| The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof. |

B.3 PERFORMANCE WORK STATEMENT (PWS)
1. The Orlando VA Medical Center has a requirement to ensure all facility buildings meet the operation, testing and maintenance of electrical power distribution systems and require testing on a routine basis. The Contractor shall provide all management, supervision, personnel, services, materials, supplies, facilities, transportation, and general and specialized equipment necessary to perform inspection, preventive maintenance, calibration, testing (Infrared Thermographic & Arc Flash included), and documentation of the electrical power distribution system and equipment at the Orlando VA Medical Center. The following facilities shall be covered in this Performance Work Statement (PWS):
1.1. 2. The requirements above are hereafter referenced as “Maintenance and Testing”. The Contractor shall perform to the standards in this contract. This Performance Work Statement (PWS) requires the work to be performed by qualified Electrical Contract Professionals, and they will hereafter be referred to as “Contractors.” Contractors who are contracted to perform Maintenance and Testing of the electrical power distribution system and equipment shall meet all the qualifications and objectives stated in Sections D. and E. respectively. This PWS requires that all Maintenance and Testing is documented, compiled into a summary/executive report (to include recommendations), and delivered to the Contracting Officer Representative (COR) upon completion of the project. The contractor will not require access to VA sensitive information, therefore the “Certification and Accreditation” (C&A) requirement in accordance with (IAW) VA Handbook 6500.6 Contract Security does not apply.
3. Background: The Veterans Health Administration (VHA) Directive 1028 dated July 25, 2014, provides policy regarding the installation, operation, testing, and maintenance of Electrical Power Distribution Systems at VA medical facilities. AUTHORITY: 29 U.S.C. 655.
3.1. VHA and The Joint Commission have adopted the National Fire Protection Association (NFPA) codes and standards including the National Electrical Code (NFPA 70), Recommended Practice for Electrical Equipment Maintenance (NFPA 70B), Standard for Electrical Safety in the Workplace (NFPA 70E), Health Care Facilities Code (NFPA 99), Life Safety Code (NFPA 101), and Standard for Emergency and Standby Power Systems (NFPA 110) as the basis for the requirements of the design, installation, operation, testing, and maintenance of the Electrical Power Distribution System at VHA facilities.
3.2. The Joint Commission’s Environment of Care (EC) standards require written Utility Management Plans. The Utility Management Plan must ensure reliability, control risks, reduce failures, and train users and operators of the Electrical Power Distribution System.
3.3. Occupational Safety and Health Requirements (OSHA) Part 1910 Subpart J, The Control of Hazardous Energy (Lockout/Tagout) (1910.147); Occupational Safety and Health Requirements Part 1910 Subpart S, Electrical (1910.301 – 1910.399); and Safety and Health Regulations for Construction Part 1926 Subpart K, Electrical (1926.400 – 1926.449) apply.
3.4. It is VHA policy that the Electrical Power Distribution System must operate in a safe, reliable, and efficient manner, recognizing its importance and potential danger; and in compliance with The Joint Commission, OSHA, and NFPA electrical standards.
4. Definitions/Acronyms/Abbreviations:
4.1. Central Utility Plant (CEP) - Maintains the VA utility infrastructure: Steam distribution piping/Chilled water distribution piping/Utilities/Electrical Substations/Electrical distribution system/Power Generation.
4.2. Contracting Officer (CO) – VA official with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
4.3. Contracting Officer's Representative (COR) – VA official responsible for providing contract oversight and technical guidance to the Contracting Officer. Responsibilities include certification of invoices, placing orders for service, providing technical guidance, overseeing technical aspects of the contract. All administrative functions remain with the Contracting Officer.
4.4. Contractor –refers to both the prime Contractor and his/her employees, and any sub-contractor and their employees.
4.5. Fixed-price contract- is a type of contract that provides for a price that is not subject to any adjustment based on the contractor's cost experience in performing the contract.
4.6. Essential Electrical System (EES) – A system comprised of alternate sources of power and all connected distribution systems and ancillary equipment, designed to ensure continuity of electrical power to designated areas and functions of a health care facility during disruption of normal power sources, and also to minimize disruption within the internal wiring system.
4.7. Joint Commission (JC) (Formerly Joint Commission on Accreditation of Healthcare Organizations) – A national organization dedicated to improving the care, safety and treatment of patients in a health care facility and environment.
