B.2 STATEMENT OF WORK
1) Introduction and Background The Dayton Veterans Medical Center (DVMC) requires comprehensive diesel and gasoline fuel testing and conditioning to ensure that the fuel used in its operations meets all necessary standards and specifications. This document outlines the requirements for these testing services to be provided by a qualified laboratory
2) Scope of Work Testing The contractor shall perform a series of tests on diesel and gasoline fuel samples from fuel storage tanks at DVMC. These tests are designed to evaluate various physical and chemical properties of diesel and gasoline fuel, ensuring compliance with federal and state regulations, and to maintain the performance and reliability of diesel-powered equipment at the medical center.
3) Testing Requirements The contractor shall perform the following tests on the diesel and gasoline fuel samples:
a. Elemental Metals Analysis
i. Determine the concentration of elemental metals present in the diesel and gasoline fuel using appropriate techniques such as ICP-OES (Inductively Coupled Plasma Optical Emission Spectroscopy) or equivalent.
b. Cetane Index
i. Measure the cetane index of the diesel and gasoline fuel to determine its combustion quality.
c. API Gravity
i. Measure the American Petroleum Institute (API) gravity, which indicates the density of the diesel and gasoline fuel relative to water.
d. Distillation
i. Perform a distillation test to characterize the boiling point range of the diesel and gasoline fuel.
e. Viscosity @ 40°C
i. Measure the kinematic viscosity of the diesel and gasoline fuel at 40 degrees Celsius.
f. Water and Sediment
i. Determine the water and sediment content of the diesel and gasoline fuel using ASTM D2709 or an equivalent method.
g. Thermal Stability
i. Assess the thermal stability of the diesel and gasoline fuel to ensure it does not degrade or form deposits at elevated temperatures.
h. Bacteria, Fungal, and Mold
i. Conduct microbiological testing to detect the presence of bacteria, fungi, and molds in the diesel and gasoline fuel.
i. Sulfur Content (ppm)
i. Measure the sulfur content in parts per million (ppm) using ASTM D5453 or an equivalent method.
j. Closed Cup Flash Point
i. Determine the flash point of the diesel and gasoline fuel using a closed cup method in accordance with ASTM D93 or an equivalent standard.
k. Water Content by Karl Fischer
i. Measure the water content of the diesel and gasoline fuel using the Karl Fischer titration method.
l. Cloud Point
i. Determine the cloud point of the diesel and gasoline fuel, which indicates the temperature at which wax crystals begin to form.
m. Pour Point
i. Measure the pour point of the diesel and gasoline fuel, which indicates the lowest temperature at which the fuel remains pourable.
4) Sope of work for Fuel Conditioning
a. The contractor shall provide all labor, tools, equipment and materials necessary to perform cleaning, filtration, decontamination and treatment of fuel for the fuel tanks located at the Dayton VA Medical Center 4100 w. 3rd Street Dayton, Ohio 45428. All testing and conditioning shall be completed during the months of August and/or September of each year.
5) Specific Tasks
a. Provide fall protection for ASTs
b. Provide primary and secondary spill containment
c. Provide emergency spill kits
d. Provide before and after samples of fuel straight from the tank for ASTM Bright & Clear Test
e. Provide field report of service performed and condition of the fuel and tanks including conditions of caps, gaskets, fittings and vents
f. Test fuel for condition of stability and microbial contamination using tests approved by ASTM international standards
g. Chemically treat fuel with appropriate inhibitor to promote stability and biocides to control microbial contamination as necessary
h. Mechanically remove water, microbiological growth and sludge contamination from diesel storage tanks by repeatedly dragging a flexible suction wand across the entire bottom of the tank
i. Run fuel through a closed loop filter circulating system consisting of three 1 micron bag filters, a 0.5 micron canister filter, oil and water separation through a coalescing unit and two water absorption filters, then return fuel to the tank under pressure
j. Contractor is responsible for capturing, containing, storing, transporting and disposal of all fuel/water contaminants that are generated from the performance of the job
k. Provide EPA number and non-hazardous waste manifest for any waste removed
l. Tag or label tank(s) noting date and description of service
m. Provide Fuel Quality Assurance Program certificate for tanks upon completion of services
n. All work shall be inspected by the Electric shop personnel during testing
6) Deliverables
a. The contractor shall provide a detailed report for each test performed, including the testing methodology, results, and relevant observations.
b. All reports shall be delivered electronically in PDF format to the designated DVMC representative within 15 business days of receiving the diesel and gasoline fuel samples.
c. The contractor shall notify DVMC immediately if any test results indicate non-compliance with applicable standards or could pose a risk to equipment performance.
7) Quality Control
a. The contractor shall adhere to all relevant ASTM, EPA, and industry standards for diesel and gasoline fuel testing. The testing laboratory must be accredited by ISO/IEC 17025 or an equivalent standard.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
(End of Clause) C.4 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
(End of Clause) C.5 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JAN 2023) (DEVIATION)
(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.
(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/ (see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13 CFR 121, 125 and 128.).
(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.
(d) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

