B.2 SCHEDULE OF SERVICE
The contractor shall provide all labor and materials including tools and apparatus, equipment, supervision, certifications, licenses, permits, regulatory notifications, transportation, technical expertise and disposal necessary to perform asbestos, abatement work at the Richmond Veterans Affairs Medical Center (RICVAMC). All work shall be performed by state-licensed abatement contractors using Environmental Protection Agency (EPA)-accredited, state-certified or state-licensed workers and supervisors.
This is requirements type contract and the MAXIMUM quantities are as follow.
75,000 sq.ft - Asbestos containing floor tile and /or mastic with critical barrier enclosure under negative air 700 Cu/Yd -Asbestos containing tile mastic by potable mechanized machine scraper.
35,000 LB - Cleaning up and disposal of asbestos materials.
81,000 sq.ft – Decontamination.
1,200 L.F – Locker and window caulking.
1,200 L.F – Mastic on ducting 75 Days – Mobilization 100 Days – Contractor’s Industrial Hygienist The contractor is not allowed to exceed the maximum quantities listed. The contractor will notify the Contracting Officer in writing prior to the estimated quantities on the price / cost schedule being exceeded. The schedule pricing will be based on an estimated quantity. The invoicing will be based on the number of samples completed. The quantities are only an estimate. The contractor will only invoice the quantity that can be proven as being completed, and the Government has determined as in accordance with SOW.

B.3 PERFORMANCE WORK STATEMENT (PWS)
1. Background/Dates of Service (Period of Performance). The Hunter Holmes McGuire VA Medical Center (Richmond VAMC) is requesting asbestos abatement services at the medical center in Richmond, VA for a base and four option years.
Base Year – 1 October 2023 through 30 September 2024 Option Year 1 - 1 October 2024 through 30 September 2025 Option Year 2 - 1 October 2025 through 30 September 2026 Option Year 3 - 1 October 2026 through 30 September 2027 Option Year 4 - 1 October 2027 through 30 September 2028
2. Scope.
a. The contractor shall provide all labor and materials including tools and apparatus, equipment, supervision, certifications, licenses, permits, regulatory notifications, transportation, and disposal necessary to perform asbestos, abatement work at the Richmond Veterans Affairs Medical Center. All work shall be performed by state-licensed abatement contractors using Environmental Protection Agency (EPA)-accredited, state-certified, or state-licensed workers and supervisors. Contractor and employee training and certifications shall be commensurate to work performed and with requirements for licensing. All asbestos disposal facilities performing under this contract shall, at all times possess the applicable Federal, State, and Local regulatory approvals, and each asbestos disposal facility shall be approved in advance in writing by the Contracting Officer’s Representative (COR).
b. The contractor shall perform the necessary planning, documentation, permitting, removal, monitoring, inspection, testing, disposal, and other support services to ensure that VA patients, employees, and visitors will not be adversely affected by asbestos abatement work. The contractor will assure the abatement work proceeds in accordance with specifications as contained within the contract and verify the abated areas or abated buildings have been successfully decontaminated.
c. The contractor shall advise the VA of all Federal, State, and Local regulatory or guidance revisions that take place during the contract. The contractor shall have responsibility to perform the work in accordance with the most current requirements along with the contract/specification requirements, to perform continuous inspection, monitoring, and testing for the safety of employees, and to perform other such services as specified. Any conflicts shall be addressed in writing to the COR.
d. There will be Industrial Hygiene Quality Assurance oversight (third-party) as the Government’s independent Industrial Hygienist. The contractor cannot perform any abatement without the presence of the third-party Government’s independent VA Industrial Hygienist.
e. The contractor’s Industrial Hygienist shall continuously inspect and monitor conditions inside and outside the regulated area to ensure compliance with these specifications. In addition, the IH shall personally manage air sample collection, analysis, and evaluation for personnel, regulated area, and adjacent area samples to satisfy EPA, Occupational Safety and Health Administration (OSHA), and the Commonwealth of Virginia Standards.
