About this file

This is a Questions and Answers (Q&A) document for a federal contract solicitation related to wastewater treatment facility maintenance and sludge removal services.

The original solicitation (36C24226Q0717) was issued as a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside but was cancelled because no prime vendors possessed the required A901 certification mandated by New Jersey state law for hull waste handling. The requirement was subsequently reissued as an unrestricted procurement (36C24226Q0989). The contract period consists of a base year plus four option years, running from October 12, 2026 through October 11, 2031, with updated period of performance dates of October 9, 2026 through October 8, 2031. The proposal submission deadline has been extended to September 24, 2025 at 12:00 PM EST. Quotations must be submitted in three parts: Part I – Technical Capability (2 copies), Part II – Past Performance (2 copies), and Part III – Pricing (1 copy), with one unredacted and one redacted complete proposal required. The contracting department is NC02.

The scope of work involves maintenance and sludge removal from four types of wastewater treatment tanks and channels located outside buildings: two aeration tanks (75 ft L x 25 ft W x 1-3 ft D), one scum pit (5.5 ft L x 3.5 ft W x 18 ft D), one sewer well (6.5 ft L x 3.5 ft W x 1-3 ft D), and two influent channels (10 ft L x 2 ft W). All tanks are open systems requiring no special fittings. The contractor is responsible for identifying and utilizing a permitted disposal facility for generated sludge. Detailed specifications and estimated quantities are provided in the updated Statement of Work, specifically in Section 5, which has been revised along with Task 2 (Remove and Transport) and Procedures Section J.

Questions:

1. Whether the quotations received under 36C24226Q0717 were evaluated.

a. The first solicitation that was posted was for All SDVOSB companies.

However, after reviewing the proposals I noticed none of the SDVOSB possessed the A901 certification. In order to be awarded this contract the Prime must possess the A901 certification.

2. The current status or outcome of that solicitation.

a. Due to none of the prime vendors having the A901 Certification, an award could not be made to SDVOSB. In the State of New Jersey, the Prime vendor must have the A901 Certification.

3. Whether JHLSS’s quotation remains under consideration.

a. If the prime vendor did not posses the A901 Certification It could not be awarded to them. The prime vendor must possess the A901 Certification.

4. How Solicitation 36C24226Q0989 relates to the procurement conducted under 36C24226Q0717

a. Solicitation 36C24226Q0717 had to be cancelled due to none of the prime vendors holding the required license to be able to hull waste for the state of New Jersey.

5. What prompted the change from a 100% SDVOSB set-aside to an unrestricted procurement.

a. To be able to award this requirement to a SDVOSB the prime vendor must be able to produce an A901 certified for the prime vendor.

6. Option Year Periods We noted inconsistencies between the cover page, pricing schedule, and contract clauses regarding the option year dates and contract duration. Could you please confirm the correct period of performance for the base year and each option year, and confirm whether the five-year schedule outlined in the Performance Work Statement is the governing schedule?

a. After reviewing the price schedule, the price schedule is incomplete and needs to be modified.

b. A modification will be implemented to incorporate a base + 4-year contract. 0001 – 4006 period of performance October 12, 2026 – October 11, 2031.

BASE 10/12/2026 – 10/11/2027

OY1 10/12/2027 – 10/11/2028

OY2 10/12/2028 – 10/11/2029

OY3 10/12/2029 – 10/11/2030

OY4 10/12/2030 – 10/11/2031

7. The solicitation instructions indicate that quotations are to be submitted in four parts; however, only the following three parts are identified:

Part I – Technical Capability Part II – Past Performance Part III – Pricing Could you please clarify the required fourth submission component?

a. The fourth submission is in error and will be removed or revised to dismiss the fourth submission component.

i. In section FAR 52.212-1 INSTRUCTIONS TO OFFERORS

1. All quotes are to be submitted in three parts, as detailed below.

2. Part I – Technical Capability (Factor 1) (2 copies)

3. Part II – Past Performance , (Factor 2) (2 copies)

4. Part III – Pricing (Factor 3) (1 copies)

5. The NC02 Contracting Department requests two (2) Copies of your proposal: one unredacted and one redacted. This does not apply to the attachments located in Section D, but the 852.219-75 Limitations on Subcontracting - Compliance for Services and Construction must be completed by all vendors. Failure to follow this request will render your quote nonresponsive.

8. Redacted and Unredacted Copies The solicitation requests both a redacted and unredacted proposal copy, while also requesting two copies of the Technical Capability and Past Performance sections and one copy of the Pricing section.

Could you please confirm:

Whether separate redacted and unredacted PDFs are required for the Technical Capability and Past Performance submissions; and Whether Pricing should be included only in the unredacted submission.

a. Please note that it is a custom practice that all vendors follow the instructions provided by the Contracting Department. Providing a redacted solicitation gives all vendors a fair opportunity when it comes to a proposal of this type of evaluation does not know what vendor they will be grading and because of that all scores will be fair to all parties.

Please follow all instructions provided by the contracting department.

9. Disposal Facility Does the VA have a designated or historical disposal/treatment outlet for the sludge generated under this contract, or is the contractor responsible for identifying and utilizing a permitted disposal facility?

a. According to the service the contractor is responsible for identifying and utilizing a permitted disposal facility

10. Incumbent Contractor Could you please advise who is currently performing these services under the existing contract?

a. Currently I don’t have any information on the previous vendor who provided services for the previous contract. This is a new requirement and I do not have any of the additional information you are requesting.

11. Proposal Due Date / Extension Request Given the volume of technical, compliance, and pricing information required, as well as the clarifications noted above, has the VA considered extending the proposal due date? An extension would allow offerors additional time to fully evaluate the requirement and submit the most complete and competitive response possible.

a. An extension will be granted for this requirement the new due date for this is September 24, 2025 @ 12PM EST.

12. I have questions about all of the below items do you have any specs on these item I see you give dimension of each but how much quantity is generated at each pick up for each and how often does each occur?

a. Please refer to the Statement of Work

a. All tanks are located outside the buildings.

Is the aeration tank open or in closed and how close can we get to it. Do we need any special fittings?
