1. ACQUISITION OF COMMERCIAL ITEMS:

This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 13.5 Simplified Procedures for Certain Commercial Items in which simplified acquisition procedures in FAR Part 13 will be used. FAR Part 14 and 15 will not be used. From this RFQ, the Government intends to award a firm fixed price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

1. SITE VISIT:

It is strongly suggested and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award.

SITE VISIT IS SCHEDULED FOR TUESDAY AUGUST 10, 2021 9:00 AM LOCAL TIME. ALL INTERESTED PARTIES TO MEET COR CHERIE LADWIG (414-384-2000 X41061) AT MOTOR POOL.

PLEASE NOTE: WHILE ON CAMPUS, ALL PERSONS MAY BE REQUIRED TO WEAR MASKS INSIDE ANY VAMC BUILDING AND WHILE TRAVELING IN VEHICLES FOR PURPOSES OF THE SITE VISIT.

1. RFQ QUESTIONS:

1. CONTRACTING OFFICER AUTHORITY:

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

1. IDENTIFICATION, PARKING, SMOKING AND VA REGULATIONS:

1. All VA property is considered Federal property and all Federal laws are applicable.

1. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VA will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

1. All VA facilities are drug free. Possession of drugs, to include Marijuana and all Marijuana bi-products are prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

1. All contractor personnel are required to adhere to all VA rules and regulations.

1. Smoking is prohibited on the entire campus, both inside and outside the VA Facility

1. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

1. VHA DIRECTIVE 1192: This Veterans Health Administration (VHA) directive establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities through the vaccination or masking of health care personnel (HCP). AUTHORITY: Title 38 United States Code (U.S.C.) 7301(b), 7318(b). Contractor is responsible in ensuring that all aspects of this directive are implemented, including providing face masks and influenza vaccines for all employees working at a VA facility.

1. SECURITY & PRIVACY CONTROL:

The Authorization & Accreditation (A&A) requirements of VHA Handbook 6500.6 do not apply to this requirement, therefore, a Security Accreditation Package is not required. No A&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security If there are any questions related to privacy, please have a member of your staff contact the VA Privacy Service at (202) 461-6309. 10. FACILITY CHECK IN/OUT

The Contractor shall be required to call COR when departing for service at the facility campus. Upon arrival at the facility campus, the Contractor shall call Graphics (414-384-2000 x41010) to notify they are onsite. Upon departure, Contractor shall call Graphics (414-384-2000 X41010) to notify departure from facility. Should the COR not be available, the Contractor shall call Police Services to notify them they are on their way to the facility. This check in is mandatory for each service visit. Upon completion of each service visit, the Contractor shall and follow up an email to the COR, to document services rendered.

SUPPLIES OR SERVICES AND PRICES/COSTS

SNOW REMOVAL SERVICE

The Contractor shall provide all labor, material, tools, equipment, travel, parking fees, supervision and incidental services that are required to successfully provide snow removal and salting service of designated areas at the Clement J. Zablocki VA Medical Center, Milwaukee, WI 53295, as defined in the Statement of Work (SOW). The services provided under this contract shall be on-call at the full discretion of the Milwaukee VAMC. Service may be required 24 hours per day/seven (7) days per week and will include full-service snow removal and de-icing services.

STATEMENT OF WORK/SPECIFICATIONS

1. GENERAL

0. The Clement J. Zablocki VA Medical Center in Milwaukee, WI requires services to remove snow from, and deposit salt on designated areas (ATTACHMENT A – LOT INFORMATION) on the VA campus. Also, see ATTACHMENT B the Campus Snow-Plow Map which displays in the red shaded areas, the lots that are to be plowed. These services are meant to provide a safe environment for the patients, families, staff, and visitors during periods of snow and ice.

0. This contract shall cover all labor, material, tools, equipment, travel, parking fees, supervision and or incidental services that are required to successfully provide snow removal and salting service of designated areas (ATTACHMENT A – LOT INFORMATION) which constitute approximately 728,879 square feet of parking lots. Services shall commence on October 1, 2021. The services provided under this contract includes on-call at the full discretion of the Milwaukee VAMC. Service may be required 24 hours per day/seven (7) days per week and includes full-service snow removal and de-icing services.

1. CONTRACTOR RESPONSIBILITIES

1. The contractor responsibilities shall include:

A. Contractor shall be available 24 hours a day 7 days a week.

B. Contractor shall provide a point of contact phone number which can be utilized on a 24/7 basis.

C. Contractor shall be on site at the Clement J. Zablocki VA Medical Center WITHIN ONE (1) HOUR OF CALL, WITH A FULL WORK CREW for snow removal and/or de-icing services when determined necessary by Facility Management Division or Police Services.

