OTHER INVOICING INSTRUCTIONS

Invoicing shall be no more than one submission per month in accordance with schedule pricing and applicable deliverable schedule as reflected in Section B.1 PRICE Schedule and Deliverable Table in Section B.3.

Invoices must match Quantity, Unit of Measure, Unit Price, and Total Price as listed on the schedule. Invoices shall be submitted no later than 10 days from end of each month of performance. Invoices may be rejected if instructions provided and schedule pricing is not in accordance with schedule pricing. Final Invoice Submission shall occur only after all deliverables are received and accepted by the Government. The Government reserves the right to withhold final invoice payment until all required deliverables are received and accepted.

PERFORMANCE WORK STATEMENT (PWS)

Civil Treatment Training for VHA Nationwide Employees

1. BACKGROUND:

The Department of Veterans Affairs (VA) Veterans’ Health Administration (VHA) is the largest integrated health care system in the United States, providing care at 1,298 health care facilities, including 171 VA Medical Centers and 1,113 outpatient sites of care of varying complexity (VHA outpatient clinics) to over 9 million Veterans enrolled in the VA health care program.

The VHA Office of Diversity, Equity, and Inclusion (ODEI) mission is rooted in the belief that every Veteran deserves compassionate, culturally competent care that addresses their unique needs and circumstances. VHA is dedicated to creating a workplace where staff from diverse backgrounds feel genuinely supported, included, and able to share their unique perspectives and skills. ODEI is seeking for sources to provide time-critical required training to VHA employees located across the United States. In this capacity, the team provided by the Contractor should consist of high caliber performers, with the knowledge, skills, and ability to provide required Civil Treatment Training with minimal Government guidance and/or instructions. VHA’s vision is to become the benchmark of excellence and value in providing exemplary services that are both patient and employee centric. The VA, ODEI, in fulfillment of its mission and vision, has a requirement for Diversity and Inclusion Civil Treatment [hereafter “Civil Treatment”] needed to equip VHA leaders and employees with the requisite skills, techniques, and knowledge to foster a safe, diverse, and inclusive workplace.

2. OBJECTIVES

ODEI intends to provide a series of virtual/online Civil Treatment training courses to equip frontline staff with the skills, techniques, knowledge, and skills needed to foster respectful and inclusive workplace interactions. ODEI Subject Matter Experts, focus on promoting understanding, tolerance, and professionalism, aiming to prevent discrimination, harassment, and other forms of misconduct. The training shall typically cover specific topics such as diversity awareness, communication skills, conflict resolution, and adherence to ethical standards, contributing to a positive and respectful work environment. The intent is to provide a series of courses for VHA Leaders, Train-the-Trainer, and VHA Employees on a monthly basis. The purpose is to keep abreast of current issues and policies on ways to deal with adversity within the workplace to perform the mission in the VA with internal and external customers. The e-learning process, aims to create a safe and respectful work climate to allows all employees to thrive, maximizes productivity, and retain a diverse and talented workforce.

VHA primary goal of this effort is to create and sustain a diverse, inclusive, and safe work environment whereby all employees can perform at their maximal potential to achieve excellences. VHA strives to become a model employer in providing a culturally responsive environment for Federal Employees and Veterans. VHA seeks to continually educate its workforce on model behaviors designed to positively impact the health and well-being of its workforce and the Nation’s Veterans.

VHA envision of becoming the benchmark of excellence and value in providing exemplary services that are both patient and employee centric. This recurring training is expected to be delivered via an Online virtual platform and shall be available to all VHA employees in an integrated environment that supports learning, discovery, and continuous improvement. Civil Treatment Training should be an interactive, virtual Instructor-led program that communicates employees’ responsibilities for building a civil workplace setting standards for inclusive, professional behavior to minimize legal and compliance risk.