3. SPECIFICATIONS
| a. | The work shall include asbestos abatement services for health care, administrative, laboratory, research, support buildings and structures. |
| b. | The contractor shall ensure that asbestos abatement projects comply with VA specifications of the Department of Veteran Affair’s Technical Information Library (TIL) and all applicable local, state, and federal regulations. Including, but not limited to the US EPA (Environmental Protection Agency) Asbestos Hazard Emergency Response Act (AHERA) 40 CFR 763 Subpart E, Asbestos NESHAP Regulation Rule 370, OSHA CFR 1926.1101 Abatement Standard for Asbestos. US EPA 40 CFR 745 Subpart L. |
| c. | The contractor, when required to complete a task, shall move, and return all furniture, furnishings, storage racks, file cabinets, desks, chairs, wall decor, and other applicable items to the original position following abatement as identified at the discretion of the COR. |
| d. | Following completion of abatement, the contractor is responsible for cleaning equipment staging areas, removing all equipment, and asbestos wastes generated by the asbestos abatement. |
| e. | Any contractor personnel who knowingly and willfully disregards any applicable Federal, State and/or local Occupational Safety and Health Administration (OSHA) regulations, environmental protection and/or public health statute or its implementing regulations; VA OSH, environmental (GEMS) and/or information security requirement; is subject to immediate removal from the job site and medical center by the VA Police. In addition, the contractor personnel who committed the violation or created/knowingly allowed the violation to occur, shall not be allowed to return to continue performing on the project unless cleared in writing by the Contracting Officer after sufficient rehabilitation (e.g., retraining). |
| f. | Any contractor personnel who knowingly and willfully commits any criminal offense (e.g., introduction of “dangerous weapons” as defined by 18 U.S.C. § 930) or contraband to VA property, traffic, and parking infractions) is subject to citation and/or arrest by the VA Police and prosecution in Federal District Court. |
| g. | All waste manifests will be received within 30 days after completion of each job. |
4. Contractor Certifications Contractor shall certify, in writing, that:
(1) Solvents (e.g., mastic removers) or products containing solvents (e.g., encapsulants) designated by the U.S. EPA as Class I ozone depleting substances, such as but not limited to, carbon tetrachloride and methyl chloroform (1,1,1-trichloroethane); or other chlorinated hydrocarbon solvent degreasers such as, but not limited to, dichloromethane (methylene chloride), chloroform, trichloroethylene and tetrachloroethylene (perchloroethylene), are not to be used for any task order issued under this contract.
(2) Solvents or products containing solvents will not become a Federal or State-EPA regulated hazardous wastes when spent (e.g., no solvents that will generate “D-listed” or “F-listed” wastes).
(3) Encapsulates do not contain any of the 8 RCRA metals – Arsenic, barium, cadmium, chromium, lead, mercury, selenium, and silver in sufficient concentration to require disposal as RCRA hazardous waste when removed and disposed.
(4) Asbestos: Replacement materials (e.g., insulation) shall not contain asbestos in any amount as defined by the U.S. EPA and OSHA. For purposes of this contract, vermiculite insulation is presumptively ACM (Asbestos Containing Materials) and shall not be used in any replacement product.
(5) Silica: Materials shall not contain free crystalline silica.
(6) High acute toxicity. Materials shall not contain any ingredient in a concentration of 1.0 percent or greater that meets the GHS (Government Hygienists Society) toxicity Category 1, 2 or 3.
(7) Human Carcinogens: Materials shall not contain any ingredient in a concentration of 0.1 percent or greater that is a GHS Category 1A or 1B human carcinogen or is listed by the American Conference of Governmental Industrial Hygienists (ACGIH) as a Category A1-Confirmed human carcinogen or Category A2 - Suspected human carcinogen.
(8) Mutagens. Material shall not contain any ingredient greater than 0.1% that is a GHS Category 1A or 1B mutagen, or greater than 1.0% of a Category 2 mutagen.
(9) Allergens/sensitizers. Materials shall not contain any ingredient in a concentration greater than one percent (1%) that is an allergen, respiratory and/or skin sensitizer.
(10) Flammables and corrosives. Materials shall not be flammable or meet the GHS definition of a Category 1, 2 or 3 corrosives.
5. Job Site This work is being performed in a hospital environment; therefore, the Contractor's performance of this contract shall not interfere with Patient Care or Hospital Operation. If necessary for reasons of patient care/hospital operation, the COR may direct the Contractor to stop work or limit the types of work that can be performed. This may occur with little or no advance notice.
