DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241-25-AP-4976
1. Contracting Activity: Department of Veterans Affairs, VISN 01, North Hampton Medical Center Radiology Service.
2237: 631-25-4-7821-0881
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Diagnostic Imaging is requesting a C-Arm table to be used with radiology equipment already in place at Worcester Outpatient Clinic. The table is specialized for use with an existing C-Arm fluoroscopy machine. It is necessary because it is radiation penetrable and will be used primarily for positioning Pain Management patients. Table type requested is Oakworks, 81772 Integrated, 110v, CFPM401; with Oakworks, 81819 Spinal Positioning System II.
Estimated Amount: $21,845.59
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
· The service has standardized to this brand for previous procurements. Maintaining standardization will ensure compatibility and streamline patient care.
· The Oakworks C-ARM CFPM401 Integrated Headrest Imaging-Pain Management Table was selected for the following criteria meeting the needs for pain management imaging:
· 500-pound capacity.
· Spine Positioning System II positioning system which will provide optimal imaging and will maximize patient comfort during imaging.
· Interventional Supine Pillow which consist of a contoured pad and a support wedge to maximize comfort and to minimize pain during the procedure.
· Arm Hammock to remove pressure; to minimize patient pain while imaging arm injuries.
· The Radiology Clinic considered brand equal devices; other brands did not provide the imaging and the ergonomic features offered by the Oakworks C-Arm brand, which VAMC CWM has standardized to.
4. Description of market research conducted and results or statement why it was not conducted: The Contracting Activity queried traditional sites such as SBA DSBS, GSA e-library and FPDS. The Contracting Activity conducted its first search on SBA DSBS. The SBA DSBS keyword “Oakworks” search returned 1 result. The GSA e-library keyword “Imaging Table” returned 3 results. The FPDS keyword search “Oakworks” returned 108 results. Market Research leads to MedLog Solutions or CME Corp as SDVOSB distributors for Oakworks.
5. Description of market research conducted and results or statement why it was not conducted: The Contracting Activity queried traditional sites such as SBA DSBS, GSA e-library and FPDS. The SBA DSBS keyword “Oakworks” search returned 1 result, the OEM who can distribute. GSA Advantage and GSA e-Library searches turned up 0 results for C-arm Tables. The FPDS keyword search “Oakworks” returned 108 results. Market Research leads to MedLog Solutions or CME Corp as SDVOSB distributors for Oakworks.
· Mandatory Sources: Mandatory sources VA Inventories, Other Agencies, AbilityOne, FPI (Federal Prison Industries) and mandatory contracts were searched. None of those sources carry a Oakworks C-arm Table such as the model provided by Oakworks.
· Source Lists for Similar Items from Other Activities, Agencies, Trade Associations, or Sources: Similar items are not suitable for this requirement. Standardization and compatibility with already existing equipment are the primary factor concerning model selection.
· SAC (Strategic Acquisition Center): Both the SAC and the SCMC were searched. The requirements listed are not available via any SAC Contract.
· VAAR 810.003-70(c) VFCP (Veterans First Contracting Program): There is no NMR Waiver for NAICS 339113, the best-fit NAICS for the Oakworks C-arm Table. Per the NMR Decision Tree and IAW VAAR 819.7003(d), an SD/VOSB set-aside cannot be applied.
· GSA NAC (National Acquisition Center) FSS (Federal Supply Schedule): The GSA e-Library lists contracts for this requirement under various BPA’s: Medical Equipment and Supplies. The GSA e-library keyword “Imaging Table” returned 3 results. There were no federal or national contracts carrying the required Oakworks C-arm Table.
· GSA Advantage: The Oakworks C-arm Table was not listed on GSA Advantage and is not available via FSS contract.
· GSA e-Library: The Oakworks C-arm Table was not listed on GSA e-Library. There are no FSS schedule holders that provide the required C-arm Table.
· FAR 19.502-2(A) Straight SB Set-Aside: The requirement is below SAT (Simplified Acquisition Threshold of $250k); there is an SBA NMR Waiver (FAR 19.502-2(a) that could typically be applied. There is only (1) manufacturer; one (1) source for the required Oakworks C-arm Table, the OEM Oakworks. The required product is proprietary and exclusive to that OEM. The requirement is eligible for a straight SB Set-Aside; the rule of two has been be met.
· FAR 13.106-1(b)(1)(i) Brand Name Justification: The brand requirement for the Oakworks brand C-Arm Table is supported by FAR 13.106-1(b)(1); the required Oakworks CFPM 401 C-Arm Table is proprietary and exclusive, to the SB OEM, Oakworks Inc. The Oakworks C-Arm Table is designed and manufactured by the OEM. The OEM has provided a Letter of Authorization (LOA) designating two (2) SB Class distributors: CME Inc/Claflin and Medalog Solutions as the sole Government distributors for the Oakworks C-Arm. The Oakworks C-Arm Table’s compatibility and performance attributes establish the Oakworks brand C-Arm Table as providing the best value to the Government.
NMR (Nonmanufacturing Rule): There is no applicable NMR Waiver for NAICS 339113. Per VAAR 819.7003(d) a SD/VOSB Set-aside cannot be applied; the NMR is not satisfied. The requirement is below SAT; the LOS does not apply. The SBA NMR Exception applies; the requirement is eligible for a SB Set-Aside IAW FAR 19.502-2(a). However, per the OEM: Oakworks, the Oakworks CFPM 401C-Arm Table required is peculiar and exclusive to the OEM.
Recommendation: The recommendation is for a Straight SB Set-Aside via the SBA NMR Exception, FAR 19.502-2(a). The SB OEM has designated (2) SB Class Distributors: CME Inc (Claflin) and Medalog Solutions as the sole, OEM-authorized distributors to the Government. The requirement is below SAT; the LOS does not apply. The Oakworks C-Arm Table is not available from mandatory sources; it is not available via FSS nor any Government-wide contract vehicle. The procurement is open market. There is no NMR Waiver for NAICS 339113; per VAAR 819.7003(d), an SDVOSB Set-Aside cannot be applied. A Straight SB Set-Aside will provide competition to the maximum extent practicable and will provide the best value to the Government.
6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