3. SCOPE

The Contractor, for this effort, shall provide Civil Treatment Virtual recurring training courses to be available to all VHA employees. Recurring training shall be hosted on a virtual, Contractor-hosted site to VHA Frontline Staff to promote a workplace of culture that values respect, inclusivity, and the unique and diverse differences of employees and Veterans. Civil Treatment training content shall be presented via courses to proactively prevent and mitigate all forms of discrimination, harassment, and retaliation, foster positive interactions, increase cultural competencies, and enhance communications. Contractor hosted On-line Instructor-Led Virtual Training shall serve as the platform with employees logging onto Government issued equipment or personal desktop/laptop via utilization of Personal Identity Verification (PIV) card.

a. Developing a management plan for organizing structures, roles, responsibilities for training, hiring, and transitioning during on-boarding and off-boarding

b. Developing an approach for submitting deliverables pertaining to Civil Treatment Training classes for VHA Employees

c. Providing a plan on how Civil Treatment Training will be provided to leaders including groups for Attorneys level, HR Staff, General Employees and Train-the-Trainer in the subject matter

d. Providing Civil Training via online, Contractor-Hosted Courses to varied audiences.

e. Providing a registration method for students to attend courses and, upon completion of the courses, receive Continuous Learning Points Certificates for hours completed.

f. Implementing a plan on how Train-the-Trainer would enable organization’s instructors to become capable of knowledge sharing to teach Government Staffs following completion of Train-the-Trainer courses

g. Developing and Introducing a staffing plan, to provide Online course work via Instructor-Led environment at the levels required within a Virtual platform

4. SPECIFIC TASKS

4.1 TASK 1: Kick-Off Meeting (Base Period Only)

The Contractor shall conduct a Kick-off Meeting (Deliverable 1) after 10 calendars days from award to review the goals and schedule of the project with the Government Point of Contacts. The meeting will be held virtually via the Microsoft TEAMS application and is attended by Government staff typically including the Program Manager (PM), Contracting Officer Representative (COR), Contracting Officer (CO), and/or Contract Specialist (CS) along with Contractor Key Personnel and others appropriate to agenda topics. The Contractor shall coordinate with the COR to provide the Kick-Off Meeting Agenda (Deliverable 2) for the meeting and a Staffing Plan (Deliverable 3). The Contractor shall provide Kick- Off Meeting Minutes (Deliverable 4) after completion of the meeting to provide captured action items, attendance, and decisions made during the meeting.

At a minimum, the Kick-off meeting shall include the following topics for:

• Introductions from Contractor Staff and Government employee relating to Civil Treatment Training

• A brief Contracting Officer overview of general contract and Government contract-related policy and regulations

• A brief overview of project administration and reporting by the Vendor

• A review of tasks by the Vendor to forge a common understanding of work to be performed, responsibilities, and Government’s priorities for the Vendor

• Details on registration link

• Details on delivery of training materials and samples of work

• Management plan on registration and training materials

4.2. TASK 2: PROGRAM MANAGEMENT PLANNING

4.2.1 (Base Period Only). The Contractor shall attend a virtual Program Planning Meeting (Deliverable

5) to consult with ODEI staff, the COR and CO which will be coordinated with the COR. Contractor staff to be included are the Program/Project Manager, Certified Instructors and other key contractor staff members involve in the Civil Treatment Training process.

4.2.2 Program Management Plan (PMP) (Deliverable 6)

The Contractor shall develop, provide, maintain, and adhere to the PMP that describes the management strategy, approach, controls, processes, and efforts that will be utilized to effectively organize and manage all training required under this contract. A draft PMP shall be submitted as part of the Contractor’s proposal. The Draft PMP will be reviewed with the Contractor Program Manager and COR or appropriate Government representative, and updates shall be provided following the Kick-Off Meeting as outlined in the Deliverable Table. The PMP shall be considered a living document and may be revised or updated upon agreement between the COR and the Contractor’s Program Manager.