The contractor shall have access to the area where work is to be performed. The movement of contractor personnel, equipment, materials, and tools shall be confined to this area so as not to interfere with ongoing hospital operations. Delivery of materials and equipment shall be made with minimum interference to Government operations and personnel. VA personnel shall not assist with contractor shipments or deliveries that are made to the job site.
The contractor shall be responsible for providing all work site protective barriers and site control devices. This includes, but is not limited to protective fences, protective tapes, and protective signage. The contractor shall be responsible for providing all necessary traffic control (i.e., street blockages, traffic cones, and flagman) at no additional cost to the Government. Proposed traffic control methods shall be submitted to the COR for final approval. No street or access way shall be completely closed to traffic without prior approval from the COR.
The contractor shall take all precautions to ensure that no damage to private or public property will result from their operations. If such damages occur, the contractor shall make all necessary repairs and/or replacements at no cost to the Government.
6. SECURITY
The Contractor shall ensure that its employees and subcontractor’s employees receive background investigations and understand the VA security policies prior to access to the medical center and VA property. To ensure timely and efficient issuance of identification badges, employees shall report for fingerprinting immediately after Task Order award but prior to the notice to proceed. Subject to the approval of the Contracting Officer the Contractor may forgo investigations of Contractor personnel who have proof of a recent security clearance and have a current badge. During the performance of any Task Order badges shall be worn by the contractor employees and displayed at all times unless displaying the badge creates a safety hazard.
7. Specific Tasks. LIST IN BULLET FORM THE SPECIFIC ITEMS REQUIRED FROM THE CONTRACTOR, SUCH AS PARTS, LABOR, COVERAGE HOURS, RESPONSE TIME, GUARANTEED UP TIME REQUIREMENTS, ETC.

10. Compliance Program
a. Where exposure levels are below 30 micrograms per cubic meter of air, calculated as an 8-hr time weighted average, no special precautions are required.
b. Where exposure levels are between 30 micrograms and 50 micrograms per cubic meter of air, calculated as an 8-hr time-weighted average, the contractor shall be required to monitor the exposure level at regular intervals; provide safety training and education; and require use of respirators.
c. Local and State regulations shall govern the transportation and disposal of demolition debris containing asbestos.
d. All asbestos removal contractors shall obtain an Allegheny Country Asbestos Abatement Permit, where applicable. In addition, copies of all permits and all signed manifests shall be proved to the VA.
11. Final Clearance Testing
a. All final clearance testing shall be performed by an independent third-party Professional Industrial Hygienist/Certified Industrial Hygienist retained by the VA (VPIH/CIH) as defined in Master Abatement Specification 02 82 11 Traditional Asbestos Abatement specifications referenced in Section 4.7 above. In no case shall the independent clearance testing professional be retained by the asbestos abatement contractor performing under this contract.
b. The final report shall be submitted to the assigned COR.
c. Invoices will be paid upon completion of the abatement. Completion of the job occurs when the areas pass clearance testing of 0.01 F/cc, receipt by the government of the waste manifest signifying proper disposal of the materials and receipt of the final report. All waste manifests will be received within 30 days after completion of each job.
12. Qualifications
a. Licensed asbestos contractors shall comply with all requirements, procedures, standards, and regulations covering any part of an asbestos project established by the U.S. Environmental Protection Agency, the U.S. Occupational Safety and Health Administration, the Virginia Department of Labor and Industry, and the Divisions of Air Pollution and Waste Management of the Department of Environmental Quality (§ 54.1-517 of the Code of Virginia). All current requirements for qualifications must be met. Before contract award, the contractor shall submit evidence of the following credentials as required by the asbestos abatement oversight activities for which they will be responsible.
A. Licensed asbestos contractors shall comply with the requirements found in § 54.1-1100 of the Code of Virginia governing the regulation of general contractors.
B. A licensed asbestos contractor shall employ only licensed asbestos supervisors and workers to perform work on any asbestos project.
C. A licensed asbestos contractor shall ensure that a licensed asbestos supervisor is present at each job site while an asbestos project is in progress.
