STATEMENT OF WORK

Upgrade ADA for Various Buildings Project 590-19-113 Scope: Provide construction services for the removal and replacement, and all associated mechanical, electrical, and plumbing as per attached plans and specifications at Hampton, VA Veterans Affairs Medical Center:

(a) General: The following is a summary of the work:

1. BASE PROPOSAL ITEM I, GENERAL CONSTRUCTION: The contractor shall provide all tools, labor, materials (to include two (2) ADA compliant temporary ramps, two (2) new automatic door operators and associated operating accessories), equipment, supervision, and expertise required to perform general construction, alterations, removal of existing structures and construction debris as per contract drawings and specifications at buildings 137C, 114, and 83 located at the Department of Veterans Affairs Medical Center in Hampton, VA 23667.

2. PROPOSAL ITEM II DEDUCT ALTERNATE NO. I: Work associated with the awning from building 137C. This shall include all architectural, structural, and electrical work.

(b) Place of Performance: Tasks will be performed at the VA Medical Center, Hampton, VA, 23667. Work will be around an occupied healthcare facility in operation 24 hours a day.

(d) Period of Performance: Contractor shall commence work under this contract promptly after Notice to Proceed (NTP), execute the work diligently, and achieve final completion and acceptance including final cleanup of the premises within one-hundred eighty calendar days including submittals.

(e) Specific Site Requirements: Contractor and all subcontractors shall obtain a flash badge from the Police Service, provide proof of completion from an approved OSHA 10-hour training course (30-hour for superintendent), provide TB test results, and shall abstain from smoking within the perimeters of the facility. All individuals that enter any VA facility are required to wear a face mask and will be pre-screened for COVID 19; to include Veterans, employees, visitors, volunteers, and contractors. Contractors working outside within six (6) feet of another individual shall also be required to wear a face mask.

VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors

1. Contractor employees who work in or travel to VHA locations must comply with the following:

a. Documentation requirements: 1) If fully vaccinated, shall show proof of vaccination. i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.

2) If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test.

3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.

4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.

a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.

Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.

1. All proposal preparation cost will be the sole responsibility of the Offeror. The Government will not reimburse any firm for their proposal preparation cost.

2. The price, technical response and past performance of each Offeror will be evaluated independently. Offerors shall separately document each of the three factors. Each of the three offer sections shall therefore be labeled with the Offerors name, business address, and VA Solicitation Number.

3. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including these instructions, the terms and conditions, representations and certifications, and technical and past performance requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

a. Complete the SF 1442, Blocks 14, 15, 17, 19, 20A, 20B, 20C. An official having the authority to bind your company contractually must sign and date the SF 1442 Block 20A. One copy of the SF 1442 must bear an original, authorized signature. In doing so, the Offeror accedes to the contract terms and conditions as written in the RFP. All sections of the RFP, excluding Instructions to Offerors and Evaluation Procedures Sections, constitute the model contract.

b. Complete the PROPOSAL ITEM LIST. As part of their proposal, each Offeror shall be required to complete the attached Base Proposal Item Price Breakdown Form for the Base Proposal Item only. (See Attachment A – Base Proposal Item Price Breakdown)

c. Complete 52.204-8 Annual Representations and Certifications, paragraph (d) applies to this contract. 52.209-7 paragraph (b) and 52.204-24. Print out these provisions in their entirety and submit it with the proposal. Offerors shall submit only those pages that require fill-in.

d. Acknowledgement of Amendments

e. Bid Bond/Offer Guarantee (electronic pdf. file) and Surety point of contact information.

f. Provide a printout of your company’s VetBiz Registration and CVE Letter, showing your firm as a CVE-verified SDVOSB (if applicable).

g. SAFETY AND ENVIRONMENTAL RECORD: To be eligible for consideration and award, the contractor shall have no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years and have an Experience Modification Rate (EMR) of equal to or less than 1.0.

All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record with their proposal.