At a minimum, the PMP shall:

• Detail the capabilities of the Offeror’s proposed team

• Establish Contractor Points of Contact and define interfaces between the training and the Government

• Establish the training organization, structure, authority, roles, responsibilities, and internal reporting relationships

• Establish training management procedures and policies, including a process for tracking according to the deliverables identified in Section C

4.3 TASK 3: REPORTING REQUIREMENTS

4.3.1 ODEI Status Updates and Meetings

The Contractor shall attend ODEI Status Meetings (Deliverable 7). The topics discussed in the meeting will include a status of the training activities, issues, resolution to issues and other topics of significance to report. The status update and meeting may include topics from the preceding month’s monthly status report or any topics from the preceding status update and meeting. Topics will include, at a minimum, reviews of:

• Number of Attendants per course

• Number of Completions of Training Courses

• Number of Cancelations

The Contractor shall collaborate with the COR and submit an ODEI Status Meeting Agenda (Deliverable

8) for the Status Update and Meeting, and a written Project Status Report (PSR) (Deliverable 9)) that covers the previous week’s activities. The Contractor’s PSR shall be concise and at a minimum include the following information:

1. The Contract Number and reporting period

2. Contract name

3. A summary of the training in the following format

a. A narrative review of training accomplishments and/or significant events for the week

b. Problems and solutions (to include impacts on quality, schedule and cost and proposed solutions)

c. Major activities planned for the following week

4.4. TASK 4: CIVIL TREATMENT TRAINING CLASSES AND CERTIFICATES

The Contractor shall provide Civil Treatment Training Classes specified to VHA Frontline staff to be held Virtually on the Contractor’s Host provided Website. All Trainings shall provide one (1) Continuous Learning Point (CLP) per hour of training to participants, as CLP Certificates (Deliverable 10) shall be delivered to participants after completion of trainings, which shall be 1 CLP per hour of training completed. Trainings shall be segmented into various groups in the sub-task section(s) that follow-up with the respective deliverables for each training session as specified within the PWS. Training classes shall be held monthly for each class segment of audience throughout the lifecycle of the contract or as otherwise stated in the requirements and Deliverable Table. The Contractor shall provide a link or an automation tool for VHA employees to register and attend virtually Online for the various Instructor-led courses.

4.4.1: Civil Treatment for VHA Employees Courses

The Contractor shall provide Civil Treatment courses for audiences comprised of general VHA employees as reflected in courses/deliverables along with the content and length (hours/days) per course:

The Contractor shall provide Civil Treatment Training for Employees Courses (Deliverable 11), with content geared for an audience of VHA Employees.

At a minimum, each Training session shall consist of the following parameters:

• Service Length: 3 hours per course (1 day)

• Minimum Participant(s): 1 per class

• Maximum Participants: 30 per class for monthly training

• Professional facilitation services specific delivery of Civil Treatment for Employees (Led by a contractor-provided HR Professional). The training should be an interactive, instructor-led program that provides managers with the tools needed to manage fairly and legally in today’s changing workplace.

The training should set standards for inclusive, professional behavior and helps minimize legal and compliance risk.

Topics shall include:

• Preventing sexual and other forms of harassment

• Non-discrimination (Race, age, disability, pregnancy, national origin, religion, and sexual orientation)

• Duty to Act

• Retaliation/protected protest

• Abusive behavior

• Employee accommodations (ADA, FMLA, religious)

• Unjust dismissal

• Fair hiring, selection, and promotion

• Preventing workplace violence

The training shall be facilitated by a Subject Matter Expert in Human Resource Training and diversity topics. The Contractor shall provide a link or an automation tool for VHA employees to register and attend virtually Online as part of the overall course deliverable.

4.4.2: Civil Treatment for VHA Leaders Courses (Deliverable 12)

The Contractor shall provide a Civil Treatment Training for VHA Leaders Courses with content geared toward Leaders.

Each Training session shall, at a minimum consist of the following parameters

• Service Length: 6 hours per course (1 day course)

• Minimum Participant(s): 1 per class

• Maximum Participants: 30 per class

• Professional facilitation services training with a specific delivery to VHA Leaders

Civil Treatment for VHA Leaders should be an interactive, instructor-led program that provides managers with the tools needed to manage fairly and legally in today’s changing workplace. The training should set standards for inclusive, professional behavior and helps minimize legal and compliance risk. Training shall be led by an Attorney Facilitator that specializes in the subject matter with an audience and topic geared toward VHA Leaders.