4.8. NICET – National Institute for Certification in Engineering Technology
4.9. Notification Appliance Circuit (NAC) special module is installed into a fire alarm panel that is supervised by the receiving equipment for "line fault", "common trouble", "supervisory" and "alarm". Also called the Bell Circuit/Signal Circuit/Output Circuit.
4.10. National Fire Protection Association (NFPA) - is a United States trade association, albeit with some international members, that creates and maintains private, copyrighted standards and codes for usage and adoption by local governments.
4.11. InterNational Electrical Testing Association (NETA) - NETA is an association of leading electrical testing companies committed to advancing the industry's standards for power system installation and maintenance to ensure the highest level of reliability and safety.
4.12. Out-Patient Clinic (OPC) - the part of our VA hospital system designed for the treatment of veteran’s outpatients with health problems who visit the VA for diagnosis or treatment out in their local community.
4.13. Quality Assurance Surveillance Plan (QASP) – an organized written document used for quality assurance surveillance. The document contains specific methods for performing surveillance of the Contractors continuous performance.
4.14. Quality Control and Quality Control Plan (QCP) – Those actions taken by the Contractor to control the production of goods or services so they will meet the requirements of the contract.
4.15. Performance Work Statement (PWS) - is a statement of work for performance-based acquisitions that describes the required results in clear, specific and objective terms with measurable outcomes.

5.12. VHA Directive 1028.
6. SCOPE. This PWS establishes a baseline for Electrical Power Distribution Inspection & Testing. This PWS details task requirements, milestones, testing specifications, deliverables, and performance measures.
6.1. The Contractor shall provide all management, supervision, personnel, services, materials, supplies, facilities, transportation, and general & specialized equipment necessary to inspect, test, maintain, calibrate, and document for annual inspections the following equipment to include related components:
6.1.1. Transformers
6.1.2. Switchgear
6.1.3. Switchboards and distribution panels
6.1.4. Motor control centers
6.1.5. Circuit breakers
6.1.6. Protective relays
6.1.7. Grounding systems
6.1.8. Ground fault protection systems
6.1.9. Automatic transfer switches
6.2. All work performed shall be in accordance with the latest editions of references listed in section I. Contractor is responsible for any damages caused by contractor’s employees and any sub-contractors to Government property during execution of work and will repair at no cost to the Government. This includes any patching, priming, and painting. Contractor shall be responsible for monitoring, testing and inspections only. Repairs are not included in this contract. Equipment Count by type

6.3. Work Hours. Work will be conducted after normal working hours and weekends. Normal working hours are Monday through Friday, 7:00am to 4:30pm and occasional Saturday clinics . Contractor shall perform all work during first, second, or third shifts to include weekends or Holidays, when possible, but shall perform any work that will affect patient care systems during times that will be the least disruptive when required by the COR.
6.4. Performance Requirements. Contractor shall provide the necessary personnel and equipment to meet or exceed required service. Contractor shall have the following responsibilities:
6.4.1. Provide licensed, trained, and qualified personnel to perform the project in the State of Florida.
6.4.2. Provide all supervision, labor, and materials to complete all requirements described in this PWS.
6.4.3. Contractors shall be certified by the InterNational Electrical Testing Association (NETA) or equivalent certifying organization as certified technicians, with each having completed the Occupational Safety & Health Administration (OSHA) approved 10-hour Construction Outreach Training or General Industry Outreach Training.
6.4.4. Contractors shall have technical training and evident track records of working experience in Maintenance and Testing of electrical power distribution systems and related components in healthcare, industrial, educational, or commercial facilities for a minimum of five (5) years. Electrical components on which Contractors have experience shall include, but not be limited to, switchboards & switchgear (low and medium voltage), low voltage controls, oil filled disconnects, medium voltage distribution sub-stations, dry & oil filled transformers (medium voltage), switchgear circuit breakers (medium voltage), motor control centers, infrared thermographic inspections, arch flash testing, battery & battery charger inspections, ventilation inspections, external & internal enclosure inspections, calibration & functional checks, dielectric tests of oil, and other electrical appurtenances.
6.4.5. Contractors shall possess and utilize all necessary tools, equipment, and Personal Protective Equipment (PPE) to perform all work safely, effectively, and timely. Tools, equipment, and PPE shall comply with OSHA Standard 29 CFR 1910, (Subpart I), and NFPA 70E. Prior to initiating work, the Contractor shall provide documentation demonstrating that all instruments, test equipment, tools, and PPE possess current calibration and safety inspections. Dated calibration and safety inspection labels shall be visible on all equipment as applicable.
