| CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES |
| NOV 2023 |
E.3 52.212-1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The version of FAR 52.212-1 in the addendum is tailored for Simplified Acquisition Procedures and supersedes the current version of FAR 52.212-1 contained in the FAR.
The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
A. Quotes shall be submitted via email to the Contracting POC listed on page 1 of the Standard Form 1449 in Block 7a. Include the Request for Quote number in the subject line of the email. All quotes shall be submitted on or before the offer due date shown on page 1 of the Standard Form 1449 in Block 8.
B. Any exchanges with potential offerors must go through the Contracting POC. Prospective Vendors are warned against contacting any medical center personnel outside the Procurement Department before the award of a Contract resulting from this solicitation. If such contact occurs and is found to be prejudicial to competing Vendors, the Vendor making such contact may be excluded from award consideration.
C. Period for acceptance of Quotes. The quoter agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes.
D. Multiple Quotes. Quoters are encouraged to submit multiple quotes presenting alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.
E. Late submissions, revisions, and withdrawals of quotes.
1. Quoters are responsible for submitting quotes so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes are due.
2. Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is "late" and may not be considered unless it is received before purchase order issuance and the Contracting Officer (CO) determines that accepting the late quotation would not unduly delay the acquisition.
3. If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude a notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
F. Requests for information. The CO will not notify unsuccessful quoters that responded to this Request for Quotation (RFQ). However, quoters may request information on purchase order(s) resulting from this solicitation with the CO.
G. EVALUATION
1. Comparative evaluation: The Government will conduct a comparative evaluation of all offers received in response to this solicitation and award a contract to the offer that represents the best value for the Government. The evaluation will be based on the criteria outlined below.
2. Special Features:
a. Please provide brochures, pamphlets, hyperlinks, or any other materials to show what your item does so that it can be evaluated on its features and capabilities. Failure to provide materials will likely result in a lower evaluation.
3. Warranty:
a. Provide the warranty, express or implied, details and documentation. Express warranties will be included into the resulting contract.
4. Delivery:
a. Vendor must specify the date or delivery information for the quoted items so that the timeframe/delivery information can be evaluated and ultimately agreed upon in the resulting contract.
5. Price:
a. The Government will evaluate the price by adding the total of all line-item prices including options. The Total Evaluated Price will be that sum.
H. To be deemed responsive and be considered for award, an offeror’s quote shall include the following in addition to what the statement of need requires and the evaluation information above.
1. Attachment “Line Items” Referenced in Section D and attached to this solicitation. ***Provide ONLY the Excel spreadsheet provided in this solicitation.*** The Quoter is only to complete Columns O, AE, AN, BY, and CH in the items tab of the spreadsheet and do not adjust the formatting. If you are offering an equal or better item, fill out blocks C and E and add/subtract line items as needed to convey your complete offer to meet or exceed.
2. This is a brand name or equal solicitation which includes provision 52.211-6. The brand name and product referenced in this solicitation are meant to provide potential offerors with an easy to find product so that they can compare items easily. The brand name and product are not intended to be restrictive or to convey that the Government only wants such products or brands.
a. However, the salient features provided are minimum characteristics that shall be met by a comparable item in order to provide an equal or better product.
3. An Authorization Letter from the Original Equipment Manufacturer (OEM) of the brand offeror is providing if the offeror is not the OEM in accordance with VAAR 852.212-71 GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023).
4. Submit a filled-out copy of the Standard Form 1449 which should include at a minimum:
a. page 1 – blocks 12, 17, 30a, 30b, and 30c completed by the offeror.
b. page 2 – Complete Contractor POC Information and Acknowledge Amendments, if applicable.
c. Section B.2 Price/Cost Schedule is not required to be completed as all information will be provided with the completion of Attachment “Line Items”.
d. Fill out clause 52.212-3 in its entirety to include the applicable Buy American Certificate paragraph:
1. 52.212-3(f) Applies only if clause 52.225-1 is included in this solicitation.
2. 52.212-3(g) Applies only if clause 52.225-3 is included in this solicitation.
3. 52.212-3(g)(4) Applies only if clause 52.225-5 is included in this solicitation.
I. The Government intends to award a one-time Firm Fixed Price contract as a result of this solicitation however, it reserves the right to issue more than one contract if it’s in the public’s best interest. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.

When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products.
(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted.