Topics should include, at a minimum:

• Preventing sexual and other types of harassment

• Non-discrimination (Race, age, disability, national origin, religion, and sexual orientation)

• Retaliation/protected protest

• Abusive behavior

• Employee accommodations (ADA, FMLA, religious)

• Unjust dismissal

• Fair hiring, selection, and promotion

• Preventing violence in the workplace

The Contractor shall provide a link or an automation tool for VHA employees to register and attend virtually Online as part of the overall course deliverable.

4.4.3: Civil Treatment Train-the-Trainer Certification Courses (Deliverable 13)

The Contractor shall provide a Civil Treatment Train-the-Trainer Certification Course, with content geared toward the general VHA-Diversity, Equity, and Inclusion Practitioner. Courses will be offered to a total of 45 individuals resulting to the provision of two (2) courses to cover all employees. Dates for the courses will be discussed and agreed upon during the Kick-Off Meeting.

• Course Length: 3 Days (10:00 am – 4:30 pm EST; 6 Hours and 30 Mins Per Day, totaling 19 Hours per Course)

• Minimum Participant(s): 4 per class

• Maximum Participants: 30 per class

• The contractor conducting the Civil Treatment Certified Instructor Program (CIP) shall provide ODEI’s instructors with the knowledge and skills needed to effectively facilitate any Civil Treatment Basics course. Participants will attend a 2 or 3-day workshop (Course) to focus on specific legal and delivery requirements relating to DEI programs’ content and format. Participant will attend 1 of 2 classes (per year) to make-up resulting to a total of 45 participants per year. One additional class may be required for participants who were unable to attend 1 of the 2 classes as a make-up, if needed at no additional cost to the Government.

The training shall be facilitated by a Subject Matter Expert in Human Resource Training and diversity topics. The Contractor shall provide a link or an automation tool for VHA employees to register and attend virtually Online as part of the overall course deliverable

For registrants, cost should include training materials/manuals and other related supplies for DEI Practitioners. Participants are eligible to receive 20 hours from the Human Resources Certification Institute (HRCI) re-edit for completing the program. Certifications will not need to be renewed and are good for life as there should not be any additional costs to maintain certification status. Certifications are associated with the funding Agency (VHA).

4.4.4: Inclusion Leadership Training Courses (Deliverable 14)

The Contractor shall provide a virtual, Contractor-Hosted Inclusion Leadership Training Course, led by a Civil Treatment Certified Instructor for a target audience of VHA Leaders.

At a minimum, each Training session shall consist of the following parameters:

• Service Length: 6 hours (1 day course)

• Minimum Participants: 1 per course

• Maximum Participants: 30 per course

• Professional facilitation services specifically for the delivery of Inclusion Leadership Training shall be an interactive, instructor- led program that provides managers with the tools needed to build highly inclusive teams and honor peoples’ differences to maximize results. The course covers topics relevant to today’s workplace, such as unconscious bias, bystander intervention, allyship, and having inclusion conversations.

Discussion topics shall include, at a minimum:

• Description of Diversity and Inclusion

• Train leaders on how to develop diverse teams and create an inclusive culture

• Effects and samples of non-inclusive behavior

• Description of Unconscious Bias

• Ways to mitigate negative impacts of unconscious bias in decision-making

• Ways to fairly communicate occupational decisions

• Foster a welcoming an inclusive atmosphere

• Positive dialogue to resolve issues relating to Diversity and Inclusion

The training shall be facilitated by a Subject Matter Expert in Human Resource Training and diversity topics. The Contractor shall provide a link or an automation tool for VHA employees to register and attend virtually Online as part of the overall course deliverable

4.5 TASK 5: CONTRACT MANAGEMENT SUPPORT

The Contractor shall ensure Daily Check-In (Deliverable 15) and provide insights about Contract Management Support issues of risk delays, review the schedule progress, provide brief updates or other concerns for the program to the COR.