6.4.6. Arrange and pay for all proper disposal of waste and debris.
6.4.7. Contractor shall remove all parts and debris daily from the OVAMC Campuses work site, and contractor is responsible for a complete daily clean-up and debris removals until inspections are completed.
6.4.8. Maintain project schedule agreed upon in the purchase order documents.
6.4.9. Provide all OSHA site safety for each employee during work.
6.4.10. Contractor employees shall have background checks completed.
6.5. Testing & Inspection Specifications. The contractor shall perform 100% testing, maintenance and exercising of the EES, including all related components executed to meet requirements of NFPA 99 and NFPA 110, whichever is more stringent. Work shall include the following items:
6.5.1. 100% inspection, testing and maintenance of transformers every 36 months. The following at a minimum will be inspected, tested, and maintained:
6.5.1.1. Transformers of 500 Kilovolt-Amps (kVA) or larger must be cleaned exteriorly, inspected for signs of overheating with infra-red thermal detecting equipment, and inspected for any damage to the housing, connection points, or insulation.
6.5.1.2. Liquid cooled transformers must have the cooling liquid tested and replaced, when tests indicate that the liquid no longer meets manufacturer’s specification. The liquid must be re-filled to meet the manufacturer’s specification.
6.5.1.3. Dry type transformers must be thoroughly cleaned exteriorly and inspected for overheating with infra-red thermal detecting equipment.
6.5.2. 100% inspection, testing, maintenance, and/or calibration of essential electrical equipment (including, but not limited to switchgears, switchboards, distribution panels, motor control centers, and all related components) every 36 months.
6.5.2.1. Use lint-free rags to clean conductors, contact points between the circuit breakers and main buss bars, buss bars and interior of the electrical equipment. Use a vacuum cleaner to remove large debris; compressed air is not to be used for this purpose. Visually inspect for signs of overheating, misaligned contacts, damaged insulation, or lose lugs.
6.5.2.2. Lubricate all moving parts with manufacturer’s approved lubricants.
6.5.2.3. Test and exercise circuit breakers located in switchgears, switchboard, and distribution panels to ensure operation under overload, and short circuit conditions.
6.5.2.4. Test ground fault protection devices for proper function if they are installed in the Electrical Power Distribution System.
6.5.2.5. Inspect and tighten ground connections. Test ground resistance for all facility grounding system.
6.5.2.6. Identify the hot spots in the electrical equipment by using infra-red thermal detecting equipment. Tighten problem connections to meet equipment manufacturers’ specification using a torque wrench or other approved devices.
6.5.2.7. Calibrate and maintain adjustable protective relays.
6.5.2.8. Test all control systems equipment for proper operation after maintenance is performed and before placing them back in normal service.
6.6. Contractor’s Minimum Requirement.
6.6.1. The contractor shall follow Joint Commission and NFPA format for all reports.
6.6.2. The contractor shall provide a dedicated Account Manager to supervise all delivery of services per scope.
6.6.3. Contractors shall comply with and have ready access to the latest versions of the references listed in section I.
6.6.4. The contractor shall be always escorted by a VA employee during Maintenance and Testing at all facilities.
7. DELIVERABLES. The Contractor shall perform the services necessary to complete the tasks in accordance with the procedures described in a timely and professional manner, consistent with industry standards, at the location, place, and time that the VA has set aside, and all in accordance with the PWS.
7.1. Initial Testing Schedule. The initial test schedule shall be submitted to the COR no later than twenty (20) days after award.
7.2. Testing Notification. The inspection schedule shall be submitted to the COR sixty (60) days prior to the start of the next inspection.
7.3. Testing Confirmation. The Contractor shall confirm with the COR (15) calendar days prior to the date of inspection.
7.4. Testing & Inspection. The contractor shall perform 100% testing, maintenance and exercising of the EES, including all related components executed to meet requirements of NFPA 99 and NFPA 110, whichever is more stringent. Work shall include the following items:

7.5. Field Report. The Contactor shall provide to the COR a copy of the inspection document used (field report) on the day of each performed inspection.
7.5.1. Discrepancies & Reporting. Contractor shall notify the COR of all discrepancies. It shall be the responsibility of the Orlando VAMC to take the necessary actions to initiate any Interim Life Safety Measures (ILSM).
The day of the inspection, the Contractor shall report all discrepancies to the COR no later than three (3) hours after inspection results are received.
All discrepancies shall be listed on the last page of each report. Contractor shall also tag systems which are found to be defective, in need of corrective action, or are in violation of NFPA Standards.
