1. ACQUISITION OF COMMERCIAL ITEMS:

This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 13.5 Simplified Procedures for Certain Commercial Items in which simplified acquisition procedures in FAR Part 13 will be used. FAR Part 14 and 15 will not be used. From this RFQ, the Government intends to award a firm fixed price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

1. SITE VISIT:

It is strongly suggested and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award.

SITE VISIT IS SCHEDULED FOR WEDNESDAY JANUARY 4TH, 2023 AT 14:00 PM LOCAL TIME. ALL INTERESTED PARTIES TO MEET POC HERBERT JONES AT THE MAIN LOBBY IN BUILDING #1. ALL INTERESTED PARTIES MUST RSVP to aaron.rogers1@va.gov, NO LATER THAN JANUARY 3RD AT 04:00 PM LOCAL TIME.

PLEASE NOTE: WHILE ON CAMPUS, ALL PERSONS WILL BE REQUIRED TO WEAR MASKS INSIDE ANY VAMC BUILDING AND WHILE TRAVELING IN VEHICLES FOR PURPOSES OF THE SITE VISIT.

1. CONTRACTING OFFICER AUTHORITY:

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

1. IDENTIFICATION, PARKING, SMOKING AND VA REGULATIONS:

1. All VA property is considered Federal property and all Federal laws are applicable.

1. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

1. All VA facilities are drug free. Possession of drugs, to include Marijuana and all Marijuana bi-products are prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

1. All contractor personnel are required to adhere to all VA rules and regulations.

1. Smoking is prohibited on the entire campus, both inside and outside the VA Facility

1. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

1. VHA DIRECTIVE 1192: This Veterans Health Administration (VHA) directive establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities through the vaccination or masking of health care personnel (HCP). AUTHORITY: Title 38 United States Code (U.S.C.) 7301(b), 7318(b). Contractor is responsible in ensuring that all aspects of this directive are implemented, including providing face masks and influenza vaccines for all employees working at a VA facility.

1. SECURITY & PRIVACY CONTROL:

Flash Badge:

Applies to common access to VA physical facilities only for a period of less than a 365-day period.

All contractor employees are subject to the same level of investigation as VA employees. The level of access needed to perform in accordance with the statement of work is: One ID compliant with PIV Guidelines. This requirement is applicable to all subcontractor personnel requiring the same access.

a. As part of this contract, each contractor shall be required to obtain government issued PIV badge and is subject to background investigation. The procedure to follow is:

· Contractors shall complete a “Request for a PIV card” form. Form can be obtained from the COR upon contract award.

· Contractors must get their fingerprints taken by Human Resources located in Building 17 on Hines campus. Must make an appointment ahead of time. It takes between 5-7 days at least for fingerprints clear. This action must be coordinated with the COR.

· The contractor can then be sponsored upon verification the fingerprints have been cleared.

· Once contractor has been sponsored they can call PIV (708) 202-5170 to make arrangements for issuance of a PIV for badge.

b. All Contractors entering campus buildings must go through the daily COVID-19 symptom screening check and wear masks at all times.

Flash Badges allow access to common VA physical facilities. Flash Badges do not allow access to VA information systems or restricted areas. Flash Badges may be issued to contractors who have a verified need to access common areas only. Flash Badges are issued following, at a minimum, the completion of an identity verification using one Form I-9 approved identity document with a photo. Flash Badges are valid for a period not to exceed one (1) year from the issuance date. Flash Badge must be visible at all times while on site.

If Contractor needs to work in sensitive/restricted areas (e.g. computer room/communications closets) appropriate VA staff must escort contractors while onsite.

1. SPECIAL NOTE: COVID-19 STATEMENT

A. Due to the current pandemic, contractors must be able to meet the screening policy in effect at the EDWARD HINES JR VA HOSPITAL. Contractor Personnel who screen positive, will not be allowed to enter any building on campus. Contractor Personnel must be able to answer “NO” to all of the following questions:

1. Do you have a fever?
2. Do you have a sore throat?
3. Do you have a new shortness of breath, within the last 21days?
4. Do you have a new onset of a cough in the last 21 days?
5. Have you traveled outside the U.S. in the last 14 days?

Contractors are required to wear an approved face mask over their nose and mouth when working on campus within 6 feet of another individual when outside, and at all times when inside a building.