In addition, evidence of five projects of similar complexity and scope as the projects for a hospital/institutional occupied abatement for Asbestos done in the last five years shall be submitted to meet the criteria for a responsible contractor.
b. Individual employee training and certifications or licensing shall be commensurate with requirements for job description. There must be a responsible supervisor on site at all times employees are present or work is being done. The supervisor must have a current 30-hour OSHA certification. Each worker must have a current 10 or 30-hour OSHA Certification. An abatement Supervisor/Contractor Course must also be presented for this person in the qualifications package submitted.
c. The contractor’s Air Monitoring Lab along with accreditation credentials shall be submitted before award. Resumes of key individuals including the contract official, project manager, Contractor's Professional Certified Industrial Hygienist and supervisor shall be submitted with the quote.
d. Qualifications shall be provided within the Technical Proposal. A list of all names of employees shall be submitted. In addition, records of proper fit testing with workplace clearances shall be submitted. All current certificates of worker’s acknowledgement along with training records shall be submitted. The contractor will be required to also submit information on the Safety Program for the Contract which may be incorporated into each project plan for each Task Order with specific details as required for the project. A Waste Transportation Safety Program and Commonwealth of Virginia Certificate shall be submitted and kept with the transport at all times. Evidence of knowledge of manifest requirements shall be submitted.
13. SAFETY AND HEALTH DURING ABATEMENT ACTIVITIES
a. Review of the Infectious Control Risk Assessment (ICRA) policy requirements for abatement activities and completion of the permit for the project and/or project phase. The COR in conjunction with the infectious control staff, director or manager of the unit(s) affected, and the contractor are responsible for identifying and reviewing all potential abatement risks and requirements as outlined in the ICRA permit.
b. Review of all contract worker Tuberculosis (TB) screening requirements and options (reference VHA Directive 2011-036 Safety and Health during Abatement). The contractor shall also be notified that anyone failing to meet these requirements is not permitted to work onsite and/or may be removed at any time without notice until these requirements are met.
c. The safety and infection control staff will inspect the abatement site periodically to ensure continuous compliance and document any findings as necessary. All findings should be brought to the attention of the assigned COR/RE/PM for response. Resolution of findings should also be documented as necessary by the safety and infection control staff.
d. All permits, including PCRA (Pre-Construction Risk Assessment), ICRA, etc. shall be active, available, and prominently displayed at all entrances to the abatement site.
e. Abatement Activity Intervention
f. All abatement work shall be immediately stopped should the COR, safety staff, infection control staff, or other VA representative identify any activities that could reasonably be expected to cause death or serious physical harm to any person (patient, visitor, staff, contract worker, general public, etc.) immediately or before the imminence of such danger can be eliminated. In the event of a stoppage, the COR/RE/PM, and the Contracting Officer (CO) should be notified immediately by the CSC representative responsible for the stoppage.
g. Serious and/or unresolved safety issues, including continuous and/or repetitive deficiencies which will be considered a serious safety concern, shall be brought to the attention of the COR for resolution.
h. Infection Control. Abatement activities and contractors shall strictly adhere to infection control measures/requirements during all phases of work. These requirements are intended to control the generation/transmission of dust and other infectious disease agents between the abatement site and other active/occupied building areas. The specific requirements for abatement projects vary based on the project location, activities, etc. These requirements may be more or less stringent dependent upon these factors; however, at a minimum the following must be adhered to. Failure/inability to observe any infection control requirements will be considered a serious safety issue.
i. Prior to beginning any abatement work, the COR, the contractor SSHO, and at least one member of the infection control staff must physically inspect and approve the correct installation of all required infection control barriers.
j. Each abatement site requiring the implementation of negative pressure shall have at least one properly functioning visual indicator installed which clearly displays on the exterior of the site whether or not negative pressure is being maintained inside the abatement area.
k. Transportation of any abatement debris/supplies through VA occupied spaces shall be done in tightly covered containers/carts. Carts shall be visibly clean on the outside and shall be wiped down and/or vacuumed to reduce the transport of dust/contaminants from abatement areas to occupied areas. Transportation times and pathways shall be coordinated when the ICRA permit is reviewed and signed.
l. Contractor employees shall remove or cover dust-laden clothing before exiting the abatement site into VA occupied spaces. Failure to do so may result in permanent removal of the employee from the project.
m. Carpet/sticky mats shall be placed at all abatement site entrances and frequently changed to ensure no dust/dirt is tracked into VA occupied spaces.