D. Contractor shall be contacted via telephone for snow removal and deicing when the snow accumulates one quarter inch (1/4”) or more or when any ice or slippery conditions exist that would cause a safety hazard.

1. Contractor shall provide all equipment needed to perform snow removal and salting services. No dump trucks shall be used in performance of these contract services. Trucks used to perform service under this contract shall be pick-up size. At a minimum, the contractor shall have the following equipment available for use in performing the tasks of this contract:

A. Two (2) Pick-Up Trucks with salters; ¾ or 1 Ton B. One (1) Skid Loader with snow blower attachments; 4000-pound capacity C. Two (2) Front End Loaders with pusher boxes (one (1) min 8 foot; one (1) min 12 foot) D. ONLY Rubber blades or poly block blades shall be used on parking structures. Contractor shall be responsible for repair costs of structure surfaces, to include replacement of sealants, if other than rubber blades or poly block are used.

2.3 Contractor shall provide salt for use in performing these services. Salt shall not be stored on the VA Grounds. Contractor will be responsible for storage of salt off-site at a location that is not more than ten (10) miles from Milwaukee VA Medical Center campus to assure that salt will be on-site regardless of weather conditions. VA reserves the right to inspect the Contractor’s salt supply and storage facility for compliance.

A. The contractor shall begin salt application (per required one-hour response time Section 2.1.C) immediately to remove ice to provide secure footing or safe driving conditions by the snow removal operation. The Contractor shall be liable to ensure that adequate source of salt is readily available throughout the duration of the contract.

B. Road salt shall be used on parking lots. (Granular Sodium Chloride of 75% is approved.)

C. A urea-based or calcium magnesium-based deicer shall be used on parking structures. Contractor shall deice entire top level of parking structures and shall deice and clear other levels as needed.

D. Snow Melt Equipment will not be permitted to be used on VA facility property in performance of this contract.

E. Contractor shall not use any other salt, liquid deicers or “beet heat.”

2.4 Contractor shall perform services in a manner that will maintain a safe environment for the patients, families, staff, and visitors during periods of snow and ice.

A. At no time shall contractor dump snow over sides of structures, over fencing, over any guardrails or into any waterway on the campus or adjacent to the campus.

B. Contractor shall not cover any sidewalks with snow; if necessary, contractor shall hand-shovel to clean up sidewalks covered due to plowing efforts.

C. Contractor shall be required to hand-shovel parking structure stairs, entrances, exits, and connected sidewalks.

D. Contractor shall be required to hand-shovel crash lab areas that are not reachable with snow removal equipment to include sidewalk.

E. Contractor shall be required to hand-shovel around and between cars parked in handicap spots in Lot #1 when vehicles are unable to be moved.

F. Maximum snow accumulation on grass areas and curb areas adjacent to parking lots is three (3) feet and two (2) feet near intersections.

G. Snow in Contractor Lot must be removed to within 12 inches of Contractor’s trailers.

H. Wind Row tolerance is zero on lots and up to three (3) feet on area adjacent to lots (off curb, sidewalks & surfaces). Wind rows/snow piles shall not be placed in roadways for any reason. Contractor shall be responsible for snow that falls into roadways from contractor equipment and shall remove from roadway immediately. No snow shall be left or wind rowed in between “No Parking Signs” located on parking lots.

I. Haul off operation from snow shoot areas is required within 12 hours following snow fall.

2.5 Contractor shall be completely responsible for snow removal and disposal of the snow off of the VA premises and all city property adjacent to the VA campus to include waterways. All snow that is cleared from lots is required to be removed from the VA premises at time of service. No snow shall be stored in parking lots on campus for later hauling except as listed below.

a. Under emergency conditions, and with prior approval from COR, snow can be staged in the following areas for up to a maximum of 48 hours (ATTACHMENT F):

a. Lot 35 - no more than two (2) parking spots

b. Lot 1a SE Corner

c. On grass area adjacent to Building 109

d. On grass area south of lots 2 & 3

e. On grass area west of Building 84

f. Any area deemed necessary by COR based on weather severity. Permission shall be given in writing via email; Contracting Officer shall be copied.

g. South end of Contractor Lot

b. Snow removal by VAMC Staff is exempt from removal of grounds.

2.6 Contractor shall be responsible to clear all areas of snow and ice prior to 5:00 a.m. Local Time. Contractor will work continuously and may need to re-clear any areas previously cleared if snow and ice remain or re-accumulate. Sidewalks and roads are the responsibility of VAMC Staff however, if contractor efforts cover roads or sidewalks, Contractor is responsible for clean-up.

