INDUSTRIAL HAZARDOUS WASTE: Consists of hazardous waste, non-hazardous waste, liquid industrial waste and recyclable with these specifications included in all classes

· Hazardous waste is defined by the State of Michigan as waste that poses a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of, or otherwise managed. This includes wastes that are ignitable, corrosive, reactive, or toxic.

The Michigan Department of Environment, Great Lakes, and Energy (EGLE) regulates hazardous waste under Part 111, Hazardous Waste Management, of the Natural Resources and Environmental Protection Act (NREPA), 1994 PA 451, as amended. Examples of hazardous waste can include certain spent solvents, electroplating wastes, and some discarded commercial chemical products. infectious waste, pharmaceutical waste, chemical waste, and radioactive waste.

· Non-hazardous waste refers to industrial waste that does not meet the criteria for hazardous waste. While not classified as hazardous, it still requires proper management and disposal to prevent environmental contamination and protect public health. This category often includes general industrial trash, construction and demolition debris, and certain process wastes that are not ignitable, corrosive, reactive, or toxic according to regulatory definitions. The management of non-hazardous industrial waste is typically regulated under Part 115, Solid Waste Management, of NREPA.

· Liquid industrial waste encompasses any waste that is generated by an industrial or commercial process and is in a liquid state. This category can include both hazardous and non-hazardous liquids. Examples might range from wastewater treatment sludge and spent coolants to certain types of oils and chemicals that are not classified as hazardous but are still in liquid form. laboratory chemicals, pharmaceutical waste, and certain cleaning solutions.

Michigan's regulations for liquid industrial waste are primarily found in Part 121, Liquid Industrial Waste, of NREPA. This part focuses on the proper transportation, storage, treatment, and disposal of these wastes to prevent spills and environmental damage.

· Universal Waste refers to specific categories of hazardous waste that are subject to streamlined regulations, making their collection and management less burdensome than other hazardous wastes. This regulatory approach aims to encourage proper disposal and recycling of these commonly generated hazardous materials, thereby preventing them from entering municipal landfills and causing environmental harm. The primary categories of universal waste in Michigan, as defined by the Michigan Department of Environment, Great Lakes, and Energy (EGLE), include:

1- Batteries: This category encompasses a wide range of batteries, including nickel-cadmium, lead-acid (sealed and unsealed), mercury, Lithium and other battery types that exhibit hazardous waste characteristics.

2- Pesticides: Recalled or unused pesticides that meet the definition of hazardous waste are classified as universal waste. This includes agricultural, household, and industrial pesticides.

3- Mercury-containing equipment: Devices and components that contain elemental mercury, such as thermostats, thermometers, and certain switches, fall under this category. The mercury content makes them hazardous if improperly disposed of.

4- Lamps: This category includes fluorescent lamps, high-intensity discharge (HID) lamps, neon lamps, mercury vapor lamps, and other electric lamps that contain hazardous constituents like mercury, lead, or cadmium.

5- Antifreeze: While not universally classified as universal waste across all states, Michigan specifically includes antifreeze as a universal waste due to its potential to contain hazardous components like ethylene glycol and heavy metals.

6- Aerosol Cans: As of recent updates, non-empty aerosol cans that contain hazardous propellants or contents are also regulated as universal waste in Michigan, simplifying their management and promoting recycling.

7- Universal Waste Pharmaceutical (Universal Pharm) means a waste pharmaceutical managed in accordance with streamlined universal waste standards adopted for specific, common, hazardous waste types. Pharmaceuticals have been a universal waste type in Michigan since December 16, 2004. Universal Waste Pharmaceuticals includes RCRA/Part 111 pharmaceuticals intended for discard, their containers that are not RCRA“empty,” NIOSH hazardous drugs, and investigative chemotherapy agents. Non-hazardous pharmaceuticals may be included; however, once mixed are all subject to RCRA/Part 111universal waste regulations. Universal Waste Pharmaceuticals includes only drugs. It does not include spill cleanup materials from hazardous pharmaceutical spills or contaminated personal protective equipment used with hazardous pharmaceuticals. For additional detail on what is a universal waste pharmaceutical, please see the Universal Waste Pharmaceutical Guide Sheet provided as part of this guide.

· Recyclables are materials that can be collected, processed, and remanufactured into new products, thereby diverting them from landfills and conserving natural resources. For industrial settings, this can include a wide array of materials such as scrap metals, paper and cardboard, plastics, glass, and certain electronic waste. While not explicitly a "waste" in the traditional sense when managed properly, the State of Michigan encourages and regulates the recycling of industrial materials to promote sustainability and reduce waste generation. Various initiatives and regulations under EGLE support industrial recycling efforts, often falling under the broader scope of solid waste management and resource recovery.

Each facility shall provide to the contractor and contractor shall collect and remove from each facility premises, treat and dispose of all “Industrial Hazardous Waste” generated by each facility in accordance with the terms of this agreement. Each facility is responsible for ensuring the Industrial Hazardous Waste is transferred to the designated and secured collection and pick up site for the contractor. The term “Industrial Hazardous Waste”: as used herein, shall include only those wastes defined by the United States Environmental Protection Agency (USEPA) as infectious waste in its Guide for Infectious Waste Management #EPA/530-SW-86-014, or defined by the USEPA as medical waste in 40CFR259.30 and any other wastes identified as infectious waste in any other applicable federal, state, county or municipal laws, regulations and guidelines.

Categories of Industrial Hazardous Waste(s) are identified in compliance with 40 Code of Federal Regulations (CFR) part 261.
