The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days.

The Contracting Officer reserves the right to designate representatives to act for him/her in furnishing technical guidance and advice or generally monitor the work to be performed under this contract. Such designation will be in writing and will define the scope and limitation of the designee’s authority. A copy of the designation letter shall be furnished to the Contractor.

The Contractor shall not make reference in its commercial advertising to Department of

Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

C.5 VAAR 852.211-76 LIQUIDATED DAMAGES – REIMBURSEMENT FOR

DATA BREACH COSTS (FEB 2023) ALTERNATE I (FEB 2023)

(a) Definition. As used in this clause, ‘‘contract’’ means any contract, agreement, order or other instrument and encompasses the definition set forth in FAR 2.101.

(b) Non-disclosure requirements. As a condition of performance under a contract, order, agreement, or other instrument that requires access to sensitive personal information as defined in VAAR 802.101, the following is expressly required—

(1) The Contractor, subcontractor, their employees or business associates shall not, directly or through an affiliate or employee of the Contractor, subcontractor, or business associate, disclose sensitive personal information to any other person unless the disclosure is lawful and is expressly permitted under the contract; and

(2) The Contractor, subcontractor, their employees or business associates shall immediately notify the Contracting Officer and the Contracting Officer’s Representative (COR) of any security incident that occurs involving sensitive personal information.

(c) Liquidated damages. If the Contractor or any of its agents fails to protect VA sensitive personal information or otherwise engages in conduct which results in a data breach, the

Contractor shall, in place of actual damages, pay to the Government liquidated damages of

[$37.50] per affected individual in order to cover costs related to the notification, data breach analysis and credit monitoring. In the event the Contractor provides payment of actual damages in an amount determined to be adequate by the Contracting Officer, the Contracting Officer may forgo collection of liquidated damages.

(d) Purpose of liquidated damages. Based on the results from VA’s determination that there was a data breach caused by Contractor’s or any of its agents’ failure to protect or otherwise engaging in conduct to cause a data breach of VA sensitive personal information, and as directed by the Contracting Officer, the Contractor shall be responsible for paying to the VA liquidated damages in the amount of [$37.50] per affected individual to cover the cost of the following:

(1) Notification related costs.

(2) Credit monitoring reports.

(3) Data breach analysis and impact.

(4) Fraud alerts.

(5) Identity theft insurance.

(e) Relationship to termination clause, if applicable. If the Government terminates this contract in whole or in part under the Termination for cause paragraph, FAR 52.212–4(m), Contract

Terms and Conditions—Commercial Products and Commercial Services, the Contractor is liable for damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These damages are in addition to costs of repurchase as may be required under the Termination clause.

C.6 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND

VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JAN 2023)

(DEVIATION)

(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the

SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/

(see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13

CFR 121, 125 and 128.).

(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.

(d) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.

(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

C.8 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a

Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National

Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting

Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.9 VAAR 852.242-71 ADMINISTRATIVE CONTRACTING OFFICER (OCT

2020)

The Contracting Officer reserves the right to designate an Administrative Contracting Officer

(ACO) for the purpose of performing certain tasks/duties in the administration of the contract.

Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

(d) Comptroller General Examination of Record. D.1 Statement of Work

3-year Electrical Testing and Maintenance of Electrical Systems and Equipment at the Robert J. Dole VA Medical Center 5500 E. Kellogg Ave. Wichita, Kansas

1. General

The work under this contract shall be performed under the supervision of a Registered

Professional Engineer. The Registered Professional Engineer shall be on site initially to discuss with the Engineering Officer the procedures used to test, survey, report, and service the equipment required to be serviced under this contract. The Registered

Professional Engineer shall supervise the services personally, review the final report, and discuss with the Engineering Officer the results of the services, any recommendations, future actions, and professional opinions, which are contained in the report.

1.2 Field service work shall be performed directly by Field Service Engineers who have successfully demonstrated their knowledge and experience in the Field of

Electrical Power Distribution Systems Testing. The Field Service Engineer shall be capable of the following: (1) testing, assessing, evaluating, servicing, and reconditioning components, (2) assuring that the equipment on which work has been performed is safe, reliable, and acceptable for its intended purpose, and (3) identifying defective equipment and potential safety problems, environmental hazards, or code violations.

