Description This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, in conjunction with FAR part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.
This solicitation is issued as a Request for Quote (RFQ), and the solicitation number is 36C256-19-Q-1416. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-05, dated August 13, 2019.
The associated North American Industrial Classification System (NAICS) code for this procurement is 238220, with a small business size standard of $15 Million.
The Network Contracting Office 16-Biloxi VAMC, is seeking to purchase services for Backflow Preventer Testing and Certification for the Gulf Coast Veterans Health Care System. All work shall be completed per the Statement of Work (SOW) provided within. The SOW is a non-negotiable document.
Service Contract Act Wage Determination No. 2015-5148 Rev 9, dated 7/16/2019, applies to this acquisition and will be incorporated into the resulting contract. A copy of the wage determination is included with this solicitation.
A site visit is not scheduled with this requirement, but may be requested.
Any award resulting from this solicitation will be issued on a Standard Form 1449.

For the purposes of the award of this Contract, The Government intends to evaluate the option to extend services under FAR 52.217-8 as follows:
The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract at the time the option is exercised. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

B.2 STATEMENT OF WORK
ANNUAL BACKFLOW PREVENTER TEST
VA GULF COAST VETERANS HEALTH CARE SYSTEM
BILOXI, MS 39531
Furnish all labor, tools, materials, equipment, and supervision necessary to perform all work associated with testing and certification of approximately one hundred (100) backflow prevention devices located at the VA Gulf Coast Veterans Affairs Health Care System, 400 Veterans Avenue, Biloxi, Mississippi 39531.
The work required is listed as follows:
1. Contractor shall perform the differential testing on double check assemblies and reduced pressure principle assemblies (ranging in size of ½” thru 12”) for compliance with annual Mississippi State Health Department, Division of Water Supply, Cross Connection Control Program. The period of performance for this service contract will be for one year and for 4 consecutive years thereafter, beginning in the fourth quarter of FY 20.
2. Contractor to provide list of backflow devices that are tested and not certified. List is to contain location (nearest building and room number/side of building/size/type) of backflow device and description as to reason(s) device could not be certified.
3. Contractor shall coordinate work with the Biloxi, VAMC Utility Systems Operators Supervisor prior to start of work. Contractor is to contact the Utility Systems Operators Supervisor at 228-523-5721 or alternatively the Maintenance & Operations Supervisor at 228-523-5757 prior to testing. No testing or inspection of backflow devices shall occur until VA has given approval to start work.
4. Contractor shall provide to MS State Health Department all required forms and reports for the annual backflow preventer testing and certification. Contractor shall provide a minimum of 2 copies of any reports or forms provided to State Health Department to the Contracting Officer Representative (COR).
Installation Time
1. All work shall be completed within 15 calendar days after “Notice to Proceed” is received by the Contractor.
2. Work will be performed during the hours of 7:30 AM and 4:30 PM, Monday through Friday, exclusive of Federal Holidays.
3. Some work outside of normal hours of operations may be necessary and must be coordinated with the COR.

SPECIAL CONSIDERATIONS BY THE CONTRACTOR:
1. All disposal costs and fees for debris removal will be the contractor’s responsibility.
2. The contractor will be responsible for cleanliness of the building area both interior and exterior.
SAFETY CONSIDERATIONS:
1. Contractor’s workmen shall provide and utilize all safety requirements in accordance with OSHA regulations during all phases of the work.
Site shall always be kept clean and free from debris and Contractor shall remove debris daily from the health care system property. Contractor will not be allowed to use Government tools, materials, and/or labor for this project.
All work is to be performed in strict compliance with this Statement of Work.
The period of performance (POP) is Base plus Four (4) Options:

Award shall be made to the quoter whose quotation offers the best value to the government, considering technical capability, past performance, and price. The government will evaluate information based on FAR 52.212-2, Evaluation-Commercial Items and will award a contract resulting from this combined synopsis/solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Technical and past performance, when combined, are equal to price.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed six (6) years.

C.3 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

C.4 52.246-4 INSPECTION OF SERVICES—FIXED-PRICE (AUG 1996)
(a) Definitions. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.
(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may (1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract for default.

C.5 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)
The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.
(End of Clause) C.6 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)
(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside.
(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.
(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.
(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.7 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)
(a) Definitions. As used in this clause—
(1) Contract financing payment has the meaning given in FAR 32.001;
(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;
(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;
(4) Invoice payment has the meaning given in FAR 32.001; and
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.
(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).
(d) Invoice requirements. Invoices shall comply with FAR 32.905.
(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—
(1) Awards made to foreign vendors for work performed outside the United States;
(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;
(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;
(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or
(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.8 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)
The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Mississippi. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

C.9 VAAR 852.270-1 REPRESENTATIVES OF CONTRACTING OFFICERS (JAN 2008) (APR 1984)
The contracting officer reserves the right to designate representatives to act for him/her in furnishing technical guidance and advice or generally monitor the work to be performed under this contract. Such designation will be in writing and will define the scope and limitation of the designee's authority. A copy of the designation shall be furnished to the contractor.

