The Contractor pays the provider directly and then invoices the Department of Labor (DOL)’s Office of Worker’s Compensation Program (OWCP) at a rate that incorporates revenue for the Contractor, but is less than the Federal Employee Compensation Act (FECA) Fee Schedule located via the following link:
https://www.dol.gov/owcp/regs/feeschedule/fee.htm
The Contractor selected shall negotiate its own contract with pharmacies and providers for services that shall generate a discount for generic and brand named drugs, DME, and diagnostic services at a rate that is below the FECA fee schedule and agreed upon at award. The PBM Program will allow VA employees who are injured on-the-job to receive services at no direct cost to the VA. Participation in the PBM Program is voluntary and does not affect the employee's option of choosing their own provider as stipulated by the FECA. There will be no funds obligated under this contract. The contractor shall provide a monthly copy of all invoices submitted to the DOL’s OWCP for reimbursement to the Contracting Officer, Contract Specialist, and Contracting Officer’s Representative identified in Section B.1 of the contract/award.

The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor compliance with the subcontracting commitments.
B.3 PERFORMANCE WORK STATEMENT
The Department of Veterans Affairs (VA) employs a workforce of approximately 380,000 Federal civilian employees. There were approximately 15,000 VA cases under active case management in FY 17.
These cases generated $21,971 in prescription costs and $37,553,546 in durable medical equipment (DME), Imaging, diagnostic services, and physical therapy costs on the VA Chargeback in FY 2017.
Based on an average of this historical data, the annual estimated cost is $70,663,998, and the total estimated cost for a three-year contract is $211,991,994. In Fiscal Year (FY) 2017, VA's Pharmacy Benefit Management (PBM) Program saved approximately $1,750,000 in medical costs on the VA Workers’ Compensation (WC) Chargeback Report. The current participation rate is 90 percent.
2. PURPOSE
The VA is seeking an expert and experienced Contractor, specializing in federal WC, to support the PBM Program or WC. The PBM Program will be a national program for VA employees who are injured on the job, and require prescription medications, durable medical equipment (DME) (walkers, crutches, canes, splints, muscle stimulators, etc.), physical therapy and diagnostic services (Magnetic Resonance Imaging (MRI), Computerized Tomography Scans (CT), Radiology, X-Rays, Electromyogram (EMG), and Nerve Conduction Velocity (NCV) studies. The function of the PBM is to provide a more efficient way for employees who are injured on the job to obtain the services they need, without the need to save receipts or file reimbursement forms.
3. PERIOD OF PERFORMANCE
The estimated contract Period of Performance (PoP) is for a 6-month base period starting on June 29, 2018, through December 29, 2018, with five 6-month option periods (three years total if all options are exercised).

2. Group 2 is comprised of new FECA claimants. These employees are newly injured on the job and have filed FECA claims pending adjudication by OWCP.
VA requires that the PBM Program provide a system for first-fill prescription coverage for employees who sustain a traumatic injury at work. The PBM Program will provide a pharmacy card system to these employees as part of the VA injury packet. SECTION C - CONTRACT CLAUSES
C.1 FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL
ITEMS (JAN 2017)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights—
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.
(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at FAR 52.233-1, Disputes, which is incorporated herein by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.
(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.
(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