n. The contractor shall maintain the space outside of the abatement area in a clean condition. Wet mopping, changing of sticky mats, etc. are all required as necessary to maintain this condition.
o. Prior to removal of any infection control barriers, the COR/RE/PM, the contractor SSHO, and at least one member of the infection control staff must physically inspect and approve all areas. The COR/RE/PM is responsible for scheduling all terminal cleanings with Environmental Management Service (EMS) as necessary prior to barrier removal.
p. Barrier Walls:
q. The abatement areas MUST be kept separated from patient care areas by barriers that keep the dust and dirt inside the worksite.
r. The walls must provide a complete seal of the abatement area from adjacent areas (walls may be rigid or 4 or 6 mil thickness plastic) ICRA team will determine type of walls to be constructed.
s. Environmental Control:
t. Negative air pressure must be maintained within the abatement area.
u. Demolition debris is removed in tightly fitted covered carts – use specified traffic patterns.
v. Sticky or walk-off mats are placed immediately outside the abatement zone and changed whenever necessary to control the spread of dust and dirt.
w. Exterior window seals are to be used to reduce the amount of outside excavation debris coming into the building.
x. If demolition chutes are used, they must be sealed when not in use; the chute and damper should be sprayed with water, as necessary to maintain dust control.
y. Control, collection, and disposal must be provided for any drain liquid or sludge found when demolishing plumbing.
z. Traffic Control:
aa. Use designated entry and exit procedures.
ab. Keep all egress pathways free of debris.
ac. No unauthorized personnel should be allowed to enter abatement areas.
ad. Use designated elevators only.
ae. Cleaning:
af. Keep the abatement area clean on a daily basis.
ag. Dust and dirt must be kept to a minimum.
ah. Workers:
ai. Clothing must be free of loose soil and debris when exiting the abatement area.
aj. Use personal protective equipment (masks, face shields, etc.) as indicated for the task at hand.
ak. Handwashing is the best method of reducing the transmission of infection: always wash your hands with soap and water after visiting the restroom, before eating, when leaving the abatement site.
14. DISPOSAL AND RETENTION
a. Materials and equipment accruing from work removed and from demolition of buildings or structures, or parts thereof, shall be disposed of as follows:
b. Reserved items which are to remain property of the Government are noted on drawings or in specifications as items to be stored. Items that remain property of the Government shall be removed or dislodged from present locations in such a manner as to prevent damage which would be detrimental to re installation and reuse. Store such items where directed by Resident Engineer.
c. Items not reserved shall become property of the Contractor and be removed by Contractor from Medical Center.
d. Items of portable equipment and furnishings located in rooms and spaces in which work is to be done under this contract shall remain the property of the Government. When rooms and spaces are vacated by the Department of Veterans Affairs during the alteration period, such items which are NOT required by drawings and specifications to be either relocated or reused will be removed by the Government in advance of work to avoid interfering with Contractor's operation.

15. REPORTING REQUIREMENTS:
Contractor shall be required to report to Engineering to check in. This check in is mandatory. The FSE shall check out with Engineering and submit the ESR(s) to Engineering. All ESR shall be submitted to Engineering for an "acceptance signature". If Biomedical is unavailable, a signed, authorized copy of the ESR will be sent to Engineering. VA Engineering Contact Person(s): Isis Otero or Joseph Nicholls by phone at 804-675-5905 or -5904 or in Location (Room Number/Building): 2K-133. The contractor shall provide the COR telephone number(s) to contact the Service Department or FSE.
16. TEST EQUIPMENT:
Prior to commencement of work on this contract, Contractor shall provide the Richmond VAMC with a copy of the current calibration certification of all test equipment to be used by the Contractor on Richmond VAMC equipment. This certification shall also be provided on a periodic basis when requested by the Richmond VAMC. Test equipment calibration shall be traceable to a national standard.
