VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Brand-Name Justification for SAP under the SAT

VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018

DEPARTMENT OF VETERANS AFFAIRS

Justification for Brand Name Only Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:_36C252-19-AP-0053; IntelliVue MX800 Monitors

1. Requesting Activity: Department of Veterans Affairs, William S. Middleton VA Medical Center, 2500

Overlook Terrace, Madison, WI 53705-2286

2. Contracting Agency: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 115

South 84th Street, Suite 101, Milwaukee, WI 53214

3. Purchase Request number: 607-19-1-969-0001

4. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The

Madison VA Medical Center is requesting (7) MX800 Perioperative Monitors and (9) IntelliVue X3’x to help them in providing health care to Our Nation’s Veterans. The MX800 Perioperative Monitor is an integrated PC with a large screen that provides one intuitive view with patient status and relevant clinical information at a patient’s bedside. This equipment also allows patient information to be sent and received across many IT modalities so the Doctors can make informed decision for the Veteran patient. The IntelliVue X3 allows the patient to be moved and to have this smaller monitor that is like a cell-phone with them. The IntelliVue X3 allows the same medical information traveling through the MX800 Perioperative Monitor to be seen on a smaller scale. The genius of these 2 devices is that they work concurrently, but yet are independent of each other. Both of these are able to provide up to the minute health information to Doctors that help save Veterans lives.

5. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Currently, Madison VA Medical Center has seven anesthesia machines currently configured for Philips MX800 monitors, thus providing standardization of patient care in the OR, PACU and ICU. Purchasing monitors with a different brand will limit their ability to utilize these monitors for all their current anesthesia machines, resulting in additional cost to reconfigure the anesthesia machines for a different brand of monitors and potentially cause safety concerns for the anesthesia team. Consistency in operation of and familiarity with anesthesia equipment is a major component of anesthesia practice. Since these new monitors will be used interchangeably with the Madison existing anesthesia machines and among the anesthesia providers, it is extremely beneficial to standardize the monitors in order to avoid dangerous or unsafe conditions, especially in emergent situations where time and accuracy are of the essence. Unfamiliarity and confusion due to different models or brands of monitors could cause problems, especially in crisis situations.

Standardization is key to ensuring patient safety. The new machines must work interchangeably with the older models we already have and are currently using. To change out the entire anesthesia department with a new line of anesthesia machines would require thousands of dollars, would require brand new installation and calibration, would limit our ability to serve the Veteran population for weeks at least, and a new anesthesia machines lineup would also have to work with our existing platform, that would take days to calibrate and tweak, so the machines could talk to each other and patient records. This total process would not be in Madison VA Medical Centers best interest.

6. Description of market research conducted and results or statement why it was not conducted:

This Contracting Officer has prior knowledge of purchasing this exact item, as this CO did extensive market research in FY18 and found that there are at least 2 SDVOSBs who can provide contract performance and who are authorized distributors for this make and model of medical equipment.

The exact Purchase request in FY18 was 607-18-3-969-0076 and the awarding action was 36C25218P5167. With this knowledge, it is in the government best interest to allow a SDVOSB set-aside in accordance with U.S.C 8127(d), and Public Law 109.461 section 502 by utilizing open market procurement procedures under FAR 13.106.

7. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
