VENDOR QUESTIONS
I. Set-Aside Designation
Question 1. The solicitation is designated as a Total Small Business Set-Aside (FAR 52.219-6). MGM Solutions is a VA-verified SDVOSB. Under 38 U.S.C. § 8127(d), VAAR 819.7006, and Kingdomware Technologies, Inc. v. United States, 579 U.S. 422 (2016), the VA must apply the Rule of Two — determining whether two or more SDVOSBs can meet the requirement at a fair and reasonable price — before issuing under any other set-aside category, including general Small Business. Can the Contracting Office confirm that a documented Rule of Two determination was conducted and that fewer than two SDVOSBs were found capable? If not, we respectfully request the solicitation be reissued as a 100% SDVOSB set-aside.
Answer 1: Market Research was conducted in accordance with Revolutionary FAR Part 10. Based on Market Research and the Non-Manufacture Rule (NMR), research confirmed that this requirement does not meet the Rule of Two. This procurement is and will remain a small business (SB) set-aside.
II. Whole-Floor Coverage — Tamper and Battery Monitoring
The SOW states (page 4): "The system will need tamper monitoring and battery monitoring for the bracelets. Coverage area on each floor is about 15,000 sqft." This language raises the following critical technical questions:
Question 2. Must the system provide tamper and low-battery alerts anywhere on each monitored floor at all times — including patient rooms, corridors, and common areas away from covered exits — or only when a patient's bracelet is in proximity to a covered door or exit? Please clarify whether continuous whole-floor coverage (not door/exit-proximity-only detection) is required to satisfy this specification.
Answer 2: Given the range limitation of BLE and the low elopement risk for our patients, whole floor coverage is not required. Periodic nursing checks on the bracelets will be sufficient.
Tamper monitoring and battery monitoring for the bracelets has been removed.
Question 3. If a patient removes their bracelet away from a covered exit — for example, in their room or a corridor — must the system generate an immediate staff alert at that moment? Or is it acceptable for the alert to be generated only when the patient subsequently approaches a covered door?
Answer 3: Notification in range of the covered doors is sufficient.
Question 4. If a patient's bracelet battery reaches a low-battery threshold away from a covered exit — for example, in their room or a corridor — must the system generate an immediate low-battery notification to staff? Or is it acceptable for the notification to be generated only when the bracelet next comes within range of a covered door reader?
Answer 4: Notification in range of the covered doors is sufficient.
Question 5. The Salient Characteristics specify a "WanderGuard Blue Door Bundle/Starter Kit" with coverage at designated doors. WanderGuard Blue is a Bluetooth Low Energy (BLE) technology operating in the 2.4 GHz spectrum. BLE systems are physically limited to exit-proximity detection and cannot maintain continuous communication with a bracelet across 15,000 square feet of hospital floor construction (reinforced concrete, metal structures, lead-lined rooms). Can the Contracting Office confirm that a BLE exit-only topology meets the stated requirement for tamper and battery monitoring across the full 15,000 sq ft coverage area per floor? If not, will the Contracting Office consider performance-based specifications that allow offerors to propose a technically superior solution?
Answer 5: BLE topology is sufficient. Coverage in vicinity of the exit doors meets our requirements.
III. Nurse Station Display and Alert Requirements
Question 6: The SOW specifies 16 Nurse Station Annunciators providing "audible indication of door alert at 4 locations on 4 floors." Does the Government require visual display at nurse station workstations showing real-time patient location, bracelet identity, tamper status, and battery status — or audible-only notification? PatienTRAK provides floor-map workstation displays at nurse stations in addition to audible alarms; please confirm whether this capability is desired or required.
Answer 6: Audible annunciation at 4 locations on each floor. Control panel and visual display only necessary at primary nurse’s station on each floor.
Question 7: Should nurse station alerts include the patient's name/identifier, location on the floor, tamper status, and battery status at the time of the alert — or only an audible door alarm signal?
Answer 7: Audible alarm annunciation is sufficient. Rest of the data displaying on main control panels is desired.
Question 8: The SOW states "audible alarm only, door locking not required." However, the Salient Characteristics note the system is "capable of upgrade to provide Auto-Door Locking Mags." Can the Contracting Office confirm that future upgrade capability to door locking and access control is desirable, even if not required at initial installation? MGM PatienTRAK integrates with maglocks, access control, CCTV, elevator systems, and nurse call — all on the same infrastructure.
Answer 8: Software that is compatible with the door locking infrastructure is sufficient to meet this requirement.
IV. Installation and As-Built Plans
Question 9: Will the Government provide AutoCAD as-built floor plans for the 4 monitored floors to allow offerors to accurately plan cable routing, reader/exciter placement, and workstation locations? For a system covering 15,000 sq ft per floor with whole-floor coverage, accurate as-built plans are essential for a complete and accurate quote. If as-builts are not in Autocad format, can you provide in PDF format?
Answer 9: PDF plans are immediately available. As-built PDFs and AutoCAD drawing may be available later in the process but not guaranteed.
Question 10: The facility is described as a renovated building being activated in June 2026. Will the elopement system installation be coordinated with the construction contractor currently on-site? Who is the primary coordination contact — the VA COR, VHiT, or the construction contractor?
Answer 10: Installation will be coordinated with the VA COR. Construction completion is anticipated by early June.
Question 11: The SOW requires integration with the Jeron Provider 790 nurse call system. Can the Contracting Office confirm the specific Jeron interface protocol required (dry contact relay, IP/TCP, serial)? MGM PatienTRAK has integrated with multiple nurse call platforms; confirmation of the interface type will ensure a complete and accurate quote.
Answer 11: Dry contact will likely be sufficient for providing an elopement notification into the Jeron nurse call system, elopement management system will not be on the VA network for TCP/IP protocol.
V. OEM Authorization Requirement
Question 12: The SOW requires "written certification from the Original Equipment Manufacturer (OEM) that authorizes the Contractor to provide and install the products and software." MGM Solutions is the OEM and developer of PatienTRAK — we manufacture, install, and support our own system. Does this OEM authorization requirement apply to offerors who are themselves the OEM/manufacturer, or only to resellers/integrators of third-party products?
Answer 12: Self-certification of installers capability will meet this requirement.
Question 13: On page 9, Section D of the attached PDF, it states that we must “complete and return provision 52.212-3.” However, when reviewing the document, I do not see a specific section or form to complete.
Could you please confirm whether provision 52.212-3 is a separate document that needs to be provided and returned, or if this requirement is satisfied by the Contractors Administration Data.
Answer 13: The requirement to complete form 52.212-3 has been removed.
Question 14: Could you please confirm if the government will accept alternate "equal or better" technical proposals for this requirement?
Answer 14: The solicitation states “Brand Name or Equal.” If you are an interested party, please submit a quote on your company letter head.
Question 15: Will the government change this to SDVOSB set aside using NAICS 541519 given two or more SDVOSBs provide this solution?
Answer 15: This procurement is and will remain a small business (SB) set-aside. Refer to question 1.