12. VHA SUPPLEMENTAL CONTRACT REQUIREMENTS FOR COMBATTING COVID-19

1. Contractor employees who work in or travel to VHA locations must comply with the following:

a. Documentation requirements:

1) If fully vaccinated, contractors shall show proof of vaccination.

i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.

2) If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.

3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.

4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.

a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

1. For indefinite delivery contracts: Contractor agrees to comply with VHA Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.

B.3 STATEMENT OF WORK/PWS

PEST CONTROL SERVICES

STATEMENT OF WORK

The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, chemicals, materials, supervision, and other items necessary to develop and implement an Integrated Pest Management (IPM) plan for Edward Hines JR VA Hospital, 5000 5th Street, Hines, IL 60141. Contractor shall be responsible for the exterior campus grounds, all interior buildings located on the campus are covered by the staff onsite. These services shall be completed through the process of long-term, environmentally sound pest-suppression strategies utilizing a wide variety of technological and managerial practices with full consideration given to alternatives to the use of pesticides.

1.0 DESCRIPTION OF SERVICES

a. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, chemicals, materials, supervision, and other items necessary to develop and implement an Integrated Pest Management (IPM) plan for Edward Hines JR VA Hospital, 5000 5th Street, Hines, IL 60141, that includes the exterior campus grounds in a manner that will ensure the health and general wellbeing of patients, staff, and visitors.

b. IPM is a process for achieving long term, environmentally sound pest suppression through the use of a wide variety of technological and management practices. Control strategies in an IPM Program extend beyond the application of pesticides to include structural and procedural modifications that reduce the food, water, harborage, and access used by pests. The Contractor shall use targeted methods including habitat/facility modification, biological/genetic/cultural control, mechanical/physical control, and where necessary, the judicious use of the least hazardous pesticides to people, property, and the environment. The contractor shall perform to the standards in this contract in the development and implementation of the IPM Plan. The IPM shall comply with the requirements of VHA Directive 1850.02(1) (Attachment 1), and be approved by the COR.

2.0 SPECIFIC TASKS

Basic Services. The contractor shall provide Integrated Pest Management Services. The following tasks are required:

A. Frequency of Visits:

The Contractor shall establish a regular schedule to provide services as needed in conformance with the IPM Plan (or the next Business Day if the scheduled day falls on a Federal holiday). The Contractor shall ensure a current copy this schedule is delivered to the COR located in the Environmental Management Service Main Office, building 2, Room 101. Any visit conducted outside this schedule shall be coordinated with the COR with at least two (2) Business Days’ notice.

B. Routine Call Back:

The Contractor shall respond within one (1) Business Day after being contacted by the COR, at no additional cost to the Government, when in the COR’s sole judgment and discretion, retreatment/continuation of treatment of an area is necessary.

C. Areas of responsibility:

Contractor shall be responsible for the following:

a) Control of aquatic pests (i.e., mosquito larvae/pupae, algae, etc.).

b) Control of lawn and turf pests (i.e., sod webworms, Japanese beetle larvae, army worms, cutworms, wireworms, cinch bugs, crickets, ants, crabgrass, chickweed, broadleaf weeds, molds, blights, rusts, anthracnose, mildew, fungi, etc.).

c) Control of shade tree and ornamental pests (i.e., aphids, scales, meal bugs, mites, weevils, leaf miners, caterpillars, borers, sawflies, chafers, bacterial diseases, fungi, etc.).

d) Exterior treatment shall be conducted in the Spring and Fall, for all outdoor pests including, at minimum: Asian lady beetles, box elder bugs, spiders, ants, and clover mites.

e) Two Edward Hines staff pest controllers are present on campus and will cover all interior building spaces, however, the Contractor shall provide and maintain control of entry bait stations contractor will ensure that viable bait is maintained year-round.

f) Contractor will be responsible for wildlife, rodents, rat, and mice control throughout exterior of campus.

2. List of Pesticides/Chemicals: The Contractor shall provide to the COR, prior to the initial application of pesticides and/or chemicals and updating as necessary, three (3) copies of a list that includes the following information for each pesticide/chemical to be used under the IPM Plan:

· trade name.

· chemical name.

· a label showing contents of the chemical.

· the strength used.

· method of application.