1) A self-certification on company letterhead that the bidder has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years. Bidders shall submit copies of their OSHA logs (OSHA Form 300A) for the past three (3) years with their bid. If the firm has been in business for less than three years, they shall submit copies of their OSHA logs for the period of time they have been in business.

2) Information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.

Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state-run worker’s compensation insurance rating bureau.

(C) GENERAL INFORMATION

1. Format for proposal Part I & II shall be as follows:

a. A page is defined as one face of an 8 ½” x 11” sheet of paper containing information.

b. Typing shall not be less than font size 11.

2. Offers shall be submitted via email to the Contracting Officer, Vangie Miller, at Vangie.Miller@va.gov prior to the due date and time identified in the solicitation. Multiple emails will likely be required to submit all attachments. Server capacity is 10MB for file attachments, per email.

3. Each response shall address each factor in the sequence listed and clearly identify which factor is being addressed.

4. There shall be no mention of costs in the Technical Proposal.

5. FEDERAL HOLIDAYS: The following Federal Legal Holidays are observed by the Contracting Office and Hampton VA Medical Center:

EVALUTATION FACTORS FOR AWARD

THIS SECTION IS FOR SOLICITATION PURPOSES ONLY. THIS SECTION WILL BE PHYSICALLY REMOVED FROM ANY RESULTANT AWARD BUT WILL BE DEEMED INCORPORATED BY REFERENCE.

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Part I –TECHNICAL CAPABILITY Part II – PAST PERFORMANCE Part III –PRICE

(b) BASIS FOR CONTRACT AWARD: This is a Best Value (Tradeoff) source selection in which all evaluation factors other than price, when combined, are significantly more important than price. The factors other than price include technical and past performance. The Government reserves the right to award a contract to other than the lowest priced offer(s) where higher priced offers received better technical and past performance ratings than the lower priced offer(s). The Source Selection Authority shall make an integrated assessment best value award decision, where the perceived benefits of the selected higher priced proposal, and the rationale for tradeoffs, shall be documented in the contract file in accordance with FAR 15.406.

(c) By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being determined unacceptable.

(d) RESPONSIVENESS OF OFFERS Offers will first be evaluated for responsiveness to the solicitation requirements without regard to evaluation of specific technical capability, past performance, or price factors. Clarifications may be conducted to identify/confirm missing documentation and a determination will be made regarding whether the offeror should/can be allowed to submit any missing/deficient documentation without adverse effect to other offerors or the timeliness of award. Responsive offers will be provided to the Technical Evaluation Board (TEB) for the next evaluation stage.

The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal.

Strength means an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance. See VAAM Appendix M815 – A The term weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001.

The term deficiency means a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

PART I – TECHNICAL CAPABILITY

The technical capability of all offers will be evaluated on strengths, weaknesses, and deficiencies. Management Approach, Corporate Experience, Key Personnel Qualifications, and Quality Control Plan sub-factors will be weighted equally, and all areas must have ACCEPTABLE rating or better. The Technical capability sub-factors ratings of Acceptable or better will be required to be considered for award. Proposals receiving an “unacceptable” rating for any technical subfactor will not be considered for award. An overall technical proposal rating will be assigned, also using the below ratings. Offers receiving a less than acceptable overall technical proposal rating will be rejected.

Evaluators shall assign a rating based on the minimum requirements stated below.

Contractor fails to make any disclosure with regards to experience in construction whether it can be deemed relevant or irrelevant and fails to provide any references for works previously performed.

2. CRITERIA: Offerors must provide a minimum of three (3) and a maximum of five (5) references of their choice of completed projects, similar in size and scope (minimum threshold: Projects where the principal objective was multi-phase construction renovations that upgrade facilities to meet ADA requirements in hospitals within the United States, with a total contract value exceeding $500,000) to the requirement being solicited. Experience of subcontractors may be used to fulfill this requirement, but future unavailability of the subcontractor to perform work may result in contract termination.