4.5.1 Contract Management Support/Services - General Instructions

The Contractor shall provide support services in support of the requirements herein, which include, but are not limited, to the expectation of using typical office automation tools in performance of the requirements and preparation of documents and materials as required.

The Contractor shall submit all required deliverables (training materials/manuals and other related supplies) in editable format compatible with Microsoft formats to be determined by COR, such as WORD, Excel, PowerPoint as described herein.

The Contractor shall deliver documentation in electronic format, unless otherwise directed. Acceptable electronic media include MS Word 2007/2010 or higher, MS Excel 2007/2010 or higher, MS PowerPoint 2007/2010 or higher, and/or Adobe Postscript Data Format (PDF).

The Contractor shall submit all deliverables to the Government Program Manager, Government Team Lead, and Contracting Officer Representative. The Government Program Manager and Government Task Lead will approve the content of deliverables in writing; then the COR will accept deliverables for invoicing in writing.

The Contractor shall ensure Contractors with knowledge of the topics are in attendance to address questions from the ODEI staff.

4.6. TASK 6: STAFFING PLAN

The Contractor shall provide and maintain a Staffing Plan (Deliverable 16). The Contractor shall develop, maintain, and adhere to staffing plan that describes all resources and skillsets needed for the Contractor to meet the requirements coupled with how the Contractor shall obtain resources throughout the lifecycle of the contract. The Staffing Plan shall be considered a living document that reflects the current staffing on the contract. The Staffing Plan shall be submitted with the Technical Proposal. Thereafter, the Staffing Plan will be updated subject to significant changes in staffing.

At a minimum, the staffing plan shall contain:

• Retention Strategy – The Contractor shall identify the retention strategy to minimize staff turn-over

• Staffing Transition Strategy – The Contractor shall identify the transition strategy to move responsibilities from personnel exiting/leaving the program to personnel accepting the associated responsibilities

Poor performance may result in disciplinary action In Accordance With Federal Acquisition Regulations (FAR). The Contractor’s performance on this Contract will be reported to the Contractor Performance Assessment Reporting System (CPARS) on an annual basis. The CO and COR will make use of information performance actions as well as any additional knowledge and information available to them with respect to the Contractor’s performance, to complete the CPARS. The Government will not pay for services that do not conform or do not meet performance standards or have not been properly rendered.

The Contractor will be given an opportunity to correct non-conforming services at no cost to the Government if the services are non-conforming or the contract requirement is unacceptable.

Documenting Performance

• Acceptable Performance: The Government will document acceptable performance in accordance with the chart above. Any report may become a part of the supporting documentation for any contractual action.

• Unacceptable Performance: When unacceptable performance occurs, the COR will inform the CO. This will always be in writing although when circumstances necessitate immediate oral communication, that communication will be followed in writing. The COR will document the discussion and place it in the COR’s file. When the CO determines formal written communication is required, the COR will prepare written notice of performance, and present it to the Contractor's program manager. The Contractor shall acknowledge receipt notice in writing to the CO. The notice will state how long after receipt the Contractor must take corrective action.

The notice will also specify if the Contractor is required to prepare a corrective action plan to document how the Contractor shall correct the unacceptable performance and avoid a recurrence. The CO will review the Contractor's corrective action plan to determine acceptability. Any performance notices may become a part of the supporting documentation for any contractual action deemed necessary by the CO.

7. TYPE OF CONTRACT:

The Contract shall be a Firm-Fixed Price Award.

8. PLACE OF PERFORMANCE

Work shall primarily be performed primarily at the Contractor’s facilities and virtually.

9. TRAVEL

There is no travel anticipated for this effort.

