About this file

This document outlines requirements for a three-year municipal solid waste disposal services contract for the Department of Veterans Affairs Veterans Integrated Service Network 4. Services required include collection, handling, transport, storage, reduction, diversion, treatment, and disposal of solid waste from nine VA medical centers and associated clinics. Attachment 1 provides the site locations, container requirements, and pick-up frequencies. Historic waste quantities from the past year are provided in Attachment 2 to assist with pricing. The incumbent contractor currently provides these services to all locations. The fixed-price ID/IQ contract would have a base period from April 1, 2024 through March 31, 2027 and an optional six-month extension. Offers are due by February 21, 2024. The award will be made to a service-disabled veteran-owned small business.

Lev V. Stowe Contracting Officer

1. Who is their Current Provider?

ANS: Hamilton Alliance, Inc.

2. Can we know their current contracted amount?

ANS: No.

3. Is a frontload an absolute requirement?

ANS: This depends on the facility and how dumpsters are staged.

4. What type of recycling is it? OCC, Single Stream, etc.

ANS: The facilities in VISN4 have OCC, Single Stream/Co- Mingled.

5. What type of compactors are the 15-yard models?

ANS: The model of compactor doesn’t need to be specific as long as the compactor meets the physical size requirements per facility.

6. Can the government provide a site visit for each location so we can review scope of services required? The SOW states that contractor is required to identify, segregate, handling, storage and reductions which is more then what is required then just normal collection, transportation and disposal services.

ANS: A formal site visit will not be hosted for this requirement, however, all container locations listed in Attachment-1 are available for viewing by the general public without the need for Government accompanied access.

7. Is there any support personnel required at each VA location daily under this contract in reference to my Question 1 above?

ANS: Each location will have a site Point of Contact (POC) for general questions specific to that site, which will be forwarded to the VISN-COR and Contracting Officer for an official answer. Government employees (Support Personnel) will not participate in the requirements outlined in the solicitation beyond the observance of contractor performance.

8. How is currently VAMC locations are currently procuring these services? Is there only one contractor that is currently servicing all these 9 locations? Can you give us the current background on the current performance at each location?

ANS: MSW Disposal Services for all locations listed in Attachment-1 are currently being performed under a single contract to one awardee. That awardee may or may not have subcontractor agreements with servicers local to each site, as a subcontracting plan was/is not required. Performance under the current contractor for services at each site has been excellent.

9. Are the contractor provided containers and compactors have to be a certain color scheme?

ANS: No.

10. Can the contractor comingle the VAMC refuse or recycling during collection and before transporting to the landfill?

ANS: Yes. As long as the waste streams aren’t combined, multiple VAMCs refuse/recycling can be transported together to the landfill.

11. Attachment 1 provides a list of containers needed for this contract? There are several types of compactors on the market. Can the government provide type of compactors required at each VAMC location?

ANS: Column “D” in Attachment-1 provides the following: Description and Volume of Containers, Dumpsters, and Compactors.

12. Can the government provide photos of current containers and dumpsters at each location?

ANS: No.

13. Can the past performance be met by utilizing subcontractor experience?

ANS: No.

14. Since this is a municipal solid waste (MSW) services contract, how does the Section 4.3.1 Diversion Program for recycling collection and recycling of materials apply to the contractor? Does the contractor collect and process recycling materials?

ANS: The contractor is responsible for the collection of recycled materials under the scope of this contract.

15. Does this MSW contract require the collection of recycling materials.

ANS: Yes.

16. Attachment 1 shows containers and services for recycling & construction debris. Does the contractor provider recycling & construction debris services as a part of this contract?

ANS: Yes.

17. Attachment 1 shows location Erie VAMC using a bailer and 96 gal totes. What is the bailed material and is the collection of this bailed material a requirement of the contract?

ANS: The bailed material is cardboard, and its collection and recycling is required under this contract.

18. Location Wilkes-Barre VAMC shows scrap metal and pallets as solid waste instead of MSW. Does the contractor process these materials as MSW instead of recycling?

ANS: This was done in error and Attachment 1 - MSW Requirements - Pick-up Schedule and POPs - 1-8-24 has been updated to reflect Wilkes-Barre’s scrap metal and pallets as recyclables; see updated Attachment 1 - MSW Requirements - Pick-up Schedule and POPs - 2-5-2024.

19. Wilkes-Barre VAMC shows compactor and autoclave to process RMW. What is the contractor’s service responsibility with RMW?

ANS: Wilkes-Barre and some other VAMCs use autoclaves to reduce some types of RMW to MSW. This is handled by VAMC staff and other vendors on separate contracts. The contractor for this MSW contract has no responsibility for biohazardous regulated medical waste.

20. Attachment 1 – the listed containers below show as VA provided. Can the Government confirm whether these are Government owned or indeed contractor owned?

· Coatesville 30-yard Cubic Yard Compactor

· Pittsburgh Solid Waste #15 – 30 Cubic Yard Dumpster

· Pittsburgh (4) (x2) 30 Cubic Yard Dumpster

· Wilmington 34 Cubic Yard Trash Compactor

ANS: See updated Attachment 1 - MSW Requirements - Pick-up Schedule and POPs - 2-5-2024.

21. Page 54 of 79, paragraph (e) – it is required that bidders must show evidence of compliance with VAAR clause 852.219-75. Can the Government provide examples of what they consider evidence of compliance?

ANS: VAAR Clause 852.219-75 requires self-certification that the offer will comply with the requirements of 852.219-75. This is accomplished by filling out the information identified at the bottom of page 41 of 79. “Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed” (852.219-75(b), p. 41 of 79).

22. Can a SDVOSB subcontract a majority of the actual hauling to a large business concern and still be eligible for award.

ANS: No.

23. To be considered technically acceptable are bidders required to submit permits, licenses, and registrations with their proposal?

ANS: Section 4.3.7 Qualifications, in the Statement of Work (p. 11 of 79) requires that those documents be provided annually and prior to contract award.

As stated at Section E.1, 52.212-1(b)(4), “A Capability Statement demonstrating the company’s technical capability, experience, and ability to meet or exceed the requirements identified in the Statement of Work. The Capability Statement shall include a description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary” (p. 50 of 79).

As stated at Section E.10, 52.212-2, “The quotation will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation and based on the information requested in the instructions to offerors section of the solicitation” (p. 61 of 79).

24. Does the SBA Policy against Ostensible Subcontracting apply to this solicitation?

ANS: Yes.

25. The past performance requirement requires relevant past work performance. Will the Government only accept past performance that is also compliant with VAAR 852.219-75 to ensure it is relevant to this requirement?

ANS: Yes.
