To All Offerors, The following questions and answers listed below are being provided via this Amendment for the information to all Offerors. The questions and answers below were inadvertently left out from Amendment 0001.
1. Question - How can the SDVOSB meet the limitations on subcontracting outside of doubling the rates if an SDVOSB does not own a hotel in the Durham area?
Answer: VAAR Clause 852.219-75 applies to all SDVOSB set asides. It is up to prospective offerors to determine how they will meet the Limitations on Subcontracting requirements.
2. Question - Will the government remove the limitations on subcontracting clause so the SDVOSB is not required to make 50% of the contract or charge the VA an exorbitant markup?
Answer: No. Please see answer to question 1 above.
3. Question - How will the government verify that the prime contractor has doubled their rates to meet the limitations on subcontracting?
Answer: Please see answer to question 1 above.
4. Question - Does the VA expect the SDVOSB to "double their rate," such as $115.00 for per diem x 2 = $230.00 (or 50% ), to meet the limitations on subcontracting?
Answer: No. Please see answer to question 1 above.
5. Question - Should any documentation be included within the submission to verify that the limitations to subcontracting are met (VAAR 852.219-75)?
Answer: Offeror’s shall submit the self-certification that they will comply with the VA Notice of Limitations on Subcontracting Compliance Certification as stated and requested under VAAR Clause 852.219-75, Clause Number C11 on Page 25 thru 27 of the Solicitation. Therefore, a copy of this self-certification must be submitted as part of the Offeror’s quote.
Question 6 - Does the contracting office prefer to accept a lower offer based on price or have the SDVOSB adhere to VAAR 852.219 and submit a higher rate?
Answer: Please see answer to question 1 above.
7. Question - Will VA accept offers over the Government Per Diem rates since food and transportation are included and there is VAAR 852.219-75 mandated by US law? Re: Facility or availability of a facility to an SDVOSB.
Answer: The Government expects Offerors to provide all-inclusive room rates as requested in the Solicitation. It is up to prospective offerors to determine how they will meet that requirement.
8. Question - Will the VA honor exclusive "letters of commitment" from hotels to an SDVOSB to determine that the SDVOSB-offeror can provide room "availability" for the facility in which they are quoting, as the facility is the primary method of evaluation?
Answer: The Government does not required Offerors to submit “letter of commitments” with their quotes but will accept and consider as additional technical capability supporting documentation if provided.
Question - 9. Will VA honor an "exclusivity letter" as a sole source for facility location that is provided by an SDVOSB, and eliminate other SDVOSB vendors from submitting that same hotel without an exclusivity letter, as they are not technically or legally authorized to represent that hotel? Re: NIST compliance
Answer: The VA will not honor any “exclusivity letters” since the services being solicited for are being solicited on a ”competitive” basis and not on a “sole source” acquisition strategy basis.
10. Given that this opportunity is set aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) and our company is fully compliant with VAAR 852.239-70, including having proof of compliance, how will the VA verify that other SDVOSBs are also compliant?
Answer: VAAR 852.239-70 is not applicable to the services being solicited.
Prospective Offerors will be subject to compliance if awarded the contract, with FAR Clause 52.224-1 & 52.224-2 security requirements which are listed by Reference Under Clause 52.252-2 on Page 18 of the Solicitation.
11. Will the VA require an SDVOSB to demonstrate compliance with VAAR 852.239-70 before making an award decision?
Answer: Please see answer to question 10 above.
12. Will not having NIST compliance disqualify an offeror based on VAAR 852.239-70? Re: Other
Answer: Please see answer to question 11 above.
13. What is required for the Personnel Qualification/Staffing Plan?
Answer: The Personnel Qualification / Staffing Plan requirement as listed under the “Complete Offer shall Include” section on Page 63 of the Solicitation was inadvertently listed however, its not applicable for the services being requested.
14. Does it matter what volume the other documents go in other than pricing being separate and on its own using B2 on page 5?
Answer: Pricing shall be provided as its own file labeled as “Volume No. 3 Schedule of Services” as stated under the Instruction to Offerors under Section E of the Solicitation using the price table listed under Section B2 “Schedule of Services” as shown on Page 5 & 6 of the Solicitation.
15. What exactly does the Government mean by Section 1 and 2? Is that Section 1 and 2 of a volume? If so, which volume?
Answer: The phrase “Section I” is being use as a reference for Offerors to use for identification of file submission purposes only. Individual files such as (Admin, Tech Capability / Facility Info) shall be labeled as “Volume 1” & Past Performance Info as “Volume 2” under Section I. File containing Pricing shall be labeled as “Volume 3 – pricing” under Section II.
