a higher evaluated priced offeror where the perceived value of the past performance and/or management approach are determined to be worth the additional price premium. However, the Government will not award to a higher evaluated priced offeror where the additional price is deemed disproportionate to the perceived value. The Government’s subjective judgement and rationale for any price-technical trade-off will be documented.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision) E.6 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—COMMERCIAL ITEMS (OCT 2018) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
