About this file

This document appears to be a government response to questions regarding a solicitation for Proceeding Support Services. The key details are:

The solicitation is seeking a qualified contractor(s) to provide legal proceeding support services including transcription, court reporting, and proofreading/editing of transcripts. The required services include accurately transcribing all audio/video recordings of legal proceedings and labor dispute proceedings, providing skilled court reporters to record spoken dialogue, and proofreading transcripts to ensure accuracy. The successful contractor must have a minimum of 5 years of experience providing these services to government agencies. The contract will be for a 12-month base period with 4 optional 12-month extensions.

The response addresses various questions about the transcription turnaround times, deliverables, invoicing, formatting of AI-generated transcripts, and whether the contract will be awarded to multiple vendors. It confirms this is a multi-award contract with 3 awardees, and that pricing will be based on either a price-per-page or hourly rate model depending on the task. The AI-generated transcripts are estimated to be approximately 90% accurate.

Generalnotice a discrepancy in the due date. Sam.com states this is due 7/11 but the SF 1449 form states 7/8. Can you please confirm the due date and time for this opportunity?Responses are due 7/12 at 4PM EST
7Task 1.3 Transcription Services"The Contractor shall provide the specific deliverables described below within 10 business days for regular transcripts and 3 business days for expedited transcripts."the Turnaround Times (TAT) are much shorter, 10 days and 3 days as opposed to the previous 15 days and 5 days. The previous contract was calendar days-not business days.
7-10Task 1.3 Transcription Services"The Contractor shall provide the specific deliverables…"On page 7, 8, 9 and part of page 10, Task 1.3 Transcription, I do not see a requirement to provide a Contractor Report with the Hearing PDF to explain any issues that come about during the transcribing of the audio file. We had been asked in the past to provide Contractor Reports if there were issues where the Names on the BVA Spreadsheet do not match what the Judge states, or if there is an Claim ID matching issue, or if there are more inaudibles than two times the number of pages (although we frequently send Contractor Reports for even less inaudibles than 2x the amount of pages), etc., -- question is will this continue with the new contract? Please see Deliverables Schedule: Task 1.3 Transcription Services for an explination on what is required from the contractor.
10Task 2 Court Reporting“The COR the Contractor shall issue invoice(s) for payment if not rejected by COR after 3 (three) business days. Invoice should be submitted in the payment system not later than (NLT) 30 days from rendering services.”I believe a word was left out, however, my question is for Court Reporting, we can invoice 3 business days after submitting the work for Court Reporting if it is not rejected? Later in the solicitation, on page 19 (C), it states invoices shall be submitted once each month (or more frequent intervals if approved by the Contracting Officer), which seems contradictory to a degree. We currently submit our invoices once a month in agreement with the COR. Can you tell me if this will be different for Court Reporting as shown on Page 10?Please see the updated section.
11Task 3 Proofreading and Editing of AIWill the AI transcripts be in Microsoft Word Format like the Templates provided are?The AI-generated transcript will likely be delivered to the proofreader in Microsoft Word. It is currently unknown what level of formatting will be completed prior delivery to the proofreader vs. what formatting the proofreader may need to carry out.
11Task 3 Proofreading and Editing of AIAre the errata sheets expected in certain format? If they are edited in Word, can the Track Changes Show All Errors saved document fulfill this requirement of the deliverable of “errata sheets”? This is currently how our transcriptionists learn from the errors, we provide the proofed/edited reports showing ALL MARKUP to them for review. We do not have a specific method in mind for the errata sheets and are open to discussions on how best to facilitate given the business processes we will employ to process transcripts.
12D. Specific Mandatory Task and Deliverables, Task TwoWill Court Reporting only be virtual, or will it need to be in-person at the hearing? We have done both. How much notice will be given if in-person? Will there only be a limited number of places these are done if “in-person”? Or, could these be at any RO?Both virtual and at the Board of Veterans' Appeals headquarters. We will schedule as soon as we receive notice of requirement.
43Section D - Contract Documents, exhibits or attachmentsthere is no “Electronic Template Cover Page” as noted on page 8 as Attachment A1. Can we get that, or will that be provided upon award? Please see the first page of ATTACHMENT A- SAMPLE TRANSCRIPT HEARING for the Electronic Template Cover Page.
GeneralWill this contract be awarded to more than one vendor? Currently there are three of us and have been for the last 6 years, but don’t see that addressed in the solicitation. This is a multi-award. There will be three awardees of found to be technically acceptable.
Attachment BAttachment B - Pricing ModelColumns H and I are Pages and Hours, Columns F and G look to be wanting hours and the price per hour. Will this contract be at a fixed price per month (like it is currently) based on our labor rates X hours needed to perform each task? Or, will this contract be based on pricing per page, i.e. Invoices will take page rate times number of pages to come up with amount to invoice, which will then be different each month? The contract will be based on either price per page or hourly rate depending on the task as indicated on the updated Pricing Model. Please be advised this requirement falls under the Dept of Labor wage determination and as such a proposed labor category is required for each CLIN.
11Task 3 Proofreading and Editing of AICan you tell us how accurate the AI generated transcripts are? We need to know approximately how accurate they are to determine the level of effort needed by proofreaders. It is believed that the AI generated transcripts will be approximately 90% accurate for spelling, grammar, correct identification of speakers, etc…
Attachment BAttachment B - Pricing ModelEach CLIN has 3 rows. We only need to submit information on a single row per CLIN correct? Each row is for a separate proposed labor category. Only fill out the number of rows needed fullfil the task. If only one is needed, fill out one row. If more than 3 are needed please add additional rows.