3. MINIMUM STANDARD OF ACCEPTABILITY: The minimum standard of acceptability is met when the Offeror provides a minimum of three (3) and a maximum of five (5) examples of their choice of completed projects or in progress of similar contracts in size and scope (minimum threshold: Projects where the principle objective was multi-phase construction including renovations that upgrade facilities to meet ADA requirements in hospitals within the United States, with a total contract value exceeding $500,000). In describing the multi-phase construction, provide the following information:

a. Project title, location and brief description of the project and contracting method (design build, design bid construct, CM at risk, Turnkey, etc.).

b. Project owner and name and telephone number of owner’s contact person.

c. Indicate your firm’s role as a prime contractor or subcontractor, etc.

d. Project Prime Contractor and Major Subcontractors and name and telephone number of contact person(s).

e. Project Statistics including start and completion dates (original vs. actual) for design and construction; cost (with brief explanation of what is included in the cost); square footage; and any awards (prizes) received.

f. Confirmation that the prime contractor and subcontractors are licensed for the work being performed in the state where the project is located, where specified, or otherwise in the state from which the contractor or subcontractor originates. Work requiring license in the State of Virginia includes all Contractors, HVAC, Plumbing, Electrical work, and Asbestos/lead Project Monitoring.

g. Please use the Corporate Experience Form (See Attachment B – Corp Experience Form) included with the solicitation to provide the requested information for Experience. Utilize block 10 to provide information required by solicitation in details; attach separate sheet if additional space is needed.

4. CRITERIA: Offeror must provide an organizational chart identifying key on-site personnel with a description of their work experience relating to projects similar in size and scope (multidiscipline construction projects including renovations that upgrade facilities to meet ADA requirements with a minimum threshold value of $500,000) to the requirement being solicited. The key personnel required for this contract shall include: Project Manager and Alternate Project Manager; Site Superintendent and Alternate Site Superintendent; Site Safety and Health Officer (SSHO) and Alternate Site Safety and Health Officer (SSHO); Quality Control Manager and Alternate Quality Control Manager in addition to any other personnel that are required within Statement of Work: (c) Specific Requirements.

5. MINIMUM STANDARD OF ACCEPTABILITY: The minimum standard of acceptability is met when the Offeror provides:

a. An organizational block identifying on-site key personnel associated with this requirement to include:

i. Each individual’s name, title, duty, years of experience and experience level relating to similar contracts including renovations that upgrade facilities to meet ADA requirements in size and scope (multidiscipline construction projects with a minimum threshold value of $500,000).

ii. Narratives for the key personnel identified within the organizational block, listing experience for projects of similar size and scope (multidiscipline construction projects with a minimum threshold value of $500,000), showing project history with these key personnel in relations to the project’s description. The Quality Control Manager and the Safety Manager may be the same individual if they meet both specifications requirements.

6. CRITERIA: Offeror must provide a plan to implement the requirements of Contract Clause entitled “Inspection of Construction” FAR 52.246-12 and section 01 45 00 “Quality Control”. The plan shall identify personnel, procedures, control, and instructions. A finalized, more detailed Quality Control Plan (QCP) will be required to be submitted and approved after contract award, which include the identification of all contract submittals, tests, records, and forms.

7. MINIMUM STANDARD OF ACCEPTABILITY: The minimum standards of acceptability are met when the Offeror provides:

a. A description of the quality control system, including a chart showing lines of authority and acknowledgement that the Quality Control (QC) Manager shall implement the three-phase control system for all aspects of work specified. The QC System Manager shall report to the project manager or someone higher in the Contractor’s organization. Project Manager in this context shall mean the individual with responsibility for the overall management of the project including quality and production.

· The proposal provides a Quality Control approach that effectively addresses the internal processes to identify and prevent deficiencies in the quality of construction.

· This approach shall also show the plans for implementation ensuring the compliance of regulatory and Specification statutes are strictly adhered to.