Contractor shall immediately notify the appropriate VA COR of all items needing immediate maintenance, repairs, replacement, or additions which, in the judgment of the contractor, may be necessary and reasonable to insure the highest degree of protection in accordance with NFPA 99 and NFPA 101.
7.6. Final Inspection. A completed final copy of all inspections per campus shall be provided to the COR within seven (7) days after the completion of inspections and shall include a complete inventory of tested devices and equipment.
7.6.1. Each complete final inspection shall be delivered to the COR and shall be delivered in two formats: 1 each Hard Copy and 1 each Electronic Copy.
7.6.1.1. The Hard Copy shall be presented in binders: labeled per campus.
7.6.1.2. The electronic copy shall be sent to the COR or designated representative email address.
8. Performance Standard. The Government representative shall be responsible for monitoring the Contractor's performance. Performance deficiencies or poor performance identified during the term of the contract shall be documented by the Government and reported to the Contractor. Upon notification of deficiencies or poor performance, the Contractor shall be given a reasonable time to take corrective action. If determined appropriate, the Contracting Officer, Government representative and/or other VA staff members shall meet with representatives of the Contractor to review performance and resolve issues. All deficiencies or poor performance shall be documented and MUST be corrected within the timeframe specified by the Government. The Contractor shall notify the Contracting Officer and the Government representative when correction(s) have been made. If the appropriate correction is not made within the timeframe specified, the Government shall have the right to terminate the contract in it is entirety. Nothing in this section is intended to modify or waive the government’s rights outlined in 52.212-4.

9. Contractor Personnel & Management.
9.1. Contractor Personnel.
9.1.1. The Contractor shall be responsible for the performance and conduct of its employees. Personnel employed by the Contractor in the performance of this PWS or any representative of the Contractor entering the VA premises shall be subject to inspections by the Government as deemed necessary. The Contractor shall not employ for performance under this contract, any person whose employment would result in a conflict of interest with the Government’s standards of conduct.
9.1.2. The Contractor is completely responsible for all actions of their employees. All contractor personnel employed in the performance of this contract shall comply with all VA building regulations, policies, and guidelines while on the premises. Contractor personnel shall be free of body odor and wear clean clothing (uniforms as appropriate) while performing duties under this contract. The Contractor shall consider the clinical environment and instruct/train their personnel in applicable safety precautions and special requirements. These requirements may include but are not limited to such conditions as human secretions, blood, barium, etc. Contractor personnel shall take appropriate precautions while performing duties applicable to this contract.
9.1.3. Personal Appearance - Contractor employees shall be well-groomed, clean, and neat in appearance; clothes properly fitted, uniform appearance with nametags, and appropriately dressed for the work to be done. Contractor employees shall not wear clothing with slogans, drawings, or language which could be construed as being lewd, obscene, profane, racially offensive, sexually suggestive, and anti-American or which advocates the use of illegal drugs or other unlawful conduct.
9.1.4. Personnel Courtesy - Contractor employees shall not exhibit rude behavior. Loudness, vulgarity, rudeness, or other similar offensive conduct by an employee of the Contractor will be ground for denying the employee further access to the VA premises.
9.2. Parking - All Contractor-owned vehicles shall be maintained in a neat, presentable, and operational condition as determined by the Contracting Officer or COR. Contractor vehicles shall be clearly marked to be distinguishable from Government Equipment. Markings shall include, but not limited to, the Contractor's name and telephone number on all equipment and vehicles used to carry out the requirements of the contract. Contractor vehicles will follow parking rules while on US government property and is subject to tow if illegally parked. It is the responsibility of the contractor to park in the appropriate designated parking areas. Information on parking is available from the Police and Security Section. Failure to park in appropriate/designated parking may be cause for parking violation from the VA Police and may jeopardize the performance of the contract.
9.3. Identification Badges.
9.3.1. The COR will coordinate the issuance of required access badges to Contractor personnel. Contracted personnel visiting any of the locations listed above must be issued a temporary badge or always have an escort with him. Badges will be issued from the location’s visitor’s desk or from the Facilities Management desk. All badges will be returned daily. Contract personnel shall wear laminated identification badges always provided by the VA when present and performing work. Badges shall be worn on the outer garment, attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.
9.3.2. Government issued identification badges remains the property of the Government and shall be returned to the issuing office upon completion of work or at the end of the workday, which ever applies.
