The offeror shall provide a completed copy of this SF1449 and a quote in the format and terms and conditions typically provided to its customers. Copies of example contract, paid invoices or other supporting information may be requested by the Government to make a price reasonableness determination.
In the event that a fair and reasonable price cannot be negotiated for the requirement items shown in the price/cost schedule and performance work statement, the Government may cancel the solicitation and seek another source.
Submit the quote, SF1449 and supporting information to the Contract Specialist, Serina Black at serina.black1@va.gov by the due date shown in block 8.

B.2 PERFORMANCE WORK STATEMENT (PWS)
BACKGROUND
The Department of Veterans Affairs Administration, Salisbury VA Healthcare System, W. G. Hefner Medical Center located at 1601 Brenner Ave. Salisbury, NC 28144 has need of a contractor who can provide materials, labor, and equipment, necessary to replace the Refractory Door Lintel and Fire Brick on Steam Boiler One in accordance with all terms and conditions, provisions and requirements listed herein and in accordance with the Performance Work Statement.
OBJECTIVE
In accordance with the terms and conditions stated herein, the contractor shall provide qualified professionals and all parts, labor, personnel, equipment, tool, supervision and other items and services necessary to perform the safe and efficient removal and replacement of the Refractory Door Lintel and Fire Brick on an industrial steam boiler. When Work is completed with this project, it is expected that the Government will be able to take full benefit of the finished product without additional work required.
SCOPE
Under this service agreement the Contractor shall provide service repair and emergency repair maintenance on Boiler #1. The service is to be provided for the Engineering Service line at the W.G. Bill Hefner Veterans Affairs Medical Center located at 1601 Brenner Avenue, Salisbury, NC 28144-2515.
SPECIFIC INFORMATION
· ELECTRONIC SPECIFICATIONS AND DRAWINGS: There are no drawings or specifications required.
· SPECIFICATIONS FOR GUARANTEE PERIOD SERVICES: Planned maintenance to be performed during normal business hours (7:00 a.m. – 5:00 p.m. Monday thru Friday).
· CONTRACTOR TRADE: A professional mechanical contractor will bid as prime contractor.
· SECURITY: The C&A requirements do not apply. This acquisition does not require services that involve connection of one or more contractor-owned IT devices (such as a laptop computer or remote connection from a contractor system) to a VA internal trusted (i.e., non-public) network. A Security Accreditation Package is not required.
· CERTIFICATIONS: Contractor must provide a certified Engineer that must be certified through a formalized training program, with a verified Certificate to perform preventative and remedial maintenance on the Boiler. Contractor must provide an Engineer who must be OSHA-10 certified and comply with the Federal Guidelines
· TRAINING: A minimum of 10 hours of training is required
· TECHNICAL SERVICES:
Versatech 55 AR HS refractory.
· WORK OPERATIONS: Contractor shall report for work during the working hours of Monday- Friday from 7:00AM-5:00PM.
· EQUIPMENT LIST:
Pre-fabricated 16” x 29” x 5” Versatech 55 AR HS refractory door lintel:
KS-4V Castable refractory Cap Materials KS-4V Castable Refractory Seal Materials Clipper DP Super Duty Fire Brick Materials
· TB, Flu, OSHA, AND BADGING REQUIREMENTS:
TB – The Contractor shall comply with the Federal/California OSHA Blood borne Pathogens Standard. Negative Results WITHIN 90 DAYS are required for badging.
The Contractor shall:
a) Have methods by which all employees are educated as to risks associated with blood borne pathogens.
b) Have policies and procedures which reduce the risk of employee exposure to blood borne pathogens.
c) Have mechanisms for employee counseling and treatment following exposure to blood borne pathogens.
Provide appropriate personal protective equipment/clothing such as gloves, gowns, masks, protective eyewear, and mouthpieces for the employee during performance of the contract.
Flu – Flu Shot or Mask (November 30th to March 31st)
The Contractor shall comply with the W. G. Hefner Medical Center VA Directive 1192 requirements for Flu Shots. All Construction Contractors and Maintenance Contractors working on Site must either have a Flu Shot or wear a mask regardless of interaction with patient areas.
Personnel must produce a flu shot record or will have to wear a mask while on property.
OSHA – The Contractor shall comply with the Federal Guidelines. A minimum of 10 hours training is required.
BADGING REQUIREMENTS FOR SALISBURY VAMC:
All contract workers are required to obtain and wear a Personal Identification Verification (PIV) Badge. The badge must always be visible while worker is on the VA Medical Center campus.
1. This document applies to all new and renewal of badges. Badging is required prior to new Contractors beginning newly awarded Maintenance Contracts.
1. Badges are renewed just prior to their expiration. It is the duty of the Contract Supervisor to ensure badges are renewed prior to expiration. Updated OSHA, TB testing, and flu shot (if during flu season) will be required for renewals.
1. Two (2) forms of Identification are required:

