36C24722Q1042 (VAMC August Medical Gas Cylinders):

1. Q. The solicitation does not identify licensing as a requirement, which is a requirement set forth by the Georgia State Board of Pharmacy (Rule 480-7-.03) for licensure among Wholesalers. Will the GOV affirm that the Prime Contractor must be licensed in the State of Georgia with proof of the licensing provided at the time bid submission?

Per the Pharmacy Facility License application (copy attached):

Also per the Georgia Pharmacy Law, Title 26, Chapter 4 (copy attached):

A. The government excepts contractors/subcontractors supplying the equipment outlined in the statement of work to be licensed in accordance with Georgia Law as it pertains to the sale and distribution of the compressed gasses.

1. Q. Will the GOV confirm that the SDVOSB offeror must have and provide proof of Liability insurance specific to NAICS 325120 at time of bid submission? It is important to note that there are very few underwriters that will insure small business for compressed gases under NAICS 325120/221210.

A. Contractors/Subcontractors will be liable for any occurrences, to include but limited to, injury, accidents, damage to government property, etc., therefore, the government encourages all involved entities to be sufficiently insured. But will not be required to show proof liability insurance when submitting an offer.
