1. Page 21 of the RFP states we are to provide Representations and Certifications in Volume II - Price Proposal (Pages 25 through 28 of the RFP). However, there are additional FAR Clauses in the General Conditions. Do we need to complete and submit FAR 52.219-28 Post-Award Small Business Program Representations with our proposal?

However, there are additional FAR Clauses in the General Conditions. Do we need to complete and submit FAR 52.223-9 Estimate of Percentage of Recovered Material Content for EPA-Designated Items with our proposal?

FAR 52.223-9 is not required for the SAMPLE PROJECT but will be required for subsequent task order awards.

5. The RFP requires us to submit Exhibits E and F to each customer point of contact for Section B - Past Performance. It can be difficult to obtain new PPQs from our customer points of contact with every new proposal. Would the government consider accepting a CPARs evaluation submitted in our proposal in lieu of a new Exhibit E/F?

The Government reserves the right to check any or all cited references to verify supplied information and to assess owner satisfaction as to quality, schedule, cost, and management. The Government may also use other tools such as CPARS, Vet Biz, Dunn & Bradstreet, and Federal Awardee Performance and Integrity Information System (FAPIIS) to gather documentation on past performance, and personal knowledge of offerors. Past performance will be evaluated in accordance with FAR 15.305(a)(2). Evaluations may include past performance information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement. Offerors without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance and shall receive a neutral rating for Past Performance. Offerors may provide information on problems encountered on the identified contracts and the corrective action taken if desired. This information shall be submitted for this procurement using Exhibit F, Past Performance Questionnaire, transmitted via Exhibit E, Sample Transmittal Letter.

6. We were unable to have a representative attend the site walk and it is past the requested 24 hour notice, does this disqualify us from bidding?

Site visit attendance was not mandatory.

7. Please confirm order of precedence for the contract documents if there are errors or omissions; SOW, dwgs, specs, example task order package, etc.

8. Please confirm for the Wilkes-Barre VAMC MATOC that we are to send the required documents to both Wilkes-Barre VAMC as well as Wilmington VAMC in order for the SSEB to review. Contractor is confused if this same template is used for potentially two (2) separate MATOCs.

9. If a SDVOSB general contractor’s past performance (PPQ & CPARS) and relevant experience (projects) stand on its own merit does the contractor need to submit subcontractor consent forms “Exhibit C – Subcontractor Information and Consent Form”? Our company has past performance and relevant experience at the Prime level without needing to gain the experiences of our subcontractors.

Each major subcontractor and/or Teaming Partner must also complete an Exhibit C, “Subcontractor Information and Consent Form” to be considered. Offerors shall have major subcontractors identify on the Exhibit B two references, owners (if they were the Prime) or other Prime contractors they have worked for. References for subcontractors from the proposing offeror are not acceptable.

10. 4.19 VAAR 852.219-10 (d) (ii) (3) states the requirements for self-performance of general construction, 236220, which is also the SEED sample task order. It will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. The self-performance calculation sheet illustrates the calculation for the former VAAR self-performance requirement. Does the SSEB want us to utilize the old form, or could the contractor amend to meet the self-performance calculation requirement per the base MATOC Terms and Conditions? We understand, per part (5) that for ‘construction projects, cost of materials is excluded and not considered to be subcontracted.’

The form contained in the solicitation shall be used.

11. Even though bonding is not required for the sample task order, would the SSEB want the contractor to add their typical bond amount in our Price to illustrate our bonding capabilities.

Will the SSEB allow the contactor to manipulate the Price Schedule item descriptions to fit all components of the work as several ‘definable features of work’ / CSI scope sections are missing. i.e., would you want plumbing scope under mechanical? Would you want all DIV 06 and DIV 09 to fall under ‘finishes”?

13. We see the OSHA forms with dates of 2012 - 2015. Should the contractor assume that we provide statistics for 2017-2020?

14. within the 1442 / solicitation there are instructions on sending hard copies and discs to two (2) different VISN 4 locations, but in the 7.11.21 sample project task order package says ‘proposals are to be submitted via email to the contracting specialist at michael.white9@va.gov and scot.plank@va.gov

The sample project price proposal (volume II) will be used as part of the overall MATOC evaluation determination. If E-mailed, the files must not exceed five (5) Megabytes (MB). The email subject line must contain PROPOSAL 36C24421R0028 Wilkes-Barre MATOC. The subject line must also contain what is attached to the email. For example, PROPOSAL 36C24421R0028 Wilkes-Barre MATOC – Volume II Price, Section 3. More than one e-mail may be needed. 15. Price schedule shows ‘item descriptions’ of General conditions (DIV 01) to Electrical (DIV 26, 27, 28), with a grand total at the bottom. Does the SSEB want the contractor to spread fee (profit and overhead), insurance, bond, special insurances evenly across all DIV 02-33 items? Put the fee in General Conditions? Or will SSEB allow the contractor to provide supplemental information in regard to our Divisional cost breakdown?

16. Exhibit A – Technical Proposal Data, 2F. We are confused on the requirement. We understand that the facility would like to see a list of subcontractors and our due diligence on subcontractors we would utilize within each MATOC task order, which we will certainly provide. But like most VA MATOCs, there is sometimes the ability for the Prime SDVOSB Contractor to provide ‘subcontractor teaming consent forms’ which is named Exhibit C. Our prime experience stands on its own merit (CPARS/PPQs/VA Healthcare work programs) and we do not wish to utilize the past performance and relevant experience of any subcontractors. However, in 2F the question states to ‘Provide list of major subcontractors and their trades that you intend to use on these projects. (These also should have been listed on Exhibit A, Part 2 and there must be an Exhibit B in the proposal for the named subcontractors or they will not be considered.” The contractor understands what we believe the intent of this section is, but could you confirm that if the SDVOSB Prime’s merit (past performance and relevant experience) stands on its own that contractor does not need to submit Exhibit C “Subcontractor Consent Forms” to include the subcontractor’s own Exhibit B PPQs. That only these forms are used for companies that are ‘teaming partners’.