0. INS Social Security card with “Valid for Work Purposes Only”.
0. Non- U.S. Passport with INS paperwork validating their right to work in the US.
0. Naturalized Card: Must be carried by the worker always while on property.
· SECURITY:
Contractors providing any on-site support/services are REQUIRED to have a RepTrax account to conduct business on VA property. The contractor is to sign into RepTrax in advance to obtain a visitor badge/access to the Salisbury VAMC. If the FSE does not have a valid account, one must obtain one prior to performing onsite support. Contractors can register using https://www.sec3ure.com/login. RepTrax Kiosks are located at each facility.
Escort will be provided as required in sensitive work areas.
The Contractor's FSE's shall wear visible identification at-all-times while on the premises of the VAMC.
The Contractor shall park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VAMC will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.
Under VHA Directive 1085, all VHA health care facilities (including CBOCs and HCCs) will be smoke-free for patients, visitors, contractors, volunteers, and vendors effective October 1, 2019.The policy applies to cigarettes, cigars, pipes, or any other combustion of tobacco, including but not limited to electronic or e-cigarettes, vape pens or e-cigars.
Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search.
Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal couple.
· PAYMENTS:
Payments will be made in arrears following the receipt of the invoice and the monthly summary report.
· SMOKE FREE VHA:
Under VHA Directive 1085, all VHA health care facilities (including CBOCs and HCCs) will be smoke-free for patients, visitors, contractors, volunteers, and vendors effective October 1, 2019. The policy applies to cigarettes, cigars, pipes, or any other combustion of tobacco, including but not limited to electronic or e-cigarettes, vape pens or e-cigars.
SPECIAL CONTRACT REQUIREMENTS
1.0 KEY PERSONNEL
Key personnel will be identified in the proposal and shall be considered key personnel essential for the successful completion of the work performed under the contract. The contractor agrees that such personnel shall not be removed, diverted, or replaced from the work without prior written approval of the Contracting Officer. The contractor shall submit written notice of proposed personnel changes to the Contracting Officer for approval at least thirty (30) business days in advance.
2.0 WORK HOURS
The services covered by this contract shall be furnished by the contractor as defined herein. The contractor shall not be required, except in case of emergency, to furnish such services on a Federal Holiday or during off duty hours as described below.
The following terms have the following meanings:
(1) Normal working hours: Monday through Friday, 7:00 a.m. – 5:00 p.m., excluding federal holidays.
(2) Federal Holidays: The 11 holidays observed by the Federal Government are:

Any other day specifically declared by the President of the United States to be a federal holiday. When one of the holidays falls on Sunday, the following Monday shall be observed as a Federal Holiday. When a holiday falls on a Saturday, the preceding Friday shall be observed as a Federal Holiday.
3.0 BILLING AND PAYMENT
The contractor shall submit payment requests in electronic form via VA’s Electronic Invoice Presentment and Payment System http://www.fsc.va.gov/fsc/einvoice.asp
1. VA’s Electronic Invoice Presentment and Payment System – The FSC uses a third-party contractor, Tungsten, to transition vendors from paper to electronic invoice submission. Please go to this website: http://www.tungsten-network.com/US/en/veterans-affairs/ to begin submitting electronic invoices, free of charge.
2. A system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) chartered by the American National Standards Institute (ANSI).

Invoices shall be submitted in arrears. The following information must be included on all submitted invoices. Invoices submitted without the following information may be rejected for payment. Invoices shall include at a minimum:

4.0 CONTRACT ADMINISTRATION
Notwithstanding the Contractor's responsibility for total management during the performance of this contract, the administration of the contract will require maximum coordination between the Government and the Contractor.
The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity, or quality of performance of this contract.
The COR shall be responsible for the overall technical administration of this contract as outlined in the COR Delegation of Authority.
In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer without authority, no adjustment shall be made in the contract price to cover an increase in costs incurred as a result thereof.

SECTION C - CONTRACT CLAUSES
ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. The following clauses are incorporated into 52.212-4 as an addendum to this contract:
C.1 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)
(a) Definitions. As used in this clause—
(1) Contract financing payment has the meaning given in FAR 32.001;
(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;
(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;
(4) Invoice payment has the meaning given in FAR 32.001; and
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.
(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).
(d) Invoice requirements. Invoices shall comply with FAR 32.905.
(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—
(1) Awards made to foreign vendors for work performed outside the United States;
(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;
(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;
(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or
(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

