Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C242-19-AP-0906
1. Contracting Activity: Department of Veterans Affairs, VISN 02, New York Harbor Healthcare System
(NYHHCS) Brooklyn Campus located at 800 Poly Place, Brooklyn, NY 11209-7104. Biomedical Engineering Services of the NYHHCS, Brooklyn Campus, has submitted Purchase Request Number 630-19-2-4454-0023. This is a Justification for Other Than Full and Open Competition.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a request for approval of full maintenance service of various government-owned scopes and associated equipment, used at the Brooklyn VA Medical Center. The purpose of the full-service agreement is to reduce service costs and improve equipment turn-around time and reliability. This will be a firm-fixed price purchase order contract with an anticipated period of performance of February 1, 2019 through September 30, 2019, and four one-year options.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Pentax of America, Inc. is the only company that can provide all the necessary OEM parts and perform all the necessary returns and repairs for the Pentax scopes and associated equipment described above due to VHA Handbook 1761.1 – Standardization of Supplies and Equipment Procedures. It is VHA policy to standardize to the maximum extent possible the types and categories of supplies and equipment VHA purchases, consistent with patient care and practitioner needs. Standardization is expected to facilitate best-value product pricing through volume purchasing and facilitate the delivery of high-quality health care. The requesting service has standardized with Pentax of America, Inc. since 2015. Purchasing universal alternatives would cause issues with standardization, which could lead to significant patient risk. Accordingly, Pentax of America, Inc. is the only firm capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements.
4. Description of market research conducted and results or statement why it was not conducted:
This action is a follow-on maintenance service requirement after a one-year lease and full-service maintenance and an exercised purchase option was exercised effective 1/01/2019 (reference FSS Delivery Order V797P-30172, 36C24218N1085). In preparation for that award, market research was conducted in December 2017 and resulted in the following findings:
Past procurement history indicates that this procurement was supported by successive delivery orders under the former Pentax VA FSS contract V797P-4389A, which also cited the role that standardization played in creating this BPA with Pentax of America, Inc. A search of GSA eLibrary for Pentax of America, Inc. in Schedule 65 II A resulted in one GSA contract identified as V797D- 30172. A search in the VA MedSurg Catalog for Pentax of America, Inc. produced one result with https://www.acquisition.gov/?q=/browse/far/13

Pentax of America, Inc. A product search of the Ability One website with description for “Pentax” resulted in no results. A VetBiz search under NAICS code 339112 with keyword “Pentax” produced two matches, but a look in the two firms’ website revealed that this requirement cannot be supported by an SDVOSB firm.
NOTE: The full-service maintenance portion of the above referenced FSS delivery order was all open market pricing, terms & conditions.
