3. Scope Management and Changes The Government may add or remove locations, adjust authorized container quantities, or increase or decrease service frequency to address actual demand. No change affecting price, quantity, location, or delivery terms is effective unless authorized by the Contracting Officer through a contract modification. New sites shall not be charged until the modification identifies the address, service level, container requirements, estimated quantities, and price structure.

4. General Performance Requirements

· Provide uninterrupted, compliant service for each location at the frequency stated in Section 7.

· Maintain all required permits, registrations, licenses, insurance, and approvals throughout the period of performance.

· Use trained, competent employees who wear company identification or uniforms and can communicate effectively with VA personnel.

· Coordinate site access and schedule changes with the COR or designated site point of contact (POC).

· Protect patients, staff, visitors, property, and the environment during container exchange, loading, transportation, and spill response.

· Do not mix, consolidate, reclassify, or treat waste streams in a manner inconsistent with law, container labeling, manifests, or this PWS.

· Provide all required reports, manifests, certificates, portal access, training, and quality-control records without separate administrative surcharges.

5. Definitions and Waste Streams

Term
Performance Definition
Regular Regulated Medical Waste (RMW)
Infectious or potentially infectious waste lawfully managed as regulated medical waste, including blood-saturated materials, cultures/stocks, and isolation waste, excluding materials that must be managed as pathological, hazardous pharmaceutical, bulk chemotherapy, radioactive, or other separately regulated waste.
Sharps
Needles, syringes, lancets, infusion or connection needles, and glass or hardened plastic capable of puncturing skin.
Pathological Waste
Human tissues, organs, body parts, certain body fluids, and related specimens requiring incineration under this PWS and applicable law.
Trace Chemotherapy Waste
Items containing only residual/trace amounts of chemotherapy or hazardous drugs, such as empty used tubing, bags, syringes, gloves, gowns, or other contaminated disposable materials, when lawfully eligible for this waste stream.
Antineoplastic/Cytotoxic Waste
Waste contaminated with cytotoxic or antineoplastic agents that requires segregation, compliant packaging, and incineration. Bulk hazardous pharmaceutical/chemotherapy waste is outside this definition unless expressly added by modification.
Generator Copy
The shipping-paper or manifest copy provided to the VA generator at pickup and, after treatment/disposal, the completed copy signed by the receiving disposal facility.

6. Contractor-Furnished Containers, Packaging, and Equipment

· All containers shall meet applicable VA, OSHA, DOT, federal, and State of Michigan requirements for the assigned waste stream and transport configuration.

· Containers shall be clean, disinfected, leak-resistant as applicable, structurally sound, nestable or stackable where specified, and easy for VA staff to handle. Lids shall be compatible with the container, tamper-resistant, securely closable, and provide visual and audible confirmation of closure when available.

· Pathological-waste packaging shall be clearly labeled “Pathological Waste - Incineration Only.” Regular RMW and sharps shipping packaging shall carry the biohazard symbol and required shipping markings.

· The Contractor shall exchange filled contractor-owned containers with clean, disinfected containers and maintain the site-specific par level.

· The COR has final approval of all proposed containers, boxes, labels, carts, trailer equipment, and substitutions before use.

· The Contractor shall remove and replace damaged, dirty, odorous, leaking, unsafe, or otherwise unacceptable equipment immediately after notice.

· The Contractor shall provide product labels, EPA registration information when applicable, and safety data sheets for cleaning/disinfection products used on contractor equipment upon request.

7. Facility-Specific Performance Requirements Requirements and charges are location-specific. Equipment or service assigned to one location shall not be billed to another location. The main-campus trailer requirement applies only to Site 01.

· No routine service shall occur on Saturdays, Sundays, or federal holidays unless approved in advance. A pickup falling on a holiday shall occur on the next business day unless the COR approves an alternate date.

· The Contractor shall provide an annual schedule for recurring service and timely written notice of changes. On-call sites are excluded from the annual recurring calendar.

· At each pickup, provide documentation identifying the location, date, waste stream, number of containers, gross weight, tare weight, and net waste weight.

9. Safety, Transportation, and Spill Response

· Use vehicles appropriate for the waste transported, compliant with all applicable federal and state requirements, clean and sanitary, and equipped with required spill-control supplies.

· Maintain all required DOT and State of Michigan transportation permits and registrations.

· Use trained drivers/technicians knowledgeable in regulated medical waste handling, universal precautions, manifests, spill response, decontamination, and emergency notification.

· Assume custody and responsibility for waste when accepted from the VA and remain responsible through lawful treatment and final disposal.

· Maintain an approved Operations and Safety Plan and evidence of employee training. Keep applicable emergency procedures available in each transport vehicle.

· Clean and disinfect any contractor-caused spill or leakage and make all notifications required by law and the VA.

· Provide a 96-hour continuity/sustainability plan and conduct one annual tabletop drill with the main campus.

The Contractor shall physically remove the 48-foot main-campus trailer each week for waste removal, maintain the trailer fuel level during weekly service, position an empty compliant replacement trailer before removal, and shall not transfer waste from the VA trailer into another vehicle or trailer at the VA site.

10. Weighing and Measurement The Contractor shall use a currently certified weighing system suitable for billing. Net billable waste weight equals gross loaded weight minus the verified tare weight of contractor containers, carts, pallets, and packaging that are not themselves treated as waste. The Contractor shall not bill the Government for reusable container weight. Scales shall be available for Government inspection, and current certification shall be provided upon request.

11. Permits, Licenses, and Treatment Facilities

· Obtain and maintain all permits, licenses, approvals, registrations, and insurance required for packaging, pickup, transportation, transfer, storage, treatment, and disposal.

· Use only permitted transporters, transfer facilities, treatment facilities, incinerators, and disposal facilities appropriate for each waste stream.

· Provide current permits, licenses, facility information, and proof of insurance before performance and upon renewal or request.

· Notify the COR and Contracting Officer before changing a transporter, transfer facility, treatment facility, or disposal facility.

12. Treatment and Final Disposal

· Treat regular RMW and sharps by a legally permitted method, including autoclaving followed by lawful disposal when appropriate.

· Incinerate pathological waste and all antineoplastic/cytotoxic/trace chemotherapy waste required by this PWS or applicable law to be incinerated.

· Do not landfill untreated regulated medical waste.

· Provide treatment and disposal records traceable to each pickup, location, waste stream, weight, treatment facility, treatment date, method, and final disposal destination.

· Maintain contingency capacity for waste that cannot be treated by the primary method or at the primary facility.

At Sites 02 through 08, the authorized contract waste stream is sharps only. The Contractor shall not accept or invoice another waste stream from an off-site location unless the Contracting Officer adds that waste stream by contract modification.

13. Manifests, Reporting, and Online Account Management Provide four VA employees with online access to current and historical manifests, regulatory documents, pickup scheduling, and invoices unless the COR changes the authorized-user count.