C.10 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS—COMMERCIAL ITEMS (MAY 2019)
(a) The Contractor shall comply with the following Federal Acquisition Regulation (FAR) clauses, which are incorporated in this contract by reference, to implement provisions of law or Executive orders applicable to acquisitions of commercial items:
(1) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions)).

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS OCT 2018
This acquisition is being procured using Simplified Acquisition Procedures under the authority of FAR Part 13.5 procedures. This solicitation has been set aside 100% for Small Businesses which includes all CLIN items being requested in this solicitation. Offers shall only be accepted from Small Businesses. (Offers shall not be accepted from offerors in other socioeconomic categories). The Government intends to solicit this requirement and award a subsequent contract without discussions or negotiations. However, if necessary the Government will seek clarification and additional information for offers that are submitted from any eligible offeror. Therefore, offerors are encouraged to provide their best offer initially because the opportunity to enter into discussions or to provide a better offer at a later time will not be possible. The Government intends to award to the offeror whose offer represents the best value to the government after consideration of all technical and price/non- price factors. Pursuant to FAR subpart 13.106-2, the Government will award a Firm-Fixed Price contract to a single successful offeror/contractor whose offer/quote in response to this solicitation will be most advantageous to the Government. Award will be made to the lowest priced offeror that meets or exceeds ALL requirements of this solicitation and the Statement of Work (SOW).

(a) General Instructions
(1) Electronic Submissions: Contractors must email their quote to Sharon Griffey at sharon.griffey@va.gov Include the solicitation number in the Subject line. Any attachments must be readable using Microsoft Office or Adobe PDF. The size of the email is limited to 5 megabytes (MB) but multiple emails are allowable. Quotes must be submitted electronically and will not be accepted through fax or postal mail.
(2) All questions regarding this solicitation should be emailed to sharon.griffey@va.gov no later than 1:00 PM Central Daylight Time (CDT) August 27, 2019 (Biloxi, MS).
(b) Selection Process
(1) Evaluations will be conducted under the procedures of FAR Part 13.
(2) In accordance with FAR 13.106-2(b)(3), the quotes will undergo a comparative analysis evaluation to determine which vendor provides the best value to the government in terms of high technical capability and past performance, while also providing a competitive price.
(c) Quote Package Contents
(1) The quote package should address all the information listed in the evaluation factors under 52.212-2. There is not a required format that the information must be presented in. We will be focused on the content of the quote and whether it addressed all the evaluation factors.
(2) For the technical capability factor, the quote package should demonstrate the contractor’s staffing approach. The quote should indicate how many personnel the contractor will use to accomplish the work tasks, how much supervision will be performed, and the qualifications of the personnel to include certification, license and insurance. The quote should not simply restate the Statement of Work. Simply restating the Statement of Work will not be favorably evaluated.
(3) For the past performance factor, attachment 1 has been provided. Please complete attachment 1 and return with your quote package.
(4) The pricing information will consist of the unit prices in the price schedule. The vendors will provide unit prices for each line item with the extended annual price calculated and the grand total columns per year completed, including base year plus four (4) option years grand total.

Technical Capability/Certification Past Performance Price Technical and past performance, when combined, are approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO 52.212-2 – EVALUATION CRITERIA
The Government will award a contract resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate the quotes:
1) Technical Capability
2) Past Performance
3) Price
In accordance with FAR 13.106-2(b)(3), the quotes will undergo a COMPARATIVE ANALYSIS evaluation to determine which vendor provides the best value to the government in terms of high technical capability and past performance, while also providing a competitive price.
FACTOR 1 – Technical Capability For the technical capability factor, the quote package should demonstrate the contractor’s service and fulfillment approach. Packages will be evaluated using the information submitted in the quote and information addressing the certification requirements that requires backflow preventer testers be certified by the Mississippi State Department of Health. Proof of certification must be submitted with the solicitation.
FACTOR 2 – Past Performance Past performance will be reviewed to determine if the previous work was recent (within the past 5 years) and relevant (similar size and type of work). Past performance information will also be reviewed to determine the overall trend in the ratings of quality for previous contracts.
FACTOR 3 – Price When submitting pricing information, the contractor shall provide pricing consisting of a base annual rate and appropriate line items, with the extended annual price calculated and include each option year priced separately in the same format, with a grand total for the base year plus four (4) option years priced accordingly.
