B.2 PERFORMANCE WORK STATEMENT
DOCUMENT DESTRUCTION SHREDDING SERVICES PROVIDENCE VAMC
| 1. | Description of Services: The Contractor shall provide document destruction services for Government documents containing sensitive, confidential and medical records. The Contractor maintain liability insurance for the duration of the contract and shall follow all pertinent federal and state regulations with regard to transportation and destruction of medical documentation. During shredding the waste material shall be maintained in a secured container in a secured holding area, which will prevent any disclosure or unauthorized access. The destruction of the information shall be witnessed either by a VA employee or, if authorized by the VA, by a contractor employee. The Providence VA Medical Center shall not be required to separate documents by color or grade of paper, nor remove paper clips and other fasteners. Contractor shall furnish containers and keys for the containers under this contract. Each container provided shall have information on it listing the acceptable and non-acceptable items that may be placed inside |
| 2. | General Requirements |
| a) | Contractor shall provide all labor, materials, containers, transportation, supervision and disposal necessary to provide weekly on-site shredding services for the Veterans Affairs Medical Center (VAMC), Providence, RI at the following locations: |
Main Campus: 32 Gallon Container 830 Chalkstone Avenue, Providence, RI 02908 ; Qty 90 Off Site Locations: 32 Gallon Container 589 Atwells Avenue, Providence, RI 02909 – 1st and 2nd floors; Qty 6 623 Atwells Ave, Providence, RI 02909 – 1st and 3rd floors; Qty 6 75 Eagle Street, Building 6, Providence, RI 02909; Qty 2 Community Base Outpatient Clinics (CBOCs): 32 Gallon Container 233 Stevens Street, Hyannis, MA 02601; Qty 3 175 Elm Street, New Bedford, MA 02740; Qty 3 One Corporate Place (West Main Road at Northgate Road), Middletown, RI 02842; Qty 3
| b) | Contractor shall provide all mobile equipment for conducting onsite interim destruction. The interim destruction of temporary paper records is an important physical safeguard for protecting VA sensitive information whenever transportation or short-term storage (i.e., less than 30 days) of temporary paper records is necessary before final destruction. Methods of interim destruction carried out by an information destruction contractor must be witnessed by a contractor (or subcontractor or third party) employee, then that individual must, prior to departing the VA location, provide the designated VA representative with documentation that acknowledges receipt of the temporary paper records. |
| c) | Contractor shall shred documents in accordance with shredding specifications outlined in most recent VA Directive 6371 guidelines. The rendered paper shall not be sold or otherwise provided to any business that would use it for packaging or any other purpose in its shredded/destroyed condition. |
| d) | The product of the interim destruction requires final destruction, through which temporary paper records are pulped, macerated, shredded or otherwise destroyed to a degree that definitively ensures that they are not readable or reconstructable to any degree. Contractor needs to make reasonable effort to recycle the final destructed material, and provide separate certificates demonstrating the weight recycled. If this final destruction is performed away from a VA facility it must be performed by an information destruction contractor (or its subcontractor of third party) who has demonstrated that: |
| 1. | It’s destruction process constitutes final destruction as defined above; and |
| 2. | It has implemented reasonable physical safeguards to protect VA temporary paper records during their transportation, transfer, or short-term storage prior to the completion of their final destruction. Long-term storage (e.g., more than 30 days) must be approved in advance and in writing by the VA organization that generated the temporary paper records. |
| e) | Contractor shall provide a written "Certificate of Destruction" to the GPOC weekly to provide verification of the destruction of the contents of all containers and receptacles referenced will be required to recycle and provide proof through certificates of destruction in addition to any manifest forms required. |
| f) | The Contractor is responsible for providing wheeled or stationary containers that are less than or equal to 32 gallon capacity, and similarly locked. Containers shall be configured to not allow user to access paper through opening, similar to postal drop box configuration. All containers should be a consistent color and maintained in new or like new condition. Location and required quantities are subject to change throughout the life of the contract – this will be completed through a bilateral contract modification. |
| g) | Contractor shall provide a schedule for shredding. Once the schedule is established all shredding shall occur on the same day of the week. If regularly scheduled day falls on a national holiday, the contractor can perform service either the day prior or the day after the holiday, and shall inform the medical center of the revised schedule for that week. All bins shall be emptied. This will allow a history for tracking any incidents. |
| h) | Upon request, the Contractor must allow a VA representative access to inspect operations at their (and subcontractor or third party) facilities, where the temporary paper records are processed and final destruction takes place. |
| i) | Contractor shall ensure that PII and other VA sensitive information is handled and stored in a secure manner until it undergoes final destruction. Contractor (or subcontractor or third party) who accepts custody of the temporary paper records from a VA facility and transports them to the final destruction location shall be a NAID certified, bonded, and insured contractor (and its subcontractors or third parties) and can provide reasonable physical safeguards for the temporary paper records throughout the destruction process. |
j) The numbers of containers and drop off stations are estimates based on current requirements. The Containers and Drop off stations needed may be increased, or decreased due to the changes in the amount of shredding services required. Additional pick-ups may be required at more frequent intervals, and will be determined/discussed between the Contractor/GPOC as the need arises. Additional pick-ups and changes in the drop off station requirements will be incorporated with a bilateral modification as needed. The contractor shall not incorporate any changes prior to approval from the contracting officer through a bilateral modification.
k. Special pickups may be required during times of overflow conditions, annual destruction of documents, or other special projects. The Contractor shall remove the sensitive documents within seven days or less of receiving notification from the COR. Special pickup requests will be labeled (Special Pickup) and sent separate from regular scheduled pickups. Special pickups may include non-recyclable products such as floppy drives, CD/DVDs, VHS Tapes, plastic film from thermal transfer printers and fax machines, and other media that contains sensitive data. Special pickups may be required throughout the life of the contract, these will be added through a bilateral modification to the contract.

