CONTINUATION PAGE

1. Question: There is no specific mention of a requirement of the Prime Contractor to be licensed in the State of North Carolina (with the Dept. of Agriculture & Consumer Services) to supply/distribute medical grade oxygen (a prescription drug). PG 40 of 64, under “ Factor 1: Technical Approach,” lists some certifications offerors/contractors must provide but it is not specific that the Prime must be in compliance with State of North Carolina licensing requirements (Prime Contractor must also be licensed, not just the sub). Please confirm that offerors/SDVOSB Prime Contractor must hold a Medical Gas Supplier license for the State of North Carolina to resell/distribute medical grade oxygen at the time of the Proposal submission.

Response: There is no specification as to who must have the license whether it is the prime or the sub. The vendor just need to have shown of a license in the package. The solicitation was edited to remove the requirement from the prime specifically since this is not typical in the industry.

1. Question: PG 19 of 64 – FAR 52.288-5 “Insurance Work on a Government Installation” is stated for this requirement (incorporated by reference). How is the GOV going to discern that the offeror is properly insured for NAICS 325120/221210 – the actual requirement for this work to comply with the RFQ and not just the dollar value threshold listed on PGs 19-20 of 64? “Insurance Work on a Government Installation” (FAR 52.288-5) conflicts with PGs 19-20, where paragraph (a) requires the offeror to have the types of insurance for the work being performed (not relegated to an undefined dollar threshold). The supplemental insurance amounts included on PGs 19-20 are not definitive and conflict directly with FAR 52.288-5. In sum, the requirement is to be insured for NAICS 325120/221210, so how must offerors depict/validate they have the correct type of Liability Insurance for this requirement? How is this affirmed to the GOV at the time of bid submission?

Response: This section has been removed.

1. Question: When was the most recent annual inspection completed, and will the VA provide a copy of this?

Response: The last inspection was completed on 05/19/2023 and can be provided upon request.

1. Question: EMERGENCY DELIVERIES: PG 7 of 64 states that “Emergency delivery and/or repairs provided by the contractor or subcontractor must be able to respond in 2 hours and deliver within 24 hours,” but the sentence immediately following states that “The contractor shall respond to the facility by either telephone or email within one hour to confirm receipt of the emergency notification to ascertain the nature of the emergency.” Please confirm whether the contractor must respond within (1) hour or within (2) hours.

Response: Two (2) hour response and 24-hour delivery

1. Question: Has there been any history of vaporizers icing up due to high usage volumes?

Response: There is no history of vaporizers icing up due to high usage volumes

1. Question: What are the current tank set points for the Main and Reserve (in inches) for FULL TRYCOCK and REORDER POINT?

Response: The tanks did NOT have the TRYCOCK or REORDER POINT only the refill and Low-level alarm which is indicated in the SOW

1. Question: Can offerors schedule a site visit to observe the current tank site conditions prior to providing a quote offer?

Response: What are the procedures for scheduling a site visit? yes, the offerors can schedule a site visit. Please contact faith.cuyler-williams@va.gov to schedule the site visit.

1. Question: In addition to the 8AM-4:30PM normal working hours listed for M-F on PG 14 of 64, will the VA allow 24-hour access for deliveries?

Response: The available hours are Monday-Friday 8am-4pm. (preferred), yes, we can allow 24-hour access we will need advance notice to alert VA police because the gates are locked.

1. Question: Re-fill procedures: Are Oxygen refills initiated via Telemetry (hitting the re-order point on the Tank gauge) or “as needed” refill requests initiated by VA personnel? There is contradicting language on PG 6 of 64 as one section states that VA Logistics orders the refills but another states other procedures may be arranged (e.g., it mentions installing a telemetry unit may be arranged even though telemetry is a hard requirement).

Response: Refills will be initiated via Telemetry hitting the refill point
