About this file

This is Amendment P0002 to solicitation 36C24426B0009 for a Four East Shower Refurbish project at the Wilmington Veterans Affairs Medical Center in Delaware. The amendment was issued April 15, 2026, and extends the proposal deadline to May 27, 2026, at 1:00 PM EST.

The amendment provides responses to ten submitted Requests for Information (RFI), establishes Infection Control Risk Assessment (ICRA) requirements, provides facility drawings, supplies a site visit sign-in sheet, and incorporates FAR clause 52.222-90 addressing DEI discrimination by federal contractors. Key RFI answers clarify that shower bases are approximately 42" x 42", no known hazardous materials are present per industrial hygienist assessment, contractors must remove and finish drain covers properly, contractors must remove and reinstall fixtures as needed for workspace access, structural repairs will be handled via contract modification, hard-barrier enclosure specifications should reference the ICRA form, negative air exhaust placement should reference the ICRA form, no on-site storage is provided for equipment and materials, no off-hours work is anticipated as the unit operates continuously, and technical drawings are available. The amendment specifies that all other terms and conditions of the original solicitation remain unchanged. The Department of Veterans Affairs Network Contracting Office 4 administers this requirement.

36C24426B0009 Four East Shower Refurbish Amendment P0002

Submitted Questions & Corresponding Answers

Answers shown in red text

1. Square Footage: What are the approximate dimensions or square footage of each of the

13 shower bases? Roughly 42” x42”

2. Hazardous Materials: Do the existing shower bases or previous coatings contain any known hazardous materials (e.g., asbestos or lead) that would require specialized abatement protocols? As per the industrial hygienist no known hazardous material is on shower bases.

3. Drain Covers and Plumbing: Is the contractor responsible for removing, replacing, or treating the shower drains/drain covers, or do we simply prep and coat up to the existing drain edges? Yes, remove and finish properly.

4. Fixtures: Will the contractor be required to remove and reinstall any bathroom fixtures (e.g., grab bars, shower doors, or curtains) to properly abrade and coat the bases, or should all adjacent fixtures simply be protected in place? Remove what is needed in workspace and reinstall once completed in that room.

5. Out-of-Scope Repairs: The Statement of Work mentions documenting "water intrusion" during the Pre-Work Inspection. If significant structural rot or severe water damage is found beneath a base, will that repair be handled via a separate contract modification, or is there a baseline allowance we should include in our bid? Contract modification.

6. Hard-Barrier Enclosures: The scope requires "dust-tight, hard-barrier enclosures". Given the typical space constraints of patient bathrooms, are reusable rigid polycarbonate barrier systems (e.g., STARC systems or similar) acceptable, or is the VA expecting traditional temporary drywall/stud framing? Refer to ICRA form.

7. Negative Air Exhaust: Where should the negative air machines be exhausted? Can they be exhausted directly to the outside via a window, tied into the building's existing exhaust, or must they be scrubbed through the HEPA filters and recirculated directly into the unit corridor? Refer to ICRA form.

8. Staging and Storage: Will there be a secure area on the 4 East unit or elsewhere on campus to store our negative air machines, ICRA carts, and coating materials overnight, or must all equipment be completely removed from the unit at the end of each shift?

No storage area provided.

9. Off-Hours Work: The solicitation notes that normal work hours are 7:00 AM to 4:30 PM, but off-hours work may be required. Based on the specific clinical/patient operations of the 4 East unit, should bidders anticipate a significant portion of this work being pushed to 2nd shifts, 3rd shifts, or weekends? No, this unit is active at all times.

10. Can drawings be provided? Yes, see separate attachment.

52.222-90 Addressing DEI Discrimination by Federal Contractors (DEVIATION APR 2026)

(a) Definitions. As used in this clause—

Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations;

or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
