RFP Page 8 – Additional Notes state that “assumptions of existing conditions should not be made”…”with no guarantees made by the VA on unforeseen existing conditions”, alluding that the contractor shall be responsible for all assumptions at their own expense, however, in accordance with FAR Clause 52.236-2 – Differing Site Conditions - if proper written notice is provided to the Contracting Officer regarding the differing site condition, the Contractor may be entitled to an equitable adjustment to their contract. The language in the RFP appears to conflict with this FAR Clause, can you please clarify how the Contractor should handle request for compensation for a differing site condition not listed within the project documents?

The language in the statement of work cannot override a mandatory contract clause. In the event of a conflict between the statement of work and a mandatory contract clause, the clause takes precedence.

51. It appears there has been a separate award for the parking lot painting and restriping at the Richmond VA Medical Center that conflicts with several parking lot areas listed in this solicitation. Is the contractor under the previous award going to be responsible for re-striping the parking lot spaces and the awarded contractor for this solicitation to repaint/restripe again after re-paving? We ask as the previously awarded contract may cause coordination overlap during this scope of work. Please advise.

The previous contractor will not have any responsibility for this project. This project will not proceed until the Notice to Proceed is issued by the Contracting Officer and there will be no overlap of work.

52. The statement of work on page 7 of the RFP states that a geotextile paving fabric shall be installed. There are numerous types of paving interlayers (paving fabric mats, fabric grids, composite grids, etc) that vary in price and ounces. Can you please provide a specification or further information on the type of Geotextile Fabric required for this project ( ie. Mirapave 600 Paving Fabric)? This will ensure all prospective bidders are competitively pricing the same type of product.

The Government cannot specify a particular brand of paving fabric. However, salient characteristics are listed in the answer to Question 25. I think you will find that the salient characteristics are equivalent to several paving fabrics on the market.

53. Spec 01 35 26 – Section 1.7 state that the QCM and the superintendent can be the same person.

However, it is not clear if the SSHO can also hold another position. Can you clarify if the VA is going to require 2 separate, full-time individuals, employed by the Prime Contractor on site at all times or will one individual be able to hold the title of QCM, SSHO, and superintendent?

See answer to Question 34.

54. It is our understanding that the Govt will determine the sequence of work for this project. Please provide a phasing plan for this work. This is needed to coordinate the number of mobilizations required.

See answer to Question 1.

55. Please provide a map showing area where the Contractor may set up temporary facilities (trailer, portable toilet, etc.)

See answer to question 5 and Figure 4.

56. What percentage of millings can be hauled off site?

See answer to Question 4d.
