Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241-25-AP-1994
1. Contracting Activity: Department of Veterans Affairs, VISN 1, VA Maine Healthcare System (Togus) 1 VA Center Augusta, Maine 04330.
PR: 402-25-2-100-0027
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The estimated value of the proposed action is $ 43,105.05
This project will provide five State of the Art Reliance FX-920 Full-Power Tilt Exam Chairs for the Eye Clinic department at Togus. These chairs will be replacing older reliance chairs that are at the end of their life cycle.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The procurement of the Reliance FX-920 Chairs aims to replace equipment at the end of its lifecycle. The acquisition of this equipment will ensure the facility's capabilities to provide patient care through timely and efficient examinations.
The sole source letter from the OEM indicates that the requested Haag-Streit brand Reliance FX-920 Exam Chairs are proprietary, exclusive, and peculiar to the Large Business OEM. The standardized designs and capabilities of these Exam Chairs will ensure workflow and performance consistency necessary for consistent and high-quality patient care.
The exam chairs are only available from Haag-Streit authorized distributors. The Reliance FX-920 Exam Chair Pearl #20 (Charcoal Upholstery) is customized to match other FX-920 Exam Chairs currently in use at TOGUS VAMC. This brand requirement is justified IAW FAR 13.106-1(b)(1)(i)., by their compatibility with previously purchased equipment of the same model, as well as by the performance standards of these chairs. These chairs must match the Reliance Brand FX-920 Exam Chairs already used in existing Optometry Lanes at VAMC Togus. The Reliance brand Reliance FX-920 Chairs from Haag-Streit USA Inc will ensure compatibility and standardization across all Optometry Lanes at VAMC Togus. The Reliance FX-920 Chairs will match the color and style of Reliance FX-920 Exam Chairs already in place at the VAMC Togus Optometry Lanes. Conformity and the continuity will maintain workflow for the clinical staff, providing the best value to the Government.
4. Description of market research conducted and results or statement why it was not conducted:
Haag-Streit has provided a sole source letter indicating that they are the sole manufacturer of the Reliance FX-920 Exam Chair. This Haag-Streit Reliance Model is exclusive, proprietary, and peculiar to the LB (large business) OEM (Original Equipment Manufacturer): Haag-Streit. Haag-Streit has also designated at least (3) SBs as their authorized distributors.
No VA agency or other agency has excess supplies of this nature. AbilityOne cannot fulfill the requirement.
· Mandatory Sources: Mandatory sources VA Inventories, Other Agencies, AbilityOne, FPI (Federal Prison Industries) and mandatory contracts were searched. None of these sources can supply the Reliance FX-920 Chairs.
· Source Lists for Similar Items from Other Activities, Agencies, Trade Associations, or Sources: Brand-equal items are not suitable for this requirement. Standardization and compatibility with the already existing Reliance FX-920 Exam Chairs are the primary factors concerning model selection.
· SAC (Strategic Acquisition Center): Both the SAC and the SCMC were searched. The requirements listed are not available via any SAC Contract.
· VAAR 810.003-70(c) VFCP (Veterans First Contracting Program): There is no NMR Waiver for NAICS 339112 for the Reliance FX-920 Chairs. Per the NMR Decision Tree and IAW VAAR 819.7003(d), an SD/VOSB set-aside can be applied.
· GSA NAC (National Acquisition Center) FSS (Federal Supply Schedule): The GSA e-Library lists contracts for this requirement under various BPA’s: Medical Equipment and Supplies. There is an FSS (36F79722D0203) held by Large Business Lombart Brothers Inc (dba Marco Lombart).
· GSA Advantage: The Reliance FX-920 Chairs are listed on GSA Advantage and are available via FSS contract. The GSA Advantage search discovered FSS V797D-60693 held by SB Bryan Medical Inc.
· GSA e-Library: The Reliance FX-920 Chairs were not listed on GSA e-Library. There is an FSS schedule holder that provides the required Reliance FX-920 Chairs.
· Straight SB Set-Aside FAR 19.502-2(a): The requirement is below SAT (Simplified Acquisition Threshold); The SBA NMR Exception can be applied for a Straight SB Set-Aside (FAR 19.502-2(a)). There is only (1) manufacturer for the required Reliance FX-920 Chairs, Haag-Streit. The required product is proprietary and exclusive to that OEM. Haag -Streit has at least (3) OEM-authorized SB Class distributors. The requirement is eligible for a straight SB set-aside; the rule of two has been met.
Nonmanufacturer Rule (NMR) Findings): There is no applicable NMR Waiver for NAICS 339112. Per VAAR 819.7003(d) a SD/VOSB Set-aside cannot be applied; the NMR is not satisfied. The requirement is below SAT; the LOS does not apply. The SBA NMR Exception applies; the requirement is eligible for a SB Set-Aside IAW FAR 19.502-2(a).
Recommendation: The recommendation is for a Straight SB Set-Aside for The Reliance FX-920 Chairs, for The Haag-Streit brand Reliance FX-920 Chairs IAW FAR 19.502-2(a). There is no NMR Waiver for NAICS 339113; an SDVOSB Set-Side cannot be leveraged. The competition will be Open Market; this will provide competition to the maximum extent practicable.
The Reliance FX-920 Exam Chairs are proprietary, exclusive, and peculiar to the LB (large business) OEM (Original Equipment Manufacturer) Haag-Streit. The exam chairs are only available from Haag-Streit authorized distributors. This brand requirement is justified IAW FAR 13.106-1(b)(1)(i), due to compatibility with previously purchased equipment of the same model, as well as by the conformance of these chairs. The Reliance FX-920 Chairs will match the color and style of Reliance FX-920 Exam Chairs already in place at the VAMC Togus Optometry Lanes. Conformity and continuity will maintain workflow for the clinical staff, providing the best value to the Government. The Reliance brand Reliance FX-920 Chairs from Haag-Streit USA Inc will ensure compatibility and standardization across all Optometry Lanes at VAMC Togus.
The Reliance FX-920 Exam Chairs are available via FSS: 1) 36F79722D0203: Lombart Brothers Inc (dba Marco Lombart) (LB); 2) V797D-60693: Bryan Medical Inc. (SB) There are not enough Small Business FSS holders to compete as an FSS.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
