Replace 3 Boilers, Building 112 at the Clement J. Zablocki VA Medical Center, 5000 W. National Ave, Milwaukee, WI, 53295 Contractor shall furnish all labor, materials, equipment, and supervision in accordance with specifications & drawings to complete Project # 695-15-116, Replace 3 Boile rs, Building 112. This project includes demolition, site prepartion, removal and new constuction for the replacement of three existing 30,000 lb boilers with three new 50,000 lb water tube steam boilers with economizers and associated support equipme
nt. Work also includes installation of new deaerator tank and pumps, condensate tank and pumps and new reverse osmosis system. Architectural work includes limited mezzanine structural modifications, installation of new overhead door, and construction of a new electrical equipment room.
All work shall be completed within 630 calendar days from issuance of the Notice to Proceed. This project has a specific phasing plan that must be adhered to.
Project magnitude range: $5,000,000 and $10,000,000 NAICS 238220: Plumbing, Heating, and Air Conditioning Contractor s / SBA Size Standard: $15.0 million
This procurement is a 100% set-aside for CVE-Verified Service-Disabled Veteran-Owned Small Business Firms (SDVOSB) per the authority 38 U.S.C. 8127 ( Public Law 109-461). In accordance with VAAR 819.7003(b), at the time of submission of bid, the bidder must represent that it is a SDVOSB concern, a small business concern under the NAICS code assigned to this acquisition, and is CVE-verified for eligibility in the VIP database.

Base Bid: Contractor shall provide for and furnish all labor, materials, equipment, qualified supervision, and other items designated in this contract in accordance with the specifications and drawings to complete Project # 695-15-116: Replace 3 Boilers, Building 112 at the Clement J. Zablocki VA Medical Center in Milwaukee, Wisconsin.
All work shall be completed within 630 calendar days after receipt of the notice to proceed.

NOTICE TO BIDDERS: Award will be made to the responsible bidder who submitted the lowest responsive bid. A single award will be made on Base Bid.
NOTICE TO BIDDERS: The contractor will be working in an active hospital, and often-congested parking and driving area adjacent to an operating hospital. The contractor will be sharing roadways with patients, visitors, staff, vendors, delivery vehicles, and other contractors during the normal work day. Significant amounts of or large materials should be delivered off normal working hours or on week-ends to mitigate congestion and interference.
The contractor will be required to keep all other non-impacted roads, walks and entrances to grounds, parking, and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles. Submittals regarding staging of equipment, crane placement, storage of supplies, etc. are required. Off-hours and/or week-end deliveries of construction equipment or materials may be required.
NOTICE TO BIDDERS: Work shall not commence until all required submittals are approved by the Contracting Officer or the Contracting Officer’s Representative (COR). An approved cost-loaded, Critical Path Method (CPM) construction schedule is required prior to commencement of construction. See specifications for details. CPM schedule shall be approved by the Contracting Officer or the Contracting Officer’s Representative. See specifications for details.
NOTICE TO BIDDERS: Additional information regarding the general and specific scope of work is defined in the specifications and drawings. This BID SCHEDULE and the attached Scope of Work are in addition to and augment the specifications and drawings. ONLY ONE AWARD WILL BE MADE AS A RESULT OF THIS SOLICITATION.

Furnish all labor and materials for all demolition, site preparation, removal and new construction for the replacement of three (3) existing 30,000 lb boilers with three (3) new 50,000 lb. water tube steam boilers with economizers and associated support equipment. Work also includes installation of new deaerator (DA) tank & pumps, condensate tank & pumps and new reverse osmosis system. Architectural work includes limited mezzanine structural modifications, installation of new overhead door, and construction of a new electrical equipment room.
1. All work shall be completed within 630 days after receiving Notice to Proceed.
· Phase 1: Pre-construction (kick-off) Meeting is anticipated to be scheduled on the effective date identified in the Notice to Proceed (NTP).
· Phase 2: Pre-Construction Period duration is NTP + 45 calendar days (not to exceed). Within this period the contractor shall submit the following (as applicable per the specification requirements):
1. Logistics Plan.
2. Construction Security Plan.
3. Construction Phasing Plan.
4. Submittal Registry.
5. Accident Prevention Plan.
6. Activity Hazard Analyses.
7. Construction Schedule.
8. Schedule of Values.
9. Existing Conditions Survey.
10. Infection Control Plan.
11. Quality Control Plan.
12. Environmental Protection Plan.
13. Document Submissions.
14. Demolition Debris Management Plan.
15. Certificates, Licenses, and Training Documents.

