About this file

This document is a Single Source Justification (SSJ) for a sole source procurement by the Department of Veterans Affairs, VISN 06, Salem Medical Center. The procurement is for water system monitoring, sampling, testing, and reporting services required under Virginia Code 12VAC5-590 Waterworks Regulations. The City of Salem is the sole source vendor because it is the only entity capable of providing licensed waterworks operators to operate the Salem VAMC's water distribution system, which is classified as a Non-Transient Non-Community, Class 5, Consecutive System receiving water from the City of Salem's distribution system.

Market research conducted on VetCert and SBA DSBS identified 597 and 158 potentially capable vendors, respectively. However, further investigation through FPDS and market research for FY24 confirmed the City of Salem as the sole source due to shared water distribution and wastewater systems, with the city requiring outflow testing from the facility to ensure no contamination enters its system. The procurement is valued under the Simplified Acquisition Threshold (SAT) of $250,000, with an effective date of 11/15/2024, and will cover water treatment services for the period of August 1, 2025, through July 31, 2026.

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C246-25-AP-2704

1. Contracting Activity: Department of Veterans Affairs, VISN 06, Salem Medical Center. 2237 No. 658-25-4-5071-0316.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Salem VAMC water system is a Consecutive System which receives water from the City of Salem’s water distribution system. The City of Salem is the only source capable of providing licensed waterworks operators with the ability to operate the VAMCs capable of Virginia code 12VAC5-590 Waterworks Regulations require.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This procurement to provide monitoring, sampling, testing, and reporting services required under Virgina Code 12 VAC5-590 Waterworks Regulations to operate the Salem VAMCs water distribution system. The Virginia Department of Health (VDH) has classified the water system as Non-Transient Non-Community, Class 5, Consecurive System which receives water from the City of Salem’s water distribution system. As such, the City of Salem is the only responsible source capable of providing services to satisfy agency requirements.

4. Description of market research conducted and results or statement why it was not conducted: Research undertaken to check potentially capable vendors under NAICS 541380 on VetCert and SBA DSBS. MR also undertaken searching FPDS and reviewing market research for same service for FY24. VetCert showed 597 and SBA DSBS showed 158 potentially capable SDVOSB and VOSB vendors. Although potentially capable vendors exist, FPDS and MR undertaken for FY24 water treatment for the Salem VA, showed a sole source to the City of Salem due to shared water distribution and wastewater systems between the City of Salem and the Salem VAMC. The City of Salem requires out flow testing from the facility to ensure no contamination from the Salem VAMC enteres the city’s system.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