15. SECTION 508 COMPLIANCE

a. NOTICE OF THE FEDERAL ACCESSIBILITY LAW AFFECTING ALL INFORMATION AND

COMMUNICATION TECHNOLOGY (ICT) PROCUREMENTS (SECTION 508)

On January 18, 2017, the Architectural and Transportation Barriers Compliance Board (Access Board) revised and updated, in a single rulemaking, standards for electronic and information technology developed, procured, maintained, or used by Federal agencies covered by Section 508 of the Rehabilitation Act of 1973, as well as our guidelines for telecommunications equipment and customer premises equipment covered by Section 255 of the Communications Act of 1934. The revisions and updates to the Section 508-based standards and Section 255-based guidelines are intended to ensure that information and communication technology (ICT) covered by the respective statutes is accessible to and usable by individuals with disabilities.

15.1 SECTION 508 – INFORMATION AND COMMUNICATION TECHNOLOGY (ICT) STANDARDS

The Section 508 standards established by the Access Board are incorporated into, and made part of all VA orders, solicitations and purchase orders developed to procure ICT. 15.2 COMPATIBILITY WITH ASSISTIVE TECHNOLOGY

The standards do not require installation of specific accessibility-related software or attachment of an assistive technology device. Section 508 requires that ICT be compatible with such software and devices so that ICT can be accessible to and usable by individuals using assistive technology, including but not limited to screen readers, screen magnifiers, and speech recognition software.

16. KEY PERSONNEL

Skilled experienced professionals and/or technical personnel are essential for successful Contractor accomplishment of the work to be performed under this effort. The Contractor agrees that key personnel shall not be removed, diverted, or replaced from work without prior notification of the CO or Contracting Officer Representative (COR). Contractor staff shall be fully qualified and have the required level of experience necessary to accomplish the requirements of the PWS.

The Contractor shall provide, at a minimum, Key Personnel as reflected in the table below:

Program/Project Manager

Serving as a Program Manager, typically responsible for organizing, directing, and managing all aspects of contract operational support functions involving multiple complex an inter-related projects tasks that often require managing teams of contractor personnel. Establish and maintain technical and financial reports to show progress of projects to management and customers. Organize and assign responsibilities to subordinates, oversee the successful completion of all assigned tasks/training. Work closely with Government officials or representatives and customer leadership to communicate milestones and needs to ensure all tasks/training are completed to prevent delay or major work stoppage.

At a minimum, possess 3+ years managing a major (multiple workstream) program for a Government Agency or large-scale private organization

At a minimum, possess 3 years’ experience supporting and facilitation Civil https://www.access-board.gov/guidelines-and-standards/communications-and-it/about-the-ict-refresh/final-rule https://www.access-board.gov/guidelines-and-standards/communications-and-it/about-the-ict-refresh/final-rule

Treatment Training, and or;

At a minimum, 2 years project management experience in a Government agency

Current Program Management Professional (PgMP) or equivalent Certification and/or Project Management Professional (PMP) Certification is preferred

HR Facilitator Serving as a HR Facilitator, typically responsible for delivering training programs that promote Civil Treatment and inclusive behavior in the workplace. Provide course materials, lead workshops, to foster an environment of civil treatment and mutual respect. The facilitator will ensure that VHA Employees understand the training material.

At a minimum, an HR related degree and 3 years’ experience in Civil Treatment Training

Attorney Facilitator

Serving as an Attorney Facilitator, typically responsible for delivering training programs that promote Civil Treatment and inclusive behavior in the workplace. Provide course materials, lead workshops, to foster an environment of civil treatment and mutual respect. The facilitator will ensure that VHA Leaders understand the training material.

At a minimum, a Licenses Attorney with 3 years’ experience in Civil Treatment Training

Civil Treatment Facilitator

Facilitator for Civil Treatment Training (Certified Preferred) typically responsible for delivering training programs that enhance workplace civility, respect, and inclusion. Provide certified curricula to educate DEI Practitioner Provide certified training materials and methods to ensure employees understand on civil treatment, discrimination, harassment.

At a minimum, an HR related degree and 3 years’ experience in Civil Treatment Training