1.3 The Supervising Service Engineer must be accredited as a Certified Electrical

Test Technologist by the NICET (National Institute for Certification of Engineering

Technologists) or the NETA (National Electrical Testing Association) or similar certification and have a minimum of five (5) years of experience on similar major testing projects.

1.4 All other testing technicians assigned to the project must be certified by NFPA, NICET, NETA, or have an equivalent qualification certification.

1.5 Test assistants and apprentices may be assigned to the project as assistants to certified technicians at a ratio not to exceed two certified to one non-certified assistant or apprentice.

1.6 The names and certification numbers of the Registered Professional Engineer supervising the work and signing the test reports and the Supervising Field Service

Engineer must be provided by the Contractor and verified by the Contracting Officer before the contract award. After the contract award, similar data for all certified technicians who will be assigned to work on the project must also be submitted and approved before starting work on the contract.

1.7 The Contractor shall fully document all work performed. Testing shall be performed in compliance with manufacturers' recommendations and applicable NFPA

99, NFPA 70B, NEMA, NETA, ANSI, ASTM, ASA, and VA Standards.

1.8 Hours: The regular work hours for this facility are Monday through Friday, from

8:00 am to 4:30 pm (CST), excluding Federal Holidays. All maintenance shall be provided during the regular business hours of this facility.

Working Hours outages shall be scheduled and approved in writing at least two weeks in advance. Outages will be scheduled only at night and on weekends for certain facility such as Surgery, endoscopy, MRI, PET/CT, etc.

Note, not all types of electrical equipment are included in Table 1, the contractor is responsible for identifying all equipment requiring testing before submitting a quotation. Current year NETA-MTS are general guidelines enforced by VHA Directive 1028; the contractor may include equal or better testing methods that is subject to Project Engineer’s technical approval.

2.2.3 Check equipment for level, security to foundation, and operation of doors. Report any unfavorable environmental conditions such as excessive moisture or conducting dust that must be corrected. Clean where appropriate.

2.2.4 Visually inspect the equipment ground and record the number and size of ground bus and straps. Report deficiencies.

2.2.5 Inspect the insulation system on the primary bus and assemblies. Test insulation on each bus, phase-to-phase, and phase-to-ground with a suitable megohmmeter.

Record values, report deficiencies, and clean where appropriate.

2.2.6 Draw or rack each breaker from its cell. Remove arc chutes, clean, inspect, and adjust all contacts as necessary. Measure and record contact resistance in micro-ohms and clean all insulating surfaces. Megger and record phase-to-phase and phase-to-ground. Lubricate as necessary.

2.2.7 Electrically close and trip each breaker with a control switch. Manually close and trip each breaker. Trip each breaker with each of its protective devices. Tighten all connections. Record any discrepancies.

2.2.8 Remove each relay from its case. Clean, inspect, and tighten all connections.

Apply three multiples of relay tap current to each relay to verify the manufacturer's time-current characteristics. Test each relay for instantaneous pickup. Report deficiencies and adjust where appropriate.

2.3 Primary Disconnects.

2.3.1 De-energize the entire substation clean all insulating surfaces and clean and dress all contacts.

2.3.2 Activate each switch. Ensure the switch completely disengages and closes, clean the switch, and lubricate as required.

2.3.3 Measure contact resistance in micro-ohms, Megger each phase-to-ground.

Record any discrepancies.

2.3.4 Clean and inspect the cubicle, tighten all untapped connections, and lubricate as necessary.

2.4 Transformers

2.4.1 Record transformer nameplate information and compare it with the facility's one-line diagram, when available. Record discrepancies.

2.4.2 Inspect transformer and accessories and report damage, loose connections or material, shipping blocks, or contamination that must be corrected. Clean where appropriate. Inspect for leaks and tighten all untapped connections. Clean all insulating surfaces.

2.5 Low Voltage Circuit Breakers

2.5.1 Record switchgear, breaker, and device nameplate information and compare it with the facility's one-line diagram. Record discrepancies.

2.5.2 Inspect equipment and each breaker and report damage, loose connections or material, or contamination that must be corrected. Clean where appropriate.