17. Evaluation guidance states 40-page limit for ‘Technical Capability’ with the exceptions of PPQs and Subcontractor Consent forms. Several sub questions:

1. The CO appears to be combining Experience (Sub factor 1) and Capability (Sub factor 2) into the same required answered to the questions within Exhibit A – Technical Proposal Data. How would you like us to segregate answers to each of these subfactors as the Award Criteria does not illustrate this break down?

Sub-factor 1 and Sub-factor 2 are specific to what will be evaluated in each Sub-factor.

2. Would you want 3. Scheduling Methodology & Construction Approach being placed under Sub-Factor 2 “Capability”?

See solicitation pages 22 and 23.

3. Exhibit A’s section 4, “Quality Control” asks for a ‘full Quality Control Plan”. Our full DIV 01 45 CQC Plan for the VA is over 50 pages alone. This requirement is not illustrated as an exception to the 40-page limitation. Would you rather us have a section to describe our quality methodology/control program for VA programs, or can you make this CQC Plan an exception to the page count for Factor 1 – “Technical Capability”.

4. Exhibit A section 5 “safety” is not listed as a subfactor under Factor 1 – Technical Capability. Would you like contractor to make a Sub-Factor 4 – “Safety” to address these questions.

18. Can we utilize that standard PPQ form for the VA? This section seems to be confused with Sub-factor 1 – “Experience” as this is where contractors typically provide size, scope, complexity, relevancy of projects within the past 3-5 years in a healthcare environment, where the contractor would provide PPQs, via COR/CO, to show the “Past Performance” rating of the contractor. Typically, this “Past Performance Sections” are where we provide PPQs within the past year by VA customers and where the SSEB reviews CPARS scores. We are overall confused at the structure of this PPQ as most of the questions revolve around Prime SDVOSB contractors that do not have the prime federal experience to execute MATOCs or task orders without utilizing subcontractor consent. Please clarify as this is different than all typical VA MATOCs in the expectations of the MATOC technical requirements. Exhibits, B, E and F are required.

19. Does the SSEB want the contractor to discuss the technical capability on past projects only where we provide PPQs? Yes. Or can Evaluation Factor 1 – Technical Capability describe our companies’ experience in a healthcare environment? Answered. How many years of experience do you want us to show in a healthcare environment – 3, 5? Seems to be doubled information in Exhibit B and Exhibit C. See solicitation.

The VA requests three (3) construction projects that best illustrate the contractor’s prime and subcontractor’s team’s qualifications completed within the past five (5) years. This documentation shall be submitted in accordance with Exhibit B, Past Performance Relevancy Questionnaire. The document should be written to show the team’s construction performance, qualifications with respect to health care construction projects, i.e. new hospital construction, hospital renovations, demo projects, and projects generally associated with the maintenance and expansions hospital campuses. The past performance section shall not exceed twelve (12) total pages.

20. We are confused between S02 Exhibit F PPQ 02 vs. Exhibit B – Past Performance Relevancy Questionnaire 02? Is Exhibit B used in addition of Exhibit A “Technical Proposal Data’ to help describe our technical capabilities. In what sub-factor is Exhibit F (Technical Proposal Data) placed?

Exhibit B concerns past performance relevancy according to the solicitation.

21. DIV 01 45 00 Quality Control not provided. Does the VA want the contractor to use the TIL for the 01 45 00 blanket Quality Control spec? Can the Superintendent for the sample task order also be the QCM and SSHO for the project as long as they meet the experience requirements?

The contractor shall use the VA TIL for the 01 45 00 Quality Control spec. The Superintendent may take on additional roles such as QCM and SSHO if they meet the experience requirements.

22. Two questions related to the Price Schedule: (1) A.3. Price/Cost Schedule appears to be an order schedule for the MATOC. Are we to leave this blank or did you want to base bid for the sample task order written here? (2) The Price Schedule on page 6 of 23 of the sample project task order package does not show the drawing set ‘bid deducts’. Please confirm if you want us to provide a FFP-LS deductive alternate in addition to the price schedule.

(2) Base deducts are not to be used in submitting the proposal. See attached Revised Pricing Schedule.

ITEM I / BASE PRICE:

GENERAL CONSTRUCTION: The scope of work shall generally consist of, but not necessarily be limited to, providing all labor, materials, tools, equipment, permits, testing, and reports required to renovate existing spaces on the 2nd Floor of Buildings 1 at the Wilkes-Barre VA Medical Center as defined by drawings and specifications. The newly renovated space is intended for Rehab and Prosthetics Service, and shall include Physical Therapy Clinics, Occupational Therapy Clinics, Rehab Clinics, Administrative Offices, Waiting Area, Clinical/Exam space, and supporting functions required for implementing patient-centered care. Work shall include major demolition (HVAC, plumbing, electrical, architectural), asbestos abatement, lead remediation, and new architectural, HVAC, plumbing, electrical, and fire protection systems. All work shall comply with all the latest federal, state, and local codes and regulations and VA standards.
