Justification and Approval (J&A) For

Other Than Full and Open Competition (> SAT)

Acquisition Plan Action ID: 36C252‐19‐AP‐1436

1. Contracting Activity:

2. Nature and/or Description of the Action Being Processed:

Project 556‐17‐007: Replace Chiller #5 at Building 188 requires the acquisition of a new chiller on a brand name basis. The existing No. 5 1000‐Ton York centrifugal chiller was installed in 1989 and needs to be replaced by a new 1000‐Ton water‐cooled centrifugal magnetic drive chiller. The contract will be award as a fixed‐firm price contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The Captain James A. Lovell Federal Health Care Center (FHCC) has a requirement for removal of an existing 1000 ton chiller # 5 and replacing with a new 1000 ton centrifugal chiller. Contractor shall provide new chilled water and condenser water pumps to complete the system with VFD's to replace the existing pumps. Rework the existing cooling tower to accommodate flow requirements of the new chiller and verify that the new flow adequately covers the cooling tower fill. The new chiller and pump VFD's shall be connected to the existing front‐end control system in accordance with the drawings and specifications. Captain James A. Lovell ‐ FHCC has named the York 1000‐Ton water‐cooled centrifugal magnetic drive chiller (Model # HYP1278XHC30B‐46A) as a required Sole

Source item to complete this requirement. The FHCC currently has in‐place a service contract for all

York Model chillers currently in operational use throughout the Federal Health Care Center.

Contractor will be required to purchase and install this specific Sole Source item.

4. Statutory Authority Permitting Other than Full and Open Competition:

In accordance with 41 USC §3304(a)(1) as implemented by FAR 6.302‐1:

( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302‐1;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

FAR 6.302‐1 allows a Contracting Officer to make a sole source designation when the supplies or services required are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements. York chillers are used throughout Capt. James A. Lovell FHCC and no other manufacturer can provide a compatible alternative of the item needed.

Accordingly, York Corporation is the only firm capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

There were no other vendors considered, as it is in the best interest of the Government to acquire this item as a sole source.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

A construction estimate was developed by the architect‐engineer and the Government accepts it as the Government IGE. The Government will perform price analysis and pricing will be evaluated against the Government IGE and the bids received in response to the solicitation to determine that the proposed price is fair and reasonable and reflects reasonable value.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

No market research was conducted for this sole source procurement because of the rationale described in Item #9 below.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Utilizing a different manufacturer would require a new service contract, the purchasing of parts and or compatible components, the loss of in‐house expertise / knowledge from familiarity and history with current equipment and components, and increased cost associated with re‐training maintenance technicians on newly installed equipment. Other technical elements to be considered in which this brand name product offers:

‐ Integrated Variable Feed Drive (VFD) ‐ Magnetic Drive Chiller (Magnetic – Bearing)

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

None
