CONTINUATION PAGE

1. We understand that Solid Waste and Recycling is regulated by the NYC Business Integrity Unit. Will the VA require the prime contractor to hold a licenses directly from the NYC BIC? As we read the regulations, the prime would need to poses this approval.

Yes, because the contractors are expected to follow all national and local regulations.

1. who is the incumbent hauler?

This requirement was previously awarded in a larger service contract award to Prosource Consulting, L.L.C The contract number was VA243-16-F-2983. This procurement is now unbundled to a separate service contract just for the Garbage Collection Service.

Prosource Consulting, L.L.C was the awardee and they are a Small Business. The request is not a follow-on acquisition This is not a bundled requirement.

1. Does this bid include medical/hazardous waste removal? No

1. In section 10 of the first page, it has 100% to set aside for Service Disabled Veteran-Owned small business. What does this mean?

Only Service Disabled Veteran-Owned small business (SDVOSB) can submit a bid.

1. Does this bid included medical waste handling as per below? No

13. TRAINING REQUIREMENTS

Due to the health and safety risks (especially Bloodborne Pathogens) associated with this requirement, the Contractor’s methods, procedures, training and other controls that are proposed must allow the performance of the tasks with no adverse effects from the risk factors. The training plan shall demonstrate a good working knowledge of the US DOT, US Occupational Health and Safety (OSHA), and other applicable regulations that govern the health and safety risks involved in the handling and shipping of regulated medical waste. The contractor must be able to provide, at a minimum, the following training:

Although there is no biohazard or hazardous waste in this contract because the location is the dock area there may be more than one waste stream on the dock at the same time.

As you are aware, ##### is the incumbent service provider for Brooklyn, St. Albans, and Manhattan Campus locations. We would like to submit the following questions in regard to Solicitation 36C24220R0145: This requirement was previously awarded in a larger service contract award to Prosource Consulting, L.L.C

On what basis has the contracting officer determined that there is a reasonable expectation that two or more verified and capable SDVOSBs will submit offers? Market Research Please note that pursuant to Section 16-505 of the New York City Administrative Code and related regulations, it is unlawful to operate a business for the collection of commercial waste in the City of New York, including brokering or subcontracting such collection, without a license issued by the New York City Business Integrity Commission (BIC). However, there do not appear to be any businesses verified as either SDVOSBs or VOSBs in the VIP database under the appropriate NAICS code that also hold a BIC license to operate a business for the collection of commercial waste in the City of New York. Accordingly, it appears unreasonable to expect even one SDVOSB to submit an offer unless such entity intends to (i) violate applicable federal limitations on subcontracting to non-similarly situated entities in an SDVOSB set-aside, and/or (ii) violate the requirements of the solicitation that the Contractor comply with local laws in performance of the services. Inapplicable.