· Phase 3: Boiler Procurement and Staging Period duration is NTP + 366 Days. All applicable documentation listed in Phase 2 and any necessary submittals required to mobilize must be approved by the COR prior to commencing work.
· Phase 4: Construction Period – Phase duration is to be 168 days, to be completed no later than NTP+578; Existing boilers must remain operational during heating seasons in accordance with contract drawing phasing notes (Sheet G004 Note 8).
Phase 3 must be completed prior to Phase 4 start. Construction is to begin no earlier than May 1st 2019 and be completed no later than October 15th 2019. All applicable documentation listed in Phase 2 and any necessary submittals required to mobilize must be approved by the COR prior to commencing work. No demolition or construction shall be started without COR review and approval of those items listed in the Pre-Construction Period unless authorized in writing by the COR or the CO.
Should naturally occurring weather delays occur, the contractor shall restart construction immediately once conditions permit.
· Phase 5: Construction Closeout Period duration is NTP + 630 calendar days. The contractor shall provide all required materials to include the following within 30 days of completion of Phase 4:
1. Inspection and Approval by the COR and/or the CO.
2. Final Approval and Beneficial Occupancy when applicable.
3. Warranties documents and O&M Manuals.
4. As-built drawings and record submittals.
5. Staff training when applicable.
6. Waste Reports.
7. Existing Conditions Re-survey.
8. Release of Claims

CONTRACTING OFFICER SPECIAL INSTRUCTIONS AS FOLLOWS
PROJECT 695-15-116: Replace 3 Boilers, Building 112 Requests for information or clarifications to solicitation documents shall be submitted to the Contracting Officer at anne.vossler@va.gov for action no later than March 2, 2018.
After compiling all required information, submit the information in accordance with the "Bid Due Date" in Block 13 of the SF 1442. Return the original and specified number of copies to the issuing office listed in Block 8 of the SF 1442.

Inquiries and all correspondence concerning this solicitation document should be submitted in writing to the Contracting Officer referenced in the solicitation. In accordance with Federal Acquisition Regulations Part 4, contractual documents (e.g. bids, proposals, awards, modifications, etc.) shall be completed and signed by the Contractor as follows:

(f) Agents: When an agent is to sign the contract, other than as stated in paragraph (a) through (e) above, the agent's authorization to bind the principal must be established by evidence satisfactory to the contracting officer.
ADDITIONAL PRIME CONTRACTOR INFORMATION - Safety or Environmental Violations and Experience Modification Rating Information Information provided below shall be applicable to solicitation 36C252-18-B-0230 1.) All Bidders/Offerors shall submit information pertaining to their past Safety and Environmental record. The information must contain a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. If such certification cannot be made, a Bidder/Offeror shall explain why and submit as much information as possible regarding the circumstances of its past safety and environmental record, including the number of EPA violations and/or the number of serious, repeat, and/or willful OSHA violations, along with a detailed description of those violations.
2.) All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR). This information shall be obtained from the Bidder’s/Offeror’s insurance carrier and be furnished on the insurance carrier’s letterhead. If a Bidder/Offeror’s EMR is above 1.0, Bidder/Offeror must submit a written explanation of the EMR from its insurance carrier furnished on the insurance carrier’s letterhead, describing the reasons for the elevated EMR and the anticipated date the EMR may be reduced to 1.0 or below.
3.) Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
4.) If the NCCI cannot issue an EMR because the Bidder/Offeror lacks insurance history, Bidder/Offeror shall submit a letter indicating so from its insurance carrier furnished on the insurance carrier’s letterhead, and include a letter from the NCCI indicating that is has assigned Bidder/Offeror a Unity Rating of 1.0.
5.) The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases, will be used to make an initial Determination of Responsibility.
6.) This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS
(a) This solicitation & all associated bid documents are available to interested parties in electronic file format from www.fedbizops.gov. No hard copy documents will be provided by the government.
(b) A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee on form SF 24, in the proper amount, by the time set for opening of bids, will result in rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(c) The bidder to whom a contract is awarded will be required to furnish a Payment Bond, on form SF 25A, and a Performance Bond, on form SF 25. (End of Provision) A.5 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;

A.7 52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be Twenty (20) percent of the bid price or $3,000,000, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

3.2 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JUL 2013)
(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
"Federal contracts and grants with total value greater than $10,000,000" means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
"Principal" means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

4.2 52.209-9 UPDATES OF PUBLICLY AVAILABLE INFORMATION REGARDING RESPONSIBILITY MATTERS (JUL 2013)
(a) The Contractor shall update the information in the Federal Awardee Performance and Integrity Information System (FAPIIS) on a semi-annual basis, throughout the life of the contract, by posting the required information in the System for Award Management database via https://www.acquisition.gov.
(b) As required by section 3010 of the Supplemental Appropriations Act, 2010 (Pub. L. 111-212), all information posted in FAPIIS on or after April 15, 2011, except past performance reviews, will be publicly available. FAPIIS consists of two segments—
(1) The non-public segment, into which Government officials and the Contractor post information, which can only be viewed by—
(i) Government personnel and authorized users performing business on behalf of the Government; or
(ii) The Contractor, when viewing data on itself; and
(2) The publicly-available segment, to which all data in the non-public segment of FAPIS is automatically transferred after a waiting period of 14 calendar days, except for—
(i) Past performance reviews required by subpart 42.15;
(ii) Information that was entered prior to April 15, 2011; or
(iii) Information that is withdrawn during the 14-calendar-day waiting period by the Government official who posted it in accordance with paragraph (c)(1) of this clause.
(c) The Contractor will receive notification when the Government posts new information to the Contractor's record.
(1) If the Contractor asserts in writing within 7 calendar days, to the Government official who posted the information, that some of the information posted to the nonpublic segment of FAPIIS is covered by a disclosure exemption under the Freedom of Information Act, the Government official who posted the information must within 7 calendar days remove the posting from FAPIIS and resolve the issue in accordance with agency Freedom of Information procedures, prior to reposting the releasable information.
