About this file
This is a Justification for Single Source Award document from the Department of Veterans Affairs for an urgent fire pump replacement at Bay Pines VA Health Care System in Florida. The document justifies a sole-source award under FAR 13.106-1 for a procurement valued under the Simplified Acquisition Threshold ($250K).
The requirement involves removing an old malfunctioning fire pump, purchasing and installing a new electric fire pump and motor assembly in Building B100. The current pump manufactured by Reddy Buffaloes Pump Inc. cannot be repaired as the manufacturer is no longer in business. Although market research identified 1,948 SDVOSB/VOSB vendors under NAICS code 238220 and a sources sought notice received four responses, the urgent nature of the failing pump that could shut down hospital operations led to a sole-source award to Results Sales & Service LLC, an SDVOSB, on January 31, 2025. A similar previous contract (36C25524P0518) was awarded to Johnson Controls Fire Protection LP in July 2024 for $46,081.25.

DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106 1 For
Over Micro Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C248 25 AP 1764
1. Contracting Activity: Department of Veterans Affairs (VA), Veterans Health Administration (VHA), Regional Procurement Office East, Network Contracting Office (NCO) 08 on behalf of Bay Pines VA Health Care System located at 10,000 Bay Pines Blvd., Bay Pines, FL 33744.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: To remove the old malfunctioning fire pump, purchase a new electric fire pump and motor assembly, and to install and commission a new pump for Building B100. The estimated procurement value is
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This is an urgent and compelling requirement. A new fire pump needs to be installed as soon as possible before the current fire pump stops working. It was found during an inspection that the existing fire pump no longer meets code requirement. It is a Joint Commission and life safety requirement for this fire pump to meet all code requirements. The current pump manufactured by Reddy Buffaloes Pump Inc. cannot be repaired as the manufacturer is no longer in business.
4. Description of market research conducted and results or statement why it was not conducted:
Limited market research was conducted, as this is an emergency requirement. The North American Industry Classification System (NAICS) code is 238220 (Plumbing, Heating, and Air Conditioning Contractors); N012 (Installation of Equipment – Fire Control Equipment).
A Veteran Small Business Certification (VetCert) search utilizing NAICS code 238220 yielded 1948 Service Disabled Veteran Owned Small Business (SDVOSB)/ Veteran Owned Small Business (VOSB) vendors that can possibly fulfill this requirement. Market research efforts include queries on Federal Procurement Data System (FPDS) and System for Award Management (SAM).
FPDS was queried utilizing the keywords "fire pump”. One similar record was found, 36C25524P0518, awarded to JOHNSON CONTROLS FIRE PROTECTION LP on 07/23/2024 for “Removal/Install of Fire Pump, Jockey Pump, and Jockey Pump Controller” in the procurement value of $46,081.25. This was procured as a Only One Source – Other (FAR 6.302 1) Requirement. No information on size was found.
Since there is not much information available on industrial fire pump removal and installation, a sources sought notice was issued on January 17, 2025 through January 21, 2025 under 36C24825Q0290 on Contract Opportunities. Four responses were received, but additional market
Revision: 01 Effective Date: 11/15/2024 Page 2 of 2 Acquisition ID#: 36C248 25 AP 1764 research was needed to determine whether the vendors would be able to provide a fair and reasonable price. Consideration was made to continue market research, but the fire pump was malfunctioning.
A quote was received from Results Sales & Service LLC, a SDVOSB. Since this is an emergency requirement as the pump is currently malfunctioning and could shut down the hospital, a notice to proceed was sent to RESULTS SALES & SERVICE, L.L.C. on January 31, 2025.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
