STATEMENT OF WORK

Title: Replace Tube Bundles

1.0 INTRODUCTION

The scope of this project is to supply 53 tube bundles for existing shell and tube exchangers (steam to hot water). The tube bundles have reached their expected life expectancy and need replacement in order to run an operational heating system throughout the multiple buildings that they serve. This replacement will be in kind.

The equipment is to be delivered to the Northport VA medical center warehouse building 36; Located at 79 Middleville Road, Northport, NY 11768. The period of performance will begin with a Notice to Proceed (NTP) issued after contract award. Total period of performance shall not exceed (210) days after NTP. This period of performance includes reasonable duration for submittal review and approval prior to ordering the tube bundle and relief valve.

2.0 REGULATIONS

1. VHA Directive 1810 – Boiler and Boiler Plant Operations (dated January 4, 2023)

2. VHA Operational Alert and Guidance Document FY2022-01 – Cast Iron Fittings / Valve Housing Use in High and Medium Pressure Steam Distribution Systems (dated December 14, 2022)

3.0 GENERAL REQUIREMENTS

1. To conform to the requirements of the VHA Operational Alert and Guidance document, the contractor must not use cast iron fittings, and components or malleable/ductile fittings anywhere in the high-pressure and medium pressure steam system (15 psi or above). Contractor must use only cast steel or forged steel fittings and components, in accordance with the VA Master Specifications.

2. Contractor must coordinate with VA Contractor’s Officer Representative (COR) the delivery date and time.

3. The equipment shall be checked by the Contractor’s Officer Representative (COR) for any damage prior to delivery acceptance.

4. The following are required for this project:

a. Supplies to be provided per this Statement of Work (SOW) and specifications included.

b. Contractor to coordinate with the VA COR prior to the delivery of all equipment.

c. Contractor to field measure existing shell and tube heat exchangers (steam to hot water) and record the make & model number before ordering as we are replacing in kind.

d. Failure to supply the exact tube bundles for the existing shell and tube heat exchangers will lead to rejection of delivery.

4.0 SAFETY PRECAUTIONS

1. The Contractor shall comply with all applicable Federal, State, and local legal requirements regarding workers health and safety. The requirements include but are not limited to, those found in Federal and State Occupational Safety and Health Act (OSHA) statutes and regulations, such as applicable provisions of Title 29, Code of Federal Regulations (CFR) Parts 1910 and 1926. Contractor is solely responsible for determining the legal requirements that apply to activities and shall ensure safe and healthful working conditions for its employees.

2. Contractor shall assume the responsibility to guard against causing of fires and/or explosions and to protect Government Property.

Description This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued.

This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC_2025-03 1-17-2025.

This solicitation is set-aside for: Small Business The associated North American Industrial Classification System (NAICS) code for this procurement is 332410, with a small business size standard of 750 employees.

The FSC/PSC is 4420.

The following solicitation provisions apply to this acquisition:

1. FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items” (Oct 2018) Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal in accordance with FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items.” If paragraph (j) of the provision is applicable, a written submission is required.

52.225-2 Buy American Certificate.

(a)(1) The Offeror certifies that each end product, except those listed in paragraph (b) of this provision, is a domestic end product and that each domestic end product listed in paragraph (c) of this provision contains a critical component.

(2) The Offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products. For those foreign end products that do not consist wholly or predominantly of iron or steel or a combination of both, the Offeror shall also indicate whether these foreign end products exceed 55 percent domestic content, except for those that are COTS items. If the percentage of the domestic content is unknown, select ‘‘no’’.

(3) The Offeror shall separately list the line item numbers of domestic end products that contain a critical component (see FAR 25.105).

(4) The terms ‘‘commercially available off-the-shelf (COTS) item,’’ ‘‘critical component,’’ ‘‘domestic end product,’’ ‘‘end product,’’ and ‘‘foreign end product’’ are defined in the clause of this solicitation entitled ‘‘Buy American—Supplies.”

The following are the decision factors:

52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

(i) Technical Capability: Offeror has the capability of meeting all requirements of the Statement of Work and is authorized to provide all requested equipment.

(ii) Price: The Government will evaluate the price by adding the total of all line-item prices. The total Evaluated Price will be that sum.

(iii) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

"The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."

OR

"The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:"

Quoters shall list exception(s) and rationale for the exception(s), if any.

Submission shall be received no later than 1600 hours EST 03/28/2025 to Janelle.Bonafede@va.gov.

Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f). e-mailed quotes will be accepted.
