About this file

This document is a Justification for Brand Name Awards in accordance with FAR 13.106-1 for a federal contract opportunity from the Department of Veterans Affairs, VISN 12, William S. Middleton Memorial Veterans Hospital.

The requirement is for the purchase and installation of two Skytron FlexArm X-Ray Shields and one Skytron FlexArm Anesthesia Utility Boom for the Cardiology Cardiovascular Lab 1. These Skytron booms are the only ones that can be used due to the specific design requirements of the construction project they will be installed in. The procurement will be set aside for small businesses, with Skytron LLC as the sole source provider. The total estimated value is unknown. The required delivery and installation date is August 5, 2024, aligning with the construction project timeline. This is a continuation of a prior procurement that installed Skytron equipment in other areas of the facility.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Brand Name Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, VISN 12, William S. Middleton Memorial

Veterans Hospital has submitted for Lights And Booms to the Great Lakes Acquisition Center (NCO12).

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This justification and approval is for Brand Name Only Lights And Booms, procurement which will be set-a-side for Small Business and awarded as a firm-fixed-priced purchase order.

This order is estimated at

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The William S. Middleton Veterans Hospital Cardiology Cardiovascular Lab 1 is requesting the purchase and installation of two Skytron FlexArm X-Ray Shields (one with in light camera) and one Skytron FlexArm Anesthesia Utility Boom. The three FlexArms are required to meet best practices and standards for the Catheterization (Cath) Lab. The Skytron Freedom booms will be installed by the vendor and will need to occur in conjunction with the construction project 607-CSI-106. The construction and renovation of where the booms will be installed has been designed to solely support the installation of Skytron’s Freedom booms and no other lights and booms would be able to accommodate the design specifications incorporated in the construction project 607-CSI-106. This is considered a brand name only because they are the only vendor that would be able to meet the required timeline of delivery and installation by the delivery date of August 5th, 2024, and still ensure that the construction project 607-CSI-106 remains on schedule. Additionally, the room where the equipment will be installed has also been designed around the requirements of the Skytron Freedom Booms. The Madison VA has Skytron lights and booms as a primary vendor throughout the facility so this procurement would ensure standardization and ensure parts would be on hand for minor repairs. Finally, this is a continuation of a procurement from last year. 6 rooms of the Operating Room department and 3 rooms in the GI Department had this equipment installed, the procurement was solicited Unrestricted Brand Name Or Equal.

4. Description of market research conducted and results or statement why it was not conducted:

Original Equipment Manufacturer (OEM) for this requirement is SKYTRON LLC [CUFAYM193W16] who is considered a Small Business (SB) per System for Award Management (Sam.gov) Reps & Certs.

A document from OEM states that they have one exclusive provider to the VA, We have two (2) vendors that can meet the requirements of 13 CFR § 121.406(b)(1)(i)–(iii). Therefore, the Rule of Two is met to be able to do a SB set-aside. Based on the information provided above, it is determined this procurement shall be set-aside for Small business (Open Market/Brand Name only), and that the award can be made at a fair and reasonable

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(c). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
