About this file
This is a Notice of Intent to Award a Sole Source contract issued by the Department of Veterans Affairs, Veterans Health Administration, Network Contracting Office 12 (Great Lakes Acquisition Center). The contracting office seeks to procure a Sun Nuclear Software License Subscription Upgrade for the Pharmacy Benefit Management Department at Edward Hines Jr. VA Hospital in Hines, Illinois. The intended awardee is Sun Nuclear Corporation, located at 3275 Suntree Blvd, Melbourne, Florida 32940. The procurement will be awarded as a Firm-Fixed Price sole source contract under FAR 12.102(a). The NAICS code is 513210 (Software Publishers), with a Product Service Code of 6515 (Medical and Surgical Instruments, Equipment, and Supplies). The SBA size standard for this sector is $47.0 million. The solicitation number is 36C25226Q0609, with a response deadline of July 22, 2026 at 1:00 PM Central Time.
The government justifies the sole source award based on Sun Nuclear's exclusive rights to the SunCheck software, which is a proprietary quality assurance tool used in Radiation Oncology to support APeX credentialing and QA protocols from AAPM and ASTRO. The current software at Hines VA is nine versions outdated and can only be upgraded through Sun Nuclear under an annual service agreement. The National Radiation Oncology Program (NROP) has selected SunCheck for use across VA facilities and has negotiated national pricing with Sun Nuclear. Interested firms may submit written responses demonstrating capability and interest within five calendar days of publication by emailing Contracting Officer Arneil Genus at arneil.genus@va.gov. Telephone inquiries will not be accepted. Firms must indicate their business size status and ownership (large, small, small-disadvantaged, 8(a), woman-owned, U.S. or foreign-owned). If no written responses are received by the closing date, a sole source award will be made to Sun Nuclear without further notice.

DESCRIPTION
NOTICE OF INTENT TO AWARD SOLE SOURCE. THIS IS NOT A REQUEST FOR COMPETITIVE QUOTES. This is a notice of intent to solicit and award a sole source contract set forth in accordance with the Revolutionary FAR Overhaul (RFO) 12.102(a), Restricting competition.
The Department of Veteran Affairs, Veterans Health Administration, Network Contracting Office 12 (NCO-12) Great Lakes Acquisition Center, intends to negotiate a sole source Firm-Fixed Price to Sun Nuclear Corporation: 3275 Suntree Blvd, Melbourne, FL 32940 USA.IAW Federal Acquisition Regulation/Revolutionary FAR Overhaul 12.102. This is for procurement of the Sun Nuclear Software License Subscription Upgrade for the Pharmacy Benefit Mgmt. Department located at Edward Hines Jr. VA Hospital: 5000 South 5th Ave Hines, IL 60141-3030. The North American Industry Classification System (NAICS) for this requirement is: 513210 - Software Publishers. The Product of Service Code for this requirement is: 6515 - Medical and Surgical Instruments, Equipment, and Supplies. The Small Business Administration (SBA) size standard for this sector is: $47.0 million.
Sole Source Purchase of Sun Nuclear’ s SunCheck Software License Subscription Upgrade.
Rationale:
Pursuant to RFO 12.102(a), there is “only one source reasonably available” capable of providing the requested end-product under this acquisition.
Background SunCheck Software, the proprietary quality assurance tool used in Radiation Oncology, was originally acquired in 2021 and remains in active clinical use. It supports compliance with APeX credentialing and QA protocols from AAPM and ASTRO. Though the service contract lapsed, staff retain full competency, so only minimal retraining, if any, will be required.
Justifications:
1. Only One Responsible Source – FAR 6.302‑1 SunNuclear holds exclusive rights to the SunCheck software—no other vendor can provide the license upgrade or service contract. The current software at Hines VA is nine versions outdated and can only be upgraded through SunNuclear under an annual service agreement.
Under FAR 6.302‑1(a)(2), contracting without full and open competition is justified because “no other supplies or services will satisfy agency requirements”.
2. Clinical Continuity & Operational Efficiency Downtime or software incompatibility would disrupt QA processes tied to credentialing and certification protocols. Staff familiarity with SunCheck ensures seamless integration of upgrades without operational delays or additional training costs. Switching to an alternate system would require new exams, QA workflows, retraining, and data migration—increasing both risk and cost.
3. National Program Alignment & Pre-Negotiated Pricing The National Radiation Oncology Program (NROP) has evaluated QA tools and selected SunCheck for use across VA facilities. NROP has also negotiated national pricing and institutional discounts with SunNuclear, reinforcing vendor exclusivity and cost-effectiveness. This national endorsement strengthens the rationale for a sole-source contract under FAR 6.302‑1(b)(ii), which acknowledges situations where competition would cause duplicated costs or unacceptable delays.
In conclusion. Because SunNuclear is the sole provider of the required upgrade and service contract for SunCheck software, and because the software is essential for QA, regulatory compliance, and staff proficiency—coupled with national endorsement and pre-negotiated pricing, this procurement satisfies the conditions for a sole-source award under FAR 6.302‑1. A full and open competition is not practicable in this case.
This announcement is being issued for information purposes only and does not constitute a solicitation or request for competitive proposals. If a firm believes it is capable of meeting the Government's requirement and capable of providing an authorized letter to perform supply/services on this end-product, it may identify their interest and capability to the Contracting Officer within five (5) calendar days of this publication by contacting the Contracting Officer, Arneil Genus via email only at arneil.genus@va.gov. Telephone inquiries will not be accepted. Respondents who submit proprietary data shall clearly mark the data with appropriate markings. Those interested firms must indicate whether they are large, small, small-disadvantaged, 8(a) or woman owned business and whether they are U.S. or foreign owned.
The Government will not pay for any information submitted as a result of this announcement. This special notice shall not be construed as an obligation on the part of the Government to acquire any products or services. Responses are due no later than Wednesday, July 22, 2026 at 1:00 PM Central Standard Time. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government. If no written response is received within the closing date of this notice, a sole source award will be made to Sun Nuclear Corp. without any further notice.