B.4 VA INFORMATION AND INFORMATION SYSTEM SECURITY/PRIVACY LANGUAGE FOR
INCLUSION INTO CONTRACTS
a. Information made available to the contractor or subcontractor by VA for the performance or administration of this contract or information developed by the contractor/subcontractor in performance or administration of the contract shall be used only for those purposes and shall not be used in any other way without the prior written agreement of the VA. This clause expressly limits the contractor/subcontractor's rights to use data as described in Rights in Data
- General, FAR 52.227-14(d) (1).
b. VA information should not be co-mingled, if possible, with any other data on the contractors/subcontractor’s information systems or media storage systems in order to ensure VA requirements related to data protection and media sanitization can be met. If co-mingling must be allowed to meet the requirements of the business need, the contractor must ensure that VA’s information is returned to the VA or destroyed in accordance with VA’s sanitization requirements. VA reserves the right to conduct on site inspections of contractor and subcontractor IT resources to ensure data security controls, separation of data and job duties, and destruction/media sanitization procedures are in compliance with VA directive requirements.
c. Prior to termination or completion of this contract, contractor/subcontractor must not destroy information received from VA, or gathered/created by the contractor in the course of performing this contract without prior written approval by the VA. Any data destruction done on behalf of VA by a contractor/subcontractor must be done in accordance with National Archives and Records Administration (NARA) requirements as outlined in VA Directive 6300, Records and Information Management and its Handbook 6300.1 Records Management Procedures, applicable VA Records Control Schedules, and VA Handbook 6500.1, Electronic Media Sanitization. Self-certification by the contractor that the data destruction requirements above have been met must be sent to the VA Contracting Officer within 30 days of termination of the contract.
d. The contractor/subcontractor must receive, gather, store, back up, maintain, use, disclose and dispose of VA information only in compliance with the terms of the contract and applicable Federal and VA information confidentiality and security laws, regulations and policies. If Federal or VA information confidentiality and security laws, regulations and policies become applicable to the VA information or information systems after execution of the contract, or if NIST issues or updates applicable FIPS or Special Publications (SP) after execution of this contract, the parties agree to negotiate in good faith to implement the information confidentiality and security laws, regulations and policies in this contract.
e. The contractor/subcontractor shall not make copies of VA information except as authorized and necessary to perform the terms of the agreement or to preserve electronic information stored on contractor/subcontractor electronic storage media for restoration in case any electronic equipment or data used by the contractor/subcontractor needs to be restored to an operating state. If copies are made for restoration purposes, after the restoration is complete, the copies must be appropriately destroyed.
f. If VA determines that the contractor has violated any of the information confidentiality, privacy, and security provisions of the contract, it shall be sufficient grounds for VA to withhold VA payment to the contractor or third party or terminate the contract for default or terminate for cause under Federal Acquisition Regulation (FAR) part 12.
g. If a VHA contract is terminated for cause, the associated BAA must also be terminated and appropriate actions taken in accordance with VHA Handbook 1600.01, Business Associate Agreements. Absent an agreement to use or disclose protected health information, there is no business associate relationship.
h. The contractor/subcontractor must store, transport, or transmit VA sensitive information in an encrypted form, using VA-approved encryption tools that are, at a minimum, FIPS 140-2 validated.
i. The contractor/subcontractor’s firewall and Web services security controls, if applicable, shall meet or exceed VA’s minimum requirements. VA Configuration Guidelines are available upon request.
j. Except for uses and disclosures of VA information authorized by this contract for performance of the contract, the contractor/subcontractor may use and disclose VA information only in two other situations: (i) in response to a qualifying order of a court of competent jurisdiction, or (ii) with VA’s prior written approval. The contractor/subcontractor must refer all requests for, demands for production of, or inquiries about, VA information and information systems to the VA contracting officer for response.
k. Notwithstanding the provision above, the contractor/subcontractor shall not release VA records protected by Title 38 U.S.C. 5705, confidentiality of medical quality assurance records and/or Title 38 U.S.C. 7332, confidentiality of certain health records pertaining to drug addiction, sickle cell anemia, alcoholism or alcohol abuse, or infection with human immunodeficiency virus. If the contractor/subcontractor is in receipt of a court order or other requests for the above-mentioned information, that contractor/subcontractor shall immediately refer such court orders or other requests to the VA contracting officer for response.
l. For service that involves the storage, generating, transmitting, or exchanging of VA sensitive information but does not require C&A or an MOU-ISA for system interconnection, the contractor/subcontractor must complete a Contractor Security Control Assessment (CSCA) on 36C24121Q0602 a yearly basis and provide it to the COR.
