Refer to FAR Clause 52.204-9 Personal Identity Verification of Contractor Personnel and VAAR Clause 852.204-70 Personal Identity Verification of Contractor Personnel.
PIV BADGE ISSUANCE:
All contract personnel must secure a PIV or PIV-I badge issued by Department of Veteran Affairs New Jersey Medical Center before beginning any physical work on the project.
The issuance process for a PIV-I badge can take up to 14 working days to receive. The issuance process for a PIV badge can take up to 30 working days. It is essential to factor this duration into the construction schedule.
The PIV-I or PIV badge is a critical security measure and must be worn visibly at all times while on-site.
ACCESS RESTRICTIONS:
No contract personnel will be allowed on-site without a valid PIV or PIV-I badge. This policy is strictly enforced to maintain the security and integrity of the work environment.
Security personnel will conduct checks to ensure compliance with this requirement. Any individual found on-site without a PIV or PIV-I badge will be asked to leave the premises immediately.
APPLICATION PROCESS:
To obtain a PIV or PIV-I badge, contract personnel must complete the necessary application process, which includes background checks and identity verification.
Detailed instructions on the application process can be obtained from the Contracting Officer Representative (COR) that is assigned to the project.
CONSTRUCTION SCHEDULE:
The construction schedule must include the timeframe required for PIV-I and PIV badge issuance. It is the responsibility of each contractor and subcontractor to plan accordingly to avoid delays.
DEPARTMENT OF VETERANS AFFAIRS LIABILITY:
The Department of Veterans Affairs will not be held responsible for any delays incurred in the issuance of PIV or PIV-I badges for contractors and subcontractors. It is the responsibility of the contracting parties to ensure timely application and compliance with the badge issuance process. Delays in badge issuance will not be considered as valid reasons to submit a claim for additional time or compensation.
ENFORMENT AND COMPLIANCE:
It is the responsibility of each contractor and subcontractor to ensure that all employees have their PIV or PIV-I badges before arriving on-site.
Failure to comply with this requirement may result in delays, penalties, or termination of the contract.
We appreciate your cooperation in adhering to this important security protocol. If you have any questions or need assistance with the PIV badge application process, please contact the Contracting Officer.
By submission of bid, the Contractor acknowledges and agrees that:
1. No construction work of any kind may begin on VA property until all Contractor and subcontractor personnel requiring unescorted access have been issued and are in possession of an approved VA PIV access badge.
2. The Contractor understands that the VA PIV enrollment and badge issuance process may take up to thirty (30) calendar days or longer, and that processing timelines are dependent upon government security requirements.
3. The Contractor has fully accounted for the PIV process and badge issuance time in its bid price, staffing plan, mobilization plan and construction schedule.
4. Delays related to PIV processing, background investigation, adjudication, badge issuance, renewal or personnel changes shall not constitute grounds for time extension, equitable adjustment, or claim against the Government.
5. All costs associated with PIV compliance, including administrative time, travel, labor downtime, and delays, are the sole responsibility of the Contractor.