2.7 Contractor shall be responsible for damage to VA owned lots including curb and grass damage. Contractor shall be responsible for any damage, which may be caused by the contractor’s personnel during the operation of the Contractor’s owned equipment, including any personal property (i.e. vehicles) which may be present in the parking lots while snow removal is in process.

2.8 Contractor shall immediately notify the Milwaukee VA Medical Center Police Department and the COR of any vehicular accidents, or any damages incurred to VA property. For the purpose of insurance claims, the Contractor shall maintain a record of each vehicular accident for two (2) years after contract expiration including the repair work that is required to return vehicle to service.

1. CONTRACTOR/PROVIDED EQUIPMENT/SUPPLIES

3.1 Contractor shall furnish:

A. All vehicles and equipment necessary to facilitate snow removal and salt dispensing. Space provided at Building 107 for parking of up to four (4) contractor owned vehicles used for providing service under this contract. Contractor is allowed to store a Conex box in one of the four parking spaces provided. Additional spaces may be available depending on need for contractor spaces in lot.

B. VA does not provide power outlets for Contractor provided equipment.

C. Salt and urea-based or calcium magnesium-based deicer.

D. Cones, operational supplies and other miscellaneous supplies necessary to facilitate snow removal and salt dispensing.

1. PERFORMANCE STANDARD

3. If performance issues develop, Contractor shall develop and maintain a quality program to ensure services are performed in accordance with contract requirements and other commonly accepted commercial practices. If required, Contractor shall develop and implement procedures to identify and prevent defective services from reoccurring. Contractor shall clearly define procedures, which will be used to complete the work and confirm the above meets the requirements of these specifications.

3. The COR shall be responsible for monitoring the Contractor's performance. Performance deficiencies or poor performance identified during the term of the contract shall be documented by the COR, reported to the Contractor and to the Contracting Officer All deficiencies or poor performance shall be documented and shall be corrected within a specified timeframe agreed upon by CO, COR and Contractor when issue is discovered. The Contractor shall notify the Contracting Officer and the COR when correction(s) have been made.

1. TRAINING/LICENSES/QUALIFICATIONS

5.1 Contractor shall have been providing this type of service satisfactorily at a medical facility with comparable parking lot size (728,879 square feet) for the past three (3) years.

5.2 All snow removal contracted drivers/operators must possess a valid state driver’s license and be US citizens. Contractor shall provide a list of all employees who will be performing service under this contract to include name, address, and driver’s license number.

5.3 Contractor shall show proof that at least one driver possesses a CDL license for heavy equipment use.

5.4 The Contractor shall provide training to employees providing service under this contract and certify that contractor employees providing work on this contract are fully trained, insured, and completely competent to perform the required work and operate machinery used to perform required work. Contractor shall provide the COR with certification that driver training has been provided. Driver shall have certification, at minimum, on the National Safety Council’s online Defensive Driving Course (four-hour course), located at this website: https://www.nsc.org/safety-training/defensive-driving/courses/online. Contractor shall submit certificates with quote submission.

5.5 The Contractor must assign a job superintendent and provide a contact number of such, who will supervise and be directly responsible for the accomplishment of the work and shall PHYSICALLY REMAIN at the job site at all times while required services are being performed.

5.6 There shall be no employer-employee relationship between VA employees and the contractor or the contractor’s employee(s).

1. CHANGES TO CONTRACT

The VA may modify this statement of work when new construction projects, yet undetermined, impact the snow removal service operation during the term of this contract.

1. PROTECTION AND DAMAGE OF GOVERNMENT PROPERTY

Prior to service being performed under this contract, and for each of the contract option year, the contractor shall attend a preseason damage assessment with COR.

During work execution, the Contractor shall take special care to protect Government property. Damage resulting from Contractor operations shall be repaired by the Contractor, at no additional cost to the Government. Contractor shall be responsible to meet all OSHA/Safety requirements in the performance of the work. This shall include but not be limited to taking all the necessary precautions to protect the patients, visitors and/or staff at each location. Contractor shall be held responsible for any injuries and/or damage, which may be caused as a result of the Contractors failure to adhere to these requirements.

Contractor shall ensure that the equipment used to perform service under this contract functions in conformance with the latest published edition of the applicable EPA, OSHA, VA, Joint Commission, state, local, federal and all applicable VA regulations for the work identified herein.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor 30 calendar days prior to the contract’s performance period end. (2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.

(4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees.

(d) The Contractor shall comply with the limitations on subcontracting as follows:

C.6 52.228-5 INSURANCE - WORK ON A GOVERNMENT INSTALLATION (JAN 1997)

a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government’s interest shall not be effective --

(1) For such period as the laws of the State in which this contract is to be performed prescribe; or

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors’ proofs of required insurance and shall make copies available to the Contracting Officer upon request.

C.7 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employer’s liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
