About this file

This is a vendor Q&A document for RFP 36C10G25R0013, which addresses questions about a Veterans Health Administration (VHA) solicitation for Intensive Care Ventilators. Key clarifications include: there are only 4 volumes required for proposals (not 5 as originally stated); vendors must submit three past performance references from the last three years; and vendors can propose additional ancillary products with quantities of zero in the pricing volume.

The Q&A addresses concerns about potentially restrictive specifications regarding SpO2 capabilities and proprietary software (IntelliSync+), clarifying that vendors can propose equivalent features or state if they don't provide certain functionalities. Additional clarifications indicate that cybersecurity requirements were approved by ISO and Privacy Officer, and vendors can propose preventative maintenance/warranty packages and consumables for consideration by the contracting and technical teams. Questions are due by 4:30 PM EST on December 19, 2024, and proposals are due by 4:30 PM EST on December 26, 2024.

RFP 36C10G25R0013 Vendor Questions Answers are in red font

1. In attachment D, on page 10, under A. Proposal Submission there is a statement that the Vendors quote shall consist of five volumes, but there are only 4 volumes listed. Should there be 5 volumes listed? If so, what is the 5th? This is a typo, there should be only 4 volumes.

1. For the past performance requirements: Are there a certain number of past performances you are looking to obtain in the volume? As this is an SDVOSB set aside, how many can be from the SDVOSB and how many can be from the manufacturer? Attachment D pages 12-13 states: “The offeror shall complete Attachment F: Past Performance Reference in its entirety, listing a total of three contracts/orders for work performed in the past three years or currently being performed. The Government will make the determination of relevance (based on size, scope, and complexity of requirement). Contracts/orders listed may include those entered into with the Federal Government, agencies of state and local governments and commercial concerns. Offerors may also submit past performance information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the acquisition. For the purposes of this solicitation, a major subcontract is defined as 20% of the total contract effort. Data concerning the prime contractor shall be provided first, followed by each proposed major subcontractor, in alphabetical order.”

1. The solicitation states that “Vendors may quote any additional ancillary products which they deem to be essential to the functionality of the proposed solution; these items must be captured in the Vendor’s pricing volume with a quantity of zero.” Do you want vendors to include value adds, such as ventilator related accessories, consumables and optional features, which could be an extensive list, or just products that are absolutely essential to meet the salient characteristics?

A vendor can propose additional items. That would be up to the contracting team and technical team to determine if they would be a needed item. We don’t know until we see what they are proposing.

1. With regards to the CLINs:

1. We feel CLINS 0003 and 0005 are potentially overly restrictive as only Hamilton has SpO2 has these built into the ventilator. Since all since all integrated patient monitors already provide SpO2 we would like to request this be removed to allow for free and open competition as this is posted as a brand name or equal solicitation.

1. We would like to request that CLIN 0013 for IntelliSync+ Application be removed as it is a proprietary software application available only on Hamilton ventilators. This prevents free and open competition. In its place we would request more specific information regarding the functionality required to meet the technical requirements of this application.

A vendor proposal must meet the salient characteristics. This is a BNOE based on meeting the salient characteristics. Additional features beyond the SCs will be evaluated under the sub-factors to determine a vendor’s strengths, weaknesses, and deficiencies. If their device includes that feature, they should simple state that on the CLIN list. They can propose an equivalent CLIN item, state that that function, option, etc. is included in their particular CLIN or state they do not provide that feature.

1. Our Servo Ventilators have ATO cybersecurity designation; does the VA ORE have any cybersecurity or risk management framework requirements for this contract?

? The 6500 for this requirement was signed by ISO and the Privacy Officer. They did not mention anything else.

1. Are you able to update the Price Cost Schedule to include line-item consumables (Flow Sensors, O2 Cells, Circuits) required for operation of stated equipment?

A vendor can propose additional items. That would be up to the contracting team and technical team to determine if they would be a needed item.

1. Does the VA plan to offer Preventative Maintenance/ Warranty packages for these ventilators?

A vendor can propose additional items. That would be up to the contracting team and technical team to determine if they would be a needed item.