· antidote or other emergency treatment; and the EPA Safety Data Sheet.

3. Special Requirements for Rodenticides/Traps: All rodenticides or traps shall be placed only at times and in the areas approved by the COR. Rodenticides and/or traps shall be replaced as necessary, per manufacturer recommendations. No pest control material or trap shall be placed where it may be accessed by patients, nor shall such material be allowed to contact food or cooking utensils. The use of rodenticides shall be used in accordance with current EPA rules and regulations, and all applicable codes. A record in duplicate shall be made of the location where each portion of any such rodenticide and/or trap is placed; one copy is to be retained by the Contractor and one copy is to be left with the COR.

4. Disposal of Hazardous Wastes. The Contractor shall not dispose of any excess pesticide, pesticide containers or any other materials contaminated by pesticides at any location on the medical facility premises except as specified by the Chief, Environmental Management Service and COR.

5. Storage of Pest Control Materials. No pest control materials or equipment shall be stored or kept at the VA medical facility when the operator is not working, without the express approval of the COR. No pest control materials, supplies, or chemicals shall be left unattended on VA medical facility or VA grounds

3.0 General Requirements

COMPLIANCE WITH THE GENERAL SAFETY REGULATIONS

All Contractors and Subcontractors performing services for the Government are shall comply with VHA Directive 1850.02(1), all Occupational Safety and Health Administration (OSHA), State, County and Municipal Safety and Occupational Health Standards and any other applicable rules and regulations. Also, all Contractors and Subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site area under this contract.

All ladders, scaffolding, tools, equipment, personal protective equipment, etc. shall be OSHA approved for the work to be performed. Contractor shall use caution signs as required by OSHA Regulations. Caution signs shall be on-site on commencement of Contract.

The Contractor shall purchase and issue all chemicals in their original containers. Materials that require precautionary warnings shall have affixed to all containers such labels or markings as are prescribed by law, regulatory agencies or this Contract. Any violation of OSHA may be subject to default action.

Contractor shall furnish to the COR two (2) copies of Material Safety Data Sheets (MSDS), for all products proposed for use, a minimum of seven (7) days prior to beginning service, for approval. Contractor must update copies of the MSDS on an annual basis. In addition, each time a new chemical product is proposed to be introduced into the facility, a copy of that product's MSDS must be provided to the COR for approval, prior to the product being used at the facility.

4.0 HOURS OF OPERATION

A. Hours of Operation. Regular business hours are between 8:00 AM and 4:00 PM CST, Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. However, not all tasks will be performed during normal business hours. The Contractor will not be paid extra for services that occur outside of normal business hours. The following are exceptions that may be required to be performed after normal business hours:

1. The Contractor will not be reimbursed when the government facility is closed for any reason. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility is not closed for the above reasons.

2. The Contractor will respond to the Contracting Officer (CO) or COR within 24 hours of receipt of routine notifications at no additional charge to the Government.

B. Recognized Holidays. The following holidays are observed by the medical center. In the event the holiday falls on a Saturday, the Friday is the observed Holiday. If the holiday falls on a Sunday, the Monday is the observed holiday.

5.0 Contractor Orientation:

The Contractor shall attend an orientation prior to beginning any work under this Contract, at the COR’s discretion. This orientation may include the following topics: Contract terms and conditions; performance monitoring; badging procedures; safety; fire procedures; severe weather procedures; infection control; and other disaster procedures.

6.0 Illinois Certification/Licensure:

The Contractor and each one of its Pesticide Applicators shall be currently certified and licensed by the Illinois Department of Public Health.

7.0 FACILITY AREA DESIGNATIONS AND SQUARE FOOTAGE

Edward Hines VA Campus: The Campus is approximately 170 acres. The contractor shall provide pest control services to the exterior areas that have an impact on the patients and staff. These areas include Parking lots, Exterior of all buildings, etc.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. (a) Pursuant to 38 U.S.C. 8127(k)(2), the offeror certifies that—

(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.

(3) If VA determines that an SDVOSB/VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:

(i) Referral to the VA Suspension and Debarment Committee;

(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and

(iii) Prosecution for violating section 1001 of title 18.

(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. The Contracting Officer may, at their discretion, require the Contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the Contracting Officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.

(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.

(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed, and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.
