B.4 STATEMENT OF WORK
COMMUNITY LIVING CENTER (CLC) RESIDENT ROOM WALL RESTORATION
MATERIAL
1. PROJECT OVERVIEW
1.1 PURPOSE:
A. The Department of Veterans Affairs (VA) is looking to procure the materials necessary to complete Resident Room and Main Corridor Wall Restoration on the 5th and 6th Floors of the
James E. Van Zandt VA Medical Center, VA, Altoona, Pa.
B. The project is specifically for furnishing wall restoration products and materials as outlined in the SOW to complete work by the VA Altoona, Pa on the Community Living Center Floors of the James. E. Van Zandt Medical Center at 2907 Pleasant Valley Boulevard, Altoona, PA
16602. All products and material specification information required for ordering is provided by the VA Altoona, Pa within this scope of work.
C. The Contractor shall be responsible for all activities in 1.2 Project Activities. This project includes the supply and delivery of all products and materials described herein not product and material installation.
1.2 PROJECT ACTIVITIES:
A. The entire activity of the project will follow the following sequence of events:
i. Request for Proposal Submission
ii. Contract Award
iii. Submission of Physical Samples of all products and materials specified and product and material Data Sheets for all products and materials specified to the VA Altoona, Pa for Final
Review and Approval Prior to Order Placement.
iv. Notice to Proceed with Order Placement
v. Product and Material Delivery Coordination with the VA, Altoona, Pa
vi. Product final delivery to VA, Altoona, Pa
vii. Final Inspection of products and materials.
viii. Acceptance
ix. Submission of Product and Materials Maintenance Data
x. Payment
xi. Manufacturer’s Standard Product and Materials Warranties
2. SCOPE OF WORK
2.1 GENERAL: The Contractor shall furnish all necessary products and materials to meet the wall restoration objectives and requirements and to provide the required outcome in terms of overall material and product quality, timeliness of delivery and final documentation.
A. Location: James E. Van Zandt VA Medical Center, Located at: 2907 Pleasant Valley
Boulevard, Altoona, PA 16602.
B. Normal product offload at the Altoona, VA are 7:00AM to 2:30PM Monday through Friday except for Federal Holidays. The Contractor shall arrange product delivery date and location with the Altoona, PA POC at least thirty days in advance of final delivery.
Delivery Location: James E. Van Zandt VA Medical Center, Located at: 2907 Pleasant Valley
Boulevard, Altoona, PA 16602, At: Warehouse loading Dock or other locations as determined by the VA Altoona, Pa.
2.2 DESCRIPTION OF WORK
A. System
The scope of this project is to provide impact resistant wall sheet panel material, corner guards, accessories, adhesive, and all required installation tools as recommended by the specified product and material manufacturer’s for VA Altoona, Pa’s use to complete the interior wall restoration work:

2.3 EXISTING SITE CONDITIONS
A. Contractor shall be responsible for verification of existing site conditions to ascertain any site conditions that may affect required impact resistant product and material types, colors, or textures.
B. SITE VISIT - A site visit will be held on Wednesday, May 17, 2023 at 10:00 AM., all quoters are encouraged to attend the site visit. Quoters shall use the main Medical Center Entrance across from the parking garage. There is a Campus Police window to the right just past the Coffee area. Quoters must check-in with a photo ID. Since the CLC floors are considered sensitive areas of higher COVID risk, face mask is required.

2.4 DELIVERABLES
A. The order shall be separated, packaged, and labeled by specific floor where the products and materials are intended for installation excluding adhesive and installation tools.
B. VA Altoona, Pa will provide details of final delivery location for products and materials.
C. Maintenance Manuals: The Contractor shall provide three (3) complete sets of Product
Maintenance Manuals to include all product data, and manufacturers recommendations for product cleaning, etc.
2.5 ACCEPTANCE
A. For the purposes of Warranty and Payment for the products and materials at the Altoona VA, government “Acceptance” will be provided by the VA upon the completion of all of the following:
i. Contractor has provided in full all Products and Materials specified.
ii. Contractor has provided in full all Product and Material Maintenance Manuals.
iii. Contractor has provided in full all Product and Material Manufacturer’s Warranties.
iv. Contractor shall deliver a compete order in a single delivery.
v. VA Altoona, PA will defer acceptance of material for 10 days from the date of product and material receipt to conduct a final inspection, verify product and material condition, and to file a notice of damages complaint.

The Contractor shall not make reference in its commercial advertising to Department of
Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.
C.4 VAAR 852.212-71 GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023)
(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.
(b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.
(c) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the
OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
C.5 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV
2018)
(a) Definitions. As used in this clause—
(1) Contract financing payment has the meaning given in FAR 32.001;
(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;
(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;
(4) Invoice payment has the meaning given in FAR 32.001; and
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.
(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National
Standards Institute (ANSI).
(d) Invoice requirements. Invoices shall comply with FAR 32.905.
(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting
Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.
Submission of payment requests by mail may be required for—
(1) Awards made to foreign vendors for work performed outside the United States;
(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;
(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;
(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or
(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.6 VAAR 852.242-71 ADMINISTRATIVE CONTRACTING OFFICER (OCT 2020)
The Contracting Officer reserves the right to designate an Administrative Contracting Officer
(ACO) for the purpose of performing certain tasks/duties in the administration of the contract.
Such designation will be in writing through an ACO Letter of Delegation and will identify the responsibilities and limitations of the ACO. A copy of the ACO Letter of Delegation will be furnished to the Contractor.

C.7 VAAR 852.246-71 REJECTED GOODS (OCT 2018)
(a) Supplies and equipment. Rejected goods will be held subject to Contractor’s order for not more than 15 days, after which the rejected merchandise will be returned to the Contractor’s address at the Contractor’s risk and expense. Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.
(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. The Department of Veterans Affairs will not be responsible for, nor pay for, products rejected. The Contractor will be liable for costs incident to examination of rejected products.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the
Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor
Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the
Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

INSTRUCTION TO OFFERORS
Quotes shall be submitted via email to the Contracting POC listed on page 1 of the Standard
Form 1449 in Block 7a. Include Request for Quote number in subject line of email. All quotes shall be submitted on or before the offer due date shown on page 1 of the Standard Form 1449 in
Block 8.
Offeror submissions shall include, but is not limited to:
