About this file
This is a GSA Template L100 lease exhibit establishing net utility provisions for federal real property leases.
The exhibit outlines requirements for utilities excluded from rental consideration, primarily electricity. The Government must pay electricity costs directly to the utility provider, and the Lessor must install separate meters—not sub-meters—to measure Government usage only, with meter numbers and verification provided in writing to the Lease Contracting Officer prior to occupancy. No proration of utilities is permitted. If the Government pays separately for electricity, no more than 500 square feet of office space may be controlled by a single switch or automatic light control system on the Government meter. The Lessor must obtain a statement from a registered professional engineer confirming that all HVAC, plumbing, and other energy-intensive building systems can operate under the control conditions specified in the lease and identifying any systems that do not conform to ANSI/ASHRAE Standard 90.1 performance values or applicable state or local codes. An automatic control system must be provided to ensure compliance with heating, ventilation, and air conditioning requirements. The building operating plan must be effective as of the Lease Term Commencement Date and must include a schedule of startup and shutdown times for all building systems, including lighting, HVAC, and plumbing. The Lessor is responsible for providing and maintaining all utilities except electricity, as well as all services, maintenance, inspections, modifications, repairs, replacements, and improvements necessary for proper property operation in accordance with lease requirements.
