(v) The business will comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size and government contracting programs at 13 CFR part 121 and 125, provided that any reference therein to a service-disabled veteran-owned small business concern (SDVO SBC), is to be construed to apply to a VA verified and VIP-listed SDVOSB unless otherwise stated in this clause.
(2) “Service-disabled Veteran” means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
(3) The term “small business concern” has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).

Page | 5 of 12
(2) Any award resulting from this solicitation shall be made to a VIP-listed SDVOSB who is eligible at the time of submission of offer(s) and at the time of award.
(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.
(c) Representation. Pursuant to 38 U.S.C. 8127(e), only VIP-listed SDVOSBs are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible SDVOSB as defined in this clause, 38 CFR part 74, and VAAR subpart 819.70.
(d) Agreement. When awarded a contract action, including orders under multiple- award contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting requirements in 13 CFR 121.406(b) and 125.6. Unless otherwise stated in this clause, a requirement in 13 CFR part 121 and 125 that applies to an SDVO SBC, is to be construed to also apply to a VIP-listed SDVOSB.
For the purpose of limitations on subcontracting, only VIP-listed SDVOSBs (including independent contractors) shall be considered eligible and/or “similarly situated” (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to the following:
(1) Services. In the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not VIP- listed SDVOSBs.
(2) Supplies or products.

(3) General construction. In the case of a contract for general construction, it will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime may be paid to firms that are not VIP-listed SDVOSBs.

For contracts referenced in (d)(2), (3), and
(4) the cost of materials is excluded and are not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the

E.4 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
(a) Basis of Award. This procurement is being conducted pursuant to FAR Part 13 procedures. The Government intends to award a contract resulting from this solicitation to the responsible offeror who offers the lowest price, whose price is found to be reasonable, and whose offer is found to be acceptable when considering the non-price evaluation factor(s) described below. In addition to the general standards of responsibility found at FAR § 9.104-1, in accordance with FAR § 9.104-2, the special standards of responsibility described below apply to this procurement. Offerors who fail to meet the special standards of responsibility will not be eligible to receive any contract award as a result of solicitation 36C24722Q0006.
Evaluation Factor (Non-Price): Compliance with Solicitation Requirements. To be considered “acceptable” for this factor, the offeror’s proposal must not take exception with any of the requirements for this procurement specified in the solicitation.
Special Standards of Responsibility: The following special standards of responsibility apply to this procurement:
SP1: The Prime vendor shall be licensed/certified/credentialed to perform pest control services in the State of Alabama.
SP2: The Prime vendor shall have at least eighteen (18) months of experience in performing pest control services.
(b) Evaluation Process. Proposals will be evaluated in the following manner. The lowest-priced offer will be identified. The proposal for the lowest-priced offer will be evaluated to determine if the offered price is reasonable and if the proposal does not take exception with any of the requirements for this procurement. If the price is found to be reasonable and the proposal does not take exception with any of the requirements for this procurement, the contracting officer will determine if the offeror is responsible using the general and special standards of responsibility for this procurement. If contract award cannot be made to the lowest-priced offer, the contracting officer will evaluate the next lowest-priced offer. This process will continue until a contract award can be made, or the contracting officer determines that no contract award can be made. The contracting officer may find all offers not acceptable and cancel the procurement if the lowest-priced offer exceeds the amount of funding available for the procurement. The Government intends to evaluate offers and award a contract without discussions with offerors.
However, the Government reserves the right to conduct discussions if later determined by the contracting officer to be necessary.
Page | 9 of 12
(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(d) Acceptance of Offer. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

5. I noticed that it states in bold that the prime contractor must be fully licensed to perform these services in the State of Alabama at the time of award and throughout the duration of the contract. The question I have is doesn't this limit competition only to those SDVOSB companies in Alabama? – No, this does not limit competition for this particular procurement.
6. Would the government please clarify the subject RFP with regard to the "18-month
Prime Vendor Experience" VS the "Evaluation Factor Personnel Experience" (see RFP pg 4 C 1 "Specifications & pg 40 & 41 E.4 (a) Special Standards of Responsibility
SP2")? - Please advise if the Prime Vendor and/or the Prime Vendor's personnel are required to have 18 months of pest control experience as the above stated SOW and
Evaluation Factor are conflicting. - The Prime Vendor must have eighteen (18) months of experience
7. Is this opportunity following the “Limits on Subcontracting” rules and if we subcontracted this opportunity to a local vendor who has the above credentials and is a registered licensed entity for the State of Alabama, will we be able to bid this work being an Out of State Prime Contractor? - The Prime Contractor must have a License in the

12. Would the government please confirm the most recent contract award "total" amount for pest control services for CAVHCS? Per an official government website (public knowledge) the base year was awarded at $180,000 (1 year). Please confirm. – This information should be posted on the site that the previous solicitation was posted.
13. Could you please clarify in great detail if the current SOW has changed or is static? -
The current SOW in the solicitation is to be used and will not be compared to past or current solicitations/contracts.
14. Offerors are unable to bid intelligently based on the fact that the required pest control routine service frequency is not incorporated in the Scope of Work (SOW). Offerors cannot bid accordingly without "Workload Data". Please consult the service (EMS) again and make an amendment to the solicitation as to post/publicize said service frequency. -
The frequency will be Monday-Friday, times will be determined between contractor and contracting officer representative. Holidays and weekends will be treated as emergency call ins.