The Contracting Officer reserves the right to designate an Administrative Contracting Officer (ACO) for the purpose of performing certain tasks/duties in the administration of the contract. Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
E.1 INSTRUCTIONS TO QUOTERS
1. SITE VISIT
Quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost and/or the contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. The site visits will be conducted on a mutually agreeable date as requested.
1. QUOTE SUBMISSION
Quoters shall submit their quote via email to Serina Black at Serina.Black1@va.gov by 11:00 AM, EST, June 14th, 2024. Quotes shall be assembled by the following Sections; each section shall be easily identified.
Section A - Quote Form (Standard Form 1449) Signed and dated, include the North American Industry Classification System (NAICS) code and small business size standard in Block 10. Data Universal Numbering System (DUNS) Number shall be entered in the block with the Quoters name and address.
Section B – Pricing Pricing shall be submitted as requested in the Schedule of Services. Total price will be evaluated by the Government. Proposed price should reflect a clear understanding of the requirements and is consistent with the various elements of the quote.
Section C– Quoters Representations and Certifications A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically). A quoter shall complete only paragraph (b) of this provision if the quoter has completed the annual representations and certifications electronically at www.sam.gov/portal/public/SAM/.
All Quoters shall be registered and current in the System for Award Management (SAM) database at time of award.
Section D – Technical/Management Approach Quoters shall submit a quote that addresses all aspects of the Statement of Work (SOW).
Quoter must have experience, capability, and willingness to commit the resources necessary to plan, organize, and execute tasks in an expeditious and efficient manner.
The project manager and lead site survey personnel shall have at least 10 years of fire protection engineering work experience with demonstrated experience with health care occupancies. A fire protection engineer shall conduct the actual on-site surveys and supervise any other onsite survey personnel.
Proposed personnel shall demonstrate that they have previously acted as the lead role in fire protection and engineering design and life safety assessment projects involving all aspects of fire protection and life safety, including code compliant designs. Personnel shall also demonstrate a thorough working knowledge and formal training in fire protection codes and standards, especially the latest edition of NFPA 101 Life Safety Code and NFPA 99 Health Care Facilities Code.
The quoter shall identify any subcontractors proposed under this solicitation. All technical elements applicable to the utilization of subcontractors must be addressed in the technical quote and detail provided.
The technical quote should be as detailed as necessary to fully explain the proposed methods and rationale; it should reflect a clear understanding of the nature of the work being undertaken. The technical quote shall include information on how the project is to be organized, staffed, and managed.
The Technical Volume shall not exceed twenty-five (25) pages in length (minimum 12-point font and no less than ½ inch margins). Page limitation includes any drawings, charts, images, etc., and excludes section dividers, table of contents, glossary of terms, cross-referencing indices, and resumes. If more than 25 pages (not counting excluded pages) are submitted, only the first 25 pages will be considered.
Section E – Past Performance Identify all federal, state, and local government contracts as well as any private/commercial contracts of similar scope, size, complexity that are ongoing or have been completed within the last three years. List the following information for each contract:
· Company Name and Address
· Description of Services Performed
· Name, Telephone Number and Email Address of Responsible individuals who have first-hand knowledge of performance relative to similar type of services
· Dates of Contract Performance
· Contract Type (e.g. fixed-price, cost reimbursable) and total contract value
Failure to submit a complete proposal may result in an unacceptable determination.
3.0 AWARD BASIS
The Government will select the quote that represents the best benefit to the Government at a price that can be determined reasonable. The Government will evaluate technical capabilities, past performance, and price.
Following receipt of quotes, the Government will perform an evaluation using a comparative analysis of the services quoted in accordance with FAR 13.106-2(b)(3). The Government will compare quotes to one another to select the service that best benefits the Government by fulfilling the requirement. The evaluation of Government requirements outlined in this request for quote will determine suitability. Contractors may submit more than one quote; however, contractors are strongly encouraged to submit their best technical solutions and prices in response to this request for quote. Once the Government determines there is/are a contractor(s) that can provide a service that meet(s) the requirements of this request for quote, the Government reserves the right to communicate with only those contractors quoting the best-suited service to address any remaining issues.
Factor 1: Technical/Management Approach The evaluation process will consider whether the quote demonstrates a clear understanding of the technical features involved in meeting the requirements of the solicitation.
Factor 2: Past Performance Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery of quality services. Emphasis will be on recent, relevant past performance in the previous 3 years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Performance Work Statement (PWS).
Past performance information is one indicator of a quoter’s ability to perform the contract successfully. Current and relevant information, source of information, context of data, and general trends in Contractor’s performance shall be considered as it pertains to the performance of work described in this solicitation. Quoters may provide information on problems encountered on identified contracts and the quoter’s corrective action. The Government shall consider this information as well as information obtained from any other sources when evaluating the quoter’s past performance.
Since the Government may not necessarily interview all of the sources provided by the quoters, it is incumbent upon the quoter to explain the relevance of the data provided. Quoters are reminded that the Government may elect to consider data obtained from other sources.
Quoters with no relevant past performance or whom information is not available, shall not be evaluated favorably or unfavorably on past performance, but may be considered less favorably than a quoter with favorable performance history.
Factor 3: Price Prices shall be submitted in accordance with the Price Schedule contained in the Solicitation. Total price will be evaluated by the Government. In evaluating the quoter’s proposed price for this project, the Government concern includes determining price reasonableness.
Reasonableness determinations will be made by determining if competition exists, by comparing proposed cost/price with established commercial prices, other contract vehicles, and/or by comparing proposed cost/price with the Independent Government Cost Estimate (IGCE). The IGCE is not releasable to the public.