2.5.3 Check equipment for level, security to foundation, and operation of doors. Report any unfavorable environmental conditions such as excessive moisture or conducting dust that must be corrected. Clean where appropriate.

2.5.4 Visually inspect the equipment ground and record the number and size of ground bus and straps. Report deficiencies.

2.5.5 Inspect the insulation system on the primary bus and assemblies. Test insulation on each bus, phase-to-phase and phase-to-ground with a suitable megohmmeter.

Record values, report deficiencies, and clean where appropriate.

3. Test Report

3.1 The test report shall include the following:

3.6 Furnish a copy or copies of the complete report to the owner/user's representative as directed in the contract.

4. INSPECTION AND TEST PROCEDURES

4.1 Switchgear and Switchboard Assemblies

4.2 Visual and Mechanical Inspection

4.3 Inspect for physical, electrical, and mechanical condition.

4.4 Compare equipment nameplate information with the latest one-line diagram when available and report discrepancies.

4.5 Check for proper anchorage, required area clearances, physical damage, and proper alignment.

4.6 Inspect all bus connections for high resistance. Check the tightness of bolted bus joints by calibrated torque wrench method.

4.7 Test all electrical and mechanical interlock systems for proper operation and sequencing.

4.8 Closure attempts shall be made on locked open devices. Opening attempts shall be made on locked closed devices.

4.9 Key exchange shall be made with devices operated in off-normal positions.

4.10 Clean switchgear.

4.11 Inspect accessible insulators for evidence of physical damage or contaminated surfaces.

4.12 Verify proper barrier and shutter installation and operation. Lubricate moving parts.

4.13 Verify appropriate contact lubricant on moving current carrying parts.

4.14 Verify appropriate lubrication on moving and sliding surfaces. Exercise all active components.

4.15 Inspect all mechanical indicating devices for proper operation.

4.16 Electrical Tests- Perform ground resistance tests.

4.17 Perform insulation resistance tests on each bus section, phase-to-phase and phase-to-ground.

4.18 Perform control wiring performance test. Use the elementary diagrams of the switchgear to identify each remote control and protective device. Conduct tests to verify the satisfactory performance of each control feature.

4.19 Control Power Transformer - Dry Type

4.20 Inspect for physical damage, cracked insulation, broken leads, tightness of connections, defective wiring, and overall general condition.

4.21 Verify that primary and secondary fuse ratings or circuit breakers match drawings.

4.22 Perform insulation resistance test. Measurements shall be made from winding to winding and windings to ground.

5. Transformers - Liquid Filled

5.1 Visual and Mechanical Inspection

5.2 Inspect for physical damage, cracked insulators, leaks, tightness of connections, and general mechanical and electrical conditions.

5.3 Check the tightness of accessible bolted electrical connections.

5.4 Verify proper liquid level in all tanks and bushings.

5.5 Perform specific inspections and mechanical tests as recommended by the manufacturer.

5.6 Verify proper equipment grounding and grounding electrode resistance.

5.7 Electrical Tests

5.8 Perform insulation resistance tests, winding to-winding and windings-to-ground, utilizing a megohmmeter.

6. Cables

6.1 Cables - Low Voltage - 600V Maximum

6.2 Visual and Mechanical Inspection

6.3 Inspect exposed sections of cables for physical damage.

6.4 Test cable mechanical connections to the manufacturer's recommended values with a calibrated torque wrench. In place of the above torquing, perform an infrared survey.

7. Air Switches - Medium Voltage - Metal Enclosed

7.2 Visual and Mechanical Inspection

7.3 Inspect for physical and mechanical condition.

7.4 Check for proper anchorage and required area clearances. Verify that fuse sizes and types correspond to drawings.

7.5 Perform mechanical operation tests per the manufacturer's recommendation.

7.6 Check blade alignment and arc interrupter operation.

7.7 Check each fuse holder for adequate mechanical support for each fuse.

7.8 Inspect all bus connections for tightness of bolted bus joints by calibrated torque wrench method. Refer to the manufacturer's recommendation for proper torque levels.

7.9 Test all electrical and mechanical interlock systems for proper operation and sequencing.

7.10 Clean the entire switch using approved methods and materials. Verify proper phase barrier materials and installation.