17. EQUIPMENT MODIFICATIONS/UPGRADES/UPDATES:
a. Equipment modifications are divided into two kinds; 1) Normal functional improvements that assure that the equipment is operating at the peak of performance and 2) Enhancing improvements are optional improvements that change the equipment’s original design to allow for supplementary or additional functions.
b. Normal functional improvements shall be provided at no cost to VA within six (6) months after each version is released. Installation shall be done at no additional cost to the government during normal working hours, unless requested by the COR.
c. Enhancing improvements are optional to VA. If the COR has determined that VA requires such enhancing improvements, it shall be considered outside of the scope of this contract and processed as a separate procurement.
d. All modifications, upgrades, updates, enhancements, etc., must be scheduled in advance with the COR. CO and COR must receive notice at least five (5) full business days in advance before any equipment updates, upgrades, enhancements, and modifications are begun along with justification (if Vendor-suggested modification), estimated costs (if applicable), probable effect on equipment operation, and needs for new or additional in-service training.
B.4 SPECIAL CONTRACT REQUIREMENTS
1. NO SMOKING
Per VHA Directive 1085 Dated 3/15/19 All VA Health Care Facilities shall be smoke free. This directive applies to all patients, visitors, contractors, volunteers, and vendors.
2. QUALITY ASSURANCE SURVEILLANCE PLAN
The Government intends to utilize a Quality Assurance Surveillance Plan (QASP) to monitor the quality of the contractor’s performance. The oversight provided for in the order and in the QASP will help to ensure that service levels reach and maintain the required levels throughout the contract term. Further, the QASP provides the Facility POC with a proactive way to avoid unacceptable or deficient performance, and provides a verifiable input for the required Past Performance Information Assessments. The QASP will be finalized immediately following award and a copy provided to the Contractor after award. The QASP is a living document and may be updated by the Government as necessary.
3. BACKGROUND INVESTIGATIONS
A full background check is not required for this position; however, all contract employees must bring photo identification and advance notice from the requiring service to obtain a VA Badge in order to work on a VA facility. Upon award, the CO shall provide the contractor with detailed instructions on fulfilling security requirements.
4. CONTRACTOR PERFORMANCE ASSESSMENT REORTING SYSTEM (CPARS)
(a) FAR 42.1502 direct all Federal agencies to collect past performance information on contracts. The Department of Veterans Affairs has implemented use of the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR Subpart 42.15 Contractor Performance Information.
(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
(c) Please furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm’s past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.
(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, system requirements, and training information for CPARS are available at www.cpars.gov. The CPARS User Manual, registration for online training for Contractor Representatives may be found at this site.
(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation and the report will be accessible at www.cpars.gov Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official’s narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1-17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection evaluations. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating, “No Comment” in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: “The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment.” Your response is due within 30 calendar days after receipt of the CPAR.
(f) The following guidelines apply concerning your use of the past performance evaluation:
(1) Protect the evaluation as “source selection information.” After review, transit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.
(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determination, production readiness reviews, or other similar purposes.
(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30-day review period.
(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been completed.
5 HOURS OF OPERATION
The services covered by this contract shall be furnished by the contractor as defined herein. The contractor shall not be required, except in case of emergency, to furnish such services on Federal Holidays or during off duty hours as described below.
Normal working hours are Monday through Friday, 8:00am-4:30pm, excluding federal holidays which are as follows:

6. BILLING AND PAYMENT
Contractor shall submit invoice monthly, in arrears, via payment request in electronic form via VA’s Electronic Invoice Presentment and Payment system https://authentication.tungsten-network.com/login. The following information must be included on all submitted invoices. Invoices submitted without the following information may be rejected for payment. Invoices shall include at a minimum:
• Date of invoice
• Invoice number
• Contract number
• Obligation number
• Vendor name
• CLIN and dates of service
7. CONTRACT ADMINISTRATION
Notwithstanding the Contractor's responsibility for total management during the performance of this contract, the administration of the contract will require maximum coordination between the Government and the Contractor.
The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity or quality of performance of this contract.
The COR shall be responsible for the overall technical administration of this contract.
IN THE EVENT THE CONTRACTOR EFFECTS ANY SUCH CHANGE AT THE DIRECTION OF ANY PERSON OTHER THAN THE CONTRACTING OFFICER WITHOUT AUTHORITY, NO ADJUSTMENT SHALL BE MADE IN THE CONTRACT PRICE TO COVER AN INCREASE IN COSTS INCURRED AS A RESULT THEREOF.

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 1 October 2023 through 30 September 2024.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered "issued" when—
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor’s fax number; or
(3) If sent electronically, the Government either—
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor’s email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