· The approach shall also clearly address the QC organizational lines of authority and the Offeror’s approach to monitor corrective actions ensuring successful and timely problem resolution.

· The detailed QC approach shall identify how quality inspections will meet the minimum requirements of the Specifications.

· The QCP shall effectively address how the Offeror will correct identified discrepancies found during QC checks and the process to provide resolution to the CO/COR for any discrepancies identified in the Specifications or design.

· The QCP shall include the Offeror’s method for identifying subcontractors to meet the specific requirements of all trade’s specifications included in the project, see each specification section for QC details and section 01 45 00.

b. A narrative demonstrating how a quality plan was successfully implemented in at least three projects of similar size and type, in a similar climate within the past five years.”

PART II – PAST PERFORMANCE

Next, the Government will evaluate the Offeror’s demonstrated past performance of recent and relevant projects, to determine the Offeror’s ability to perform the contract successfully and help determine responsibility. There are two aspects to the past performance evaluation: 1. Relevancy of contractual work performed; and 2. How well the contractual work was performed.

An overall Past Performance Confidence Assessment Rating will be assigned, but each past performance reference will first be evaluated for “recency” and “relevancy”. Therefore, the following ratings tables will be used. “Recent” past performance is defined as projects completed within the last five years, with the actual completion date being not earlier than November 23, 2016. Past Performance examples will be assigned a relevancy rating based on the below rating definitions, in comparison with the scope of work detailed in the Specifications and Drawings.

A. CRITERIA and SUBMISSION REQUIREMENTS: The information submitted in response to Technical Subfactor 2 (“Corporate Experience”) will be used, to assign a Performance Confidence Assessment Rating. Project owners may be contacted to verify information provided, where necessary, and to obtain documentation regarding successful or unsuccessful performance, and to obtain information regarding the following performance areas. Where past performance assessments are available in the Government’s Contractor Performance Assessment Reporting System (CPARS), that information will take precedent as documentation of successful or unsuccessful performance. The offeror’s past performance records, generally, will also be reviewed in the Federal Awardee Performance and Integrity Information System (FAPIIS) and Contractor Performance Assessment Reporting System (CPARS) for the purpose of identifying any existing derogatory records impacting the evaluation team’s confidence in the offeror to perform the work.

B. The following is a list of evaluation areas/concerns that may be addressed when communicating with past performance points of contact, where CPARS assessments are unavailable.

I. Quality 1.Contractor provided effective quality control and inspection procedures that resulted in a quality-finished project.

2.Contractor developed and submitted realistic progress schedules.

3.Contractor provided well researched and clearly identified submittals that matched contract requirements.

4.Contractor completed all work with good workmanship and in conformance with the specifications, resulting in minor, if any, punch list items.

5.Contractor thoroughly reviewed design package proposals for accuracy, completeness, and compliance with contract requirements.

6.Contractor designs were all concise, accurate and captured all details of the site visit.

II. Timely Performance 1.Contractor met established project schedules to complete the project on time.

2.Contractor performed all work without the issuance of a cure notice or show cause letter. (If a notice was issued, please describe the circumstances on a separate sheet of paper and identify if liquidated damages were assessed.)

3.Contractor provided timely cost/design proposals.

4.Contractor submitted the progress schedule and interim progress reports as required in a timely manner and the schedule was approved prior to actual construction.

5.Contractor provided submittals on time as required.

6.Contractor provided payrolls for both their firm and their subcontractor’s employees as required and scheduled.

7.Contractor provided timely resolution of all punch list items.

III. Management Effectiveness 1.Contractor provided experienced qualified managers and supervisors with the technical and administrative abilities needed to meet contract requirements.

2.Contractor hired quality subcontractors and effectively managed and coordinated their work.

3.Contractor hired, maintained, and replaces as necessary, qualified personnel and subcontractors/suppliers.

4.Contractor ensured the site manager had sufficient authority to make decisions and take actions during project performance to keep the project on schedule.