9.3.3. Contractor Badges - In addition to the government furnished badge, Contractor personnel shall also always wear a laminated contractor identification badge when performing services under this Contract, including when on Government directed travel. The badge will contain a personal picture, name of employee, and Contractor's name. Badges shall be worn on the outer garment attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.
9.4. Safety/Security Requirements. The Contractor shall comply with all applicable federal, state and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss. Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.
9.5. All information generated in performance of this contract becomes property of the Government and must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.
9.6. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the Contracting Officer.
9.7. The Contractor personnel shall agree to comply with the Privacy Act of 1974 (the Act) and other applicable federal laws, rules, regulations, and policies issued under the Act during and after the execution of this contract. Because confidential medical record information may be accessible and/or visible to Contractor employees during performance of their daily duties, the Contractor shall obtain a signed "confidentiality certificate" from each employee prior to allowing them to start work under this contract. Any information about an individual that is maintained by the VA, including, but not limited to, education, financial transactions, medical history, and criminal or employment history or any record that contains the person's name, or the identifying number, symbol, or other identifying assigned to the individual, shall be kept CONFIDENTIAL. A copy of this certification shall be provided to the COR upon request.
9.8. Standard of Conduct.
9.8.1. Conduct of Personnel. Government rules, regulations, laws, directives, and requirements that are issued during the Contract term relating to law and order, and security shall be applicable to all employees or representatives who enter the VA premises. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site. Removal of employee does not relieve the Contractor from the responsibility for the work defined in this PWS.
9.8.2. The Contracting Officer or COR may require the Contractor to remove any employee performing requirements under this SOW for reasons of misconduct, safety, or security risk posed. Contractor employees shall be subject to immediate dismissal from the premises upon determination by the COR that such action(s) is in the best interest of the Government.
9.8.3. Contractor personnel are not authorized to carry or possess personal weapons to include, but not limited to, firearms and knives with a blade length in excess of three inches, while assigned under this contract.
9.8.4. Working Attire and Appearance. Contractor personnel shall present a professional appearance commensurate with standards delineated for Government civilian personnel acting in similar capacities.
9.8.5. The Government reserves the right to review Contractor personnel qualifications. Upon request, resumes shall be provided to the Contracting Officer prior to clearance approval, for review and acceptance by the COR. The intent is verification purpose and not for the Government to become the hiring authority.
9.8.6. Contractor employees shall not consume alcohol or illegal drugs during working hours or at any other time the employees are performing work under this PWS. The Contractor shall not allow any employee to perform work if the employee is under the influence of alcohol or illegal drugs. Employees found to be under the influence of alcohol or illegal drugs during working hours will be immediately removed from duty. For purposes of this provision, the threshold for being under the influence of alcohol or illegal drugs is the same as that established by current laws for vehicle operations. The Contractor is responsible for establishing the methods by which employees will be determined to be under the influence of alcohol or illegal drugs.

SECTION C - CONTRACT CLAUSES
ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
The following clauses are incorporated into 52.212-4 as an addendum to this contract:
C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.3 SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
(End of Clause) C.4 VAAR 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023) (DEVIATION)
(a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;
(iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and
(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certification Program at 13 CFR parts 121, 125, and 128.
(2) The term ‘‘Service-disabled Veteran’’ means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
(3) The term ‘‘small business concern’’ has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).
(4) The term ‘‘small business concern owned and controlled by Veterans with service-connected disabilities’’ has the meaning given the term ‘‘small business concern owned and controlled by service-disabled veterans’’ under section 3(q)(2) of the Small Business Act (15 U.S.C. 632(q)(2)).
(5) The term “SDVOSB participant” or certified SDVOSB means a small business that has been certified in the SBA Veteran Small Business Certification Program and listed in the SBA certification database (see 13 CFR 128.102).
(b) General. In order for a concern to submit an offer and be eligible for the award of an SDVOSB set-aside or sole source contract, the concern must qualify as a small business concern under the size standard corresponding to the NAICS code assigned to the contract and be listed as an SDVOSB participant in the SBA certification database as set forth in 13 CFR 128.
(1) Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.
(2) Any award resulting from this solicitation shall be made to a certified SDVOSB listed in the SBA certification database who is eligible at the time of submission of offer(s) and at the time of award.
(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.
(c) Representation. Pursuant to 38 U.S.C. 8127(e), only certified SDVOSBs listed in the SBA certification database are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible and certified SDVOSB as defined in this clause, 13 CFR 121, 125, and 128, and VAAR subpart 819.70.
(d) Agreement/LOS certification. When awarded a contract action, including orders under multipleaward contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6.