C.6 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (OCT 2019)
(a) The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses (SDVOSBs) or veteran-owned small businesses (VOSBs) proposed as subcontractors in accordance with 852.215–70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.
(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

C.7 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)
(a) Definitions. As used in this clause—
(1) Contract financing payment has the meaning given in FAR 32.001;
(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;
(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;
(4) Invoice payment has the meaning given in FAR 32.001; and
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.
(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).
(d) Invoice requirements. Invoices shall comply with FAR 32.905.
(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—
(1) Awards made to foreign vendors for work performed outside the United States;
(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;
(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;
(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or
(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

E.2 52.237-1 SITE VISIT (APR 1984)
Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

E.3 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Price Technical Past Performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

E.4 BASIS FOR AWARD
Award will be based upon the best overall value to the Government considering the evaluation factors listed below utilizing Comparative Evaluation procedures.
The Government will evaluate quotations using the comparative evaluation process, where quotations will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. Each response must meet the minimum requirements of the solicitation.
The Government may determine that a quote is unacceptable if the quoted prices are significantly unbalanced or not all required information is provided.
Questions/Clarifications: In order to maintain integrity, all quoters are advised that any questions/clarifications shall be submitted in written form via email to the Contracting Officer designated in the solicitation and shall be received no later than August 11, 2025. Questions after that date may not be accepted.
Preparation of Quotes: The Government shall not pay any costs incurred in preparation and submission of quotes.
The Items identified below detail the criteria that will be required to be included in the submission of a quote package for consideration for award. Quotes should ensure that there is enough information in addition to the required information below to adequately describe how the quoter expects to meet or exceed the requirements identified in the Performance Work Statement. Failure to meet any requirement established in this RFQ may result in rejection of the quote.
Only emailed quotes shall be accepted. Quoter shall ensure that the quote is received to the designated contracting person prior to the closing date and time.
Failure to submit the necessary information may render the Quote unacceptable, in which case it will not be considered for award. Quotes will be evaluated in accordance with the criteria set forth below. Quoters are encouraged to submit quotes that represent the best terms and conditions of the Quoter.
Quoter shall provide (only emailed submissions will be accepted – maryjane.crim@va.gov):
· Narrative on how the vendor will meet fuel testing and conditioning requirements in the Statement of Work and in accordance with all required regulations to include the following:
· Proposed methodology
· Project timeline
· Innovation and problem solving
· Potential risks and detailed mitigation strategies
· Completed Price/Cost Schedule
· Pricing information with a breakdown of all labor (separate labor categories) and materials
· At least three and not more than five past performance for work of a similar size and scope within the past 5 years The VA will evaluate the following:
· Pricing
· Pricing will be evaluated whether it provides “best value” to the Government when compared to the IGCE, which was determined utilizing past and current contract pricing and informal quotes
· Technical
· Evaluate the offeror’s comprehension of the testing and conditioning requirements, including all specified details and nuances of the tasks
· Assess the offeror's approach to performing fuel sample testing and conditioning, including the techniques and equipment to be used (e.g., ICP-OES for elemental metals analysis, ASTM methods)
· Consider any innovative methods or technologies proposed to enhance the testing and conditioning process, and how the offeror plans to handle potential challenges
· Determine the practicality and likelihood of successful execution of the proposed technical approach within the defined project timeline (August and/or September each year)
· Examine the offeror's ability to identify potential risks and their detailed mitigation strategies; assess the measures proposed to ensure the quality of work and deliverables
· Past Performance
· The Government will review the quality, relevancy, and recency of the Quoters past performance as it relates to the probability of successful accomplishment of the required effort
· Evaluate the offeror’s past performance and experience with similar fuel testing and conditioning projects, particularly within medical or similar critical environments **NOTE: A site visit will be held on Wednesday, August 6, 2025 at 10AM. All interested parties who attend the site visit shall meet at the reception desk in the main entrance of the engineering building (bldg. 128).
E.5 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (MAY 2024) (DEVIATION FEB 2025) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
