About this file

This is a pre-solicitation/sources sought notice for veteran transportation services at the Coatesville Veterans Affairs Medical Center (VAMC). The Department of Veterans Affairs Veterans Health Administration, Veterans Integrated Service Network 4, is seeking a contractor to provide ride share transportation services for veterans to and from the Coatesville VAMC facility. The solicitation seeks information regarding potential vendors' capability and willingness to provide reliable, safe, and accessible transportation services specifically designed to support veteran mobility needs and medical appointments. This pre-solicitation phase allows the government to gather market intelligence and identify qualified service providers before issuing a formal Request for Proposal.

The pre-solicitation notice serves to inform interested vendors of the government's intention to solicit this service requirement. Interested parties should monitor for the formal solicitation to follow, which will contain specific technical requirements, performance standards, pricing terms, contract award timeline, and submission deadlines. Vendors should use this opportunity to assess their capability to meet the specialized transportation demands of a veteran population and prepare documentation demonstrating relevant experience, operational capacity, insurance requirements, and safety protocols for the formal competitive procurement process.

Questions and Answers

1. Transportation Providers: Is the contractor permitted to use its own company-operated vehicles and drivers to provide transportation for the majority of trips, rather than relying exclusively on rideshare providers such as Uber and Lyft?

Yes, the contractor is permitted to use its own driver and vehicle to provide transportation for the majority of trips, rather than relying exclusively on rideshare providers such as Uber and Lyft.

2. Rideshare Use: If Uber/Lyft or other transportation providers may be used when appropriate, are there any specific requirements or restrictions regarding when the contractor may utilize these services?

No. There are no specific requirements or restrictions when the contractor utilizes Uber, Lyft, or other transportation providers.

3. Service Availability: If a requested ride cannot be fulfilled through Uber, Lyft, or another rideshare provider in a particular service area, may the contractor fulfill the trip using its own company vehicle and driver?

Yes, the contractor may fulfill the trip request as required by the PWS.

4. Wheelchair-Accessible Vehicles: Are wheelchair-accessible vehicles (WAVs) required under this solicitation? If so, must WAV transportation be available throughout all listed service areas?

Wheelchair-accessible vehicles are not required.

5. Insurance Requirements: If we use our own company-operated vehicles and drivers, what specific types of insurance and minimum coverage limits are required for the contractor, vehicles, and drivers? In particular, please clarify the required commercial auto liability limits and whether any additional coverage is required.

See VAAR 852.228-71 below in full text.

Indemnification and Insurance (MAR 2018)

(a) Indemnification. The Contractor expressly agrees to indemnify and save the Government, its officers, agents, servants, and employees harmless from and against any and all claims, loss, damage, injury, and liability, however caused, resulting from, arising out of, or in any way connected with the performance of work under this contract. Further, it is agreed that any negligence or alleged negligence of the Government, its officers, agents, servants, and employees, shall not be a bar to a claim for indemnification unless the act or omission of the Government, its officers, agents, servants, and employees is the sole, competent, and producing cause of such claims, loss, damage, injury, and liability. At the option of the Contractor, and subject to the approval by the Contracting Officer, insurance coverage may be employed as guaranty of indemnification.

(b) Insurance. Satisfactory insurance coverage is a condition precedent to award of this contract. In general, a successful bidder must present satisfactory evidence of full compliance with State and local requirements, or those below stipulated, whichever are the greater. More specifically, workers' compensation and employer's liability coverage will conform to applicable State law requirements for the service defined, whereas general liability and automobile liability of comprehensive type shall, in the absence of higher statutory minimums, be required in the amounts per vehicle used of not less than $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. State-approved sources of insurance coverage ordinarily will be deemed acceptable to the Department of Veterans Affairs, subject to timely certifications by such sources of the types and limits of the coverages afforded by the sources to the bidder. [Contracting Officer's Note: In those instances where airplane service is to be used, substitute the word “aircraft” for “automobile” and “vehicle” and modify coverage to require aircraft public and passenger liability insurance of at least $200,000 per passenger and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.] (End of clause)

6. Contractor Compensation: Which CLIN provides for the contractor’s fee/profit for scheduling and transportation coordination, particularly in situations where rideshare expenses are reimbursed at actual cost?

Please see the modified CLINs attached.

CLINs 0001 and 0002 will reflect the order service fee for one way trips and shall include any fee for profit for scheduling and transportation coordination. Firm Price CLINs.

CLIN0003 will be used as a “reimbursement” CLIN. This CLIN will be used for reimbursement of the trip. This amount is shown on the Price Schedule as an estimate ceiling for each funding year.

Each invoice trip shall include either CLIN0001 or CLIN0002 for the scheduling / transportation and CLIN0003 for trip cost.

7. Block 10 of the SF 1449 appears to identify the acquisition as unrestricted, while Section E states that it is set aside for small businesses and incorporates FAR 52.219-6. Please confirm the applicable set-aside status.

This submission is a set-aside for small business.

8. Section B.2 describes CLIN 0003 as additional mileage after the first 10 miles, with an estimated quantity of 500 and a unit of “PG.” However, Section 4.2 of the Performance Work Statement describes CLIN 0003 as a declining-balance amount for reimbursement of actual rideshare costs. Please confirm the correct purpose, unit of measurement, and pricing method for CLIN 0003.

Please reference the new price schedule and question number 6.

9. The PWS states that actual rideshare costs will be reimbursed without profit or general and administrative fees. Please clarify which CLIN should include compensation for scheduling, comparative pricing analysis, 24/7 coordination, customer support, reporting, and invoice administration.

Please reference the new price schedule and question number 6.

10. Does the estimated quantity of 13,350 under CLIN 0001 represent individual one-way passenger trips over the entire five-year ordering period?

Yes, this will be an estimated quantity of one-way trips for a 5-year IDIQ and there may be adjustments over the 5-year period pending funding, usage, and requirements. Please reference the new price schedule and question number 6.

11. May the contractor use its own vehicles or vehicles operated by a properly licensed and insured transportation subcontractor when doing so represents the lowest-priced compliant transportation option, or must transportation primarily be arranged through third-party rideshare companies?

Yes, the contractor may use any type of transportation to provide services that meets all requirements of the PWS.

12. For trips into Montgomery County, Delaware, and New Jersey, must the prime contractor independently possess transportation operating authority in every applicable jurisdiction, or is it sufficient for the transportation provider performing each ride to possess the required authority?

It is sufficient for the transportation provider performing each ride to possess the required authority.

13. Does one wait-time unit under CLIN 0002 represent each wait-time occurrence, each additional 15-minute interval, or another unit of measurement?

Please reference the new price schedule and question number 6.

14. May an active SAM-registered small-business prime contractor use an experienced, properly licensed Pennsylvania transportation company as a major subcontractor? If so, may the subcontractor’s relevant past performance be considered when submitted with the required consent letter?

Yes, subcontractors can be used. Sub-contractor past performance can be submitted with the proposal and will be reviewed if relevant. Please see FAR 52.212-1 Instructions to Offerors within solicitation for more information. The prime contractor must reference the subcontractor when responding to the solicitation.
